Mrbi 1=t, ishand'og-ChaPtel III, Article 6 of the Ordinances of the City of Bangor - Parking Be it ordained by the Cay Council o%the City ofBanpor, as f i4bmn' THAT Chapter 1II, Article 6 of the Ordinances of the City of Bangor be amended by deletion of the existing provisions and replacing them with the following: Sec. 1 Vehicle Parking. Except when necessary in obedience to traffic regulations, traffic signs or signals, it shall be unlawful and a violation of this Article for any person: 1.1 Positioning of Vehicle. To atop, stand or park a vehicle in a r o dway other than parallel with the edge of the roadway, headed in the direction of traffic and with the curb side wheels of the vehicle within six inches of the edge of the roadway, except as provided in the following; upon these streets which have been marked or signed for angle parking; and in places used far the loading or unloading of merchandise or materials, the vehicles used for the transportation of the s may back into the curb but not onto the curb, whenever it is impossible .. to load or unload from the side of the vehicle, but n vehicle shall remain wan backed up to the curb except when actually leading or unloading. 1.2 Parking Vehicles fiuttended. To allow a vehicle to stand on a street unattended, without first setting the brakes thereon and stopping the motor of said vehicles, and when standing upon a perceptible grade, without turning the front wheels of such vehicle to the curb or to the side of the street or highway. L.3 Parking Within an Individual Parking Space. To park a vehicle so that such vehicle Is not entirelywithin an individual parking space specified and narked off. 2 Sec. 2 Parking Prohibitions. It shall be unlawful and in violation of this Article for any person: 2.1 Parking Prohibited At At Tame � Schedule V. To stop, stand o park a vehicle on the streets Or portions Of streets duly marked or posted and which are described orspecified in Schedule V, and have so been designated by the City Meager and approved by order of the City Council. Said schedule sha1L be maintained by the City Clerk and available for public inspection at any reasonable hour. 2.2 parking, Limited to Two Hour$ - Schedule VI. To stop, stand or park a vehicle more than a O (2). hours bet a the hours of nine a and fiveP.M except on Sundays and holidays when such parking may be permitted, on those streets or portions of streets duly marked or posted and which are described or specified in Schedule VI and have been so designated by the CityPiarmger and approved by Order of .the City Council. Said schedule sba1L be maintained by the City Clerk and available for public inspection at any reasonable hour. 2.3 Parking Limited to ane Hour - Schedule VII.To stop, stand o Park a vehicle for move than one (l) hour between the hours of nine a and five p.m., except on Sundays and holidays when such parking may be permitted, on those streets or portions of streets duly marked x posted and which are described or specified in Schedule VII, and which have been duty marked or posted and have been a designated by the City Manager and approved by order of the City Council. Said schedule shall be maintained by the City Clerk and available for public inspection at any reasonable hour. 2.4 Trailer Truck Parkin Limited - Schedule VI11. TO stop, Stand r park any trailer truck for purposes of leading or unloading between the hours of eleven a and five-thttty p.m without first obtaining special permission to do so from the Police Department on those streets described and specified in Schedule .VIII and have so been designated by the City Manager and approved by order of the City Council. Said schedule shall be maintained by the City Clerk and be available for public inspection at any reasonable hour. 2.5 Parkin Prohibited Except for Loading or Unloading - Schedule I%. To stop, stand Or park a vehicle, whether occupied or annot, at y time except while with all dispatch actually engagedIn the process of Loading or unloading or taking on or discharging passengers within any of the spaces described or specified in Schedule I%, and which are duly marked or posted, when designated by the City Manger and approved by order Of the City Council. Said schedule shall be maintained by the City Clerk and available for public inspection at any reasonable hour.. Sec. 3 Wintertime parking. It shall be unlawful and In violation of this Article between October 15 and April 15 or the fallowing year, for any person: 3.1 Removal of Cars Hindering Snow Removal. To atop, stand or park, or allow to remain, a vehicle in o upon any street, public way, public square, o public Parking area within the City of Bangor, so as to interfere with or hinder snow removal, or snow plowing operations. 3.2 Parking Limited to Alternate Sides of Sheets. To atop, stand or park a vehicle which is act parked an the proper side of the street in accordance with the following: Unless otherwise pasted, on the odd numbered days of the month, packing will be permitted on the odd numbered aide of each street: and on the a ,mbered days of the month, parking will be permittedonthe even limbered side of each street. The alternate aide parking limitation will apply to metered areas only until the snow has been removed to the curb line. 3.3 Violations. Any officer of the pedant Police Impartment is hereby authorized to remove and taw away or have moved or towed away by any commercial towing service, any vehicle parked in violation of Sections 3.1 and 3.2 and to have said vehicle placed i suitable plat , all at the expense of the owner of each vehicle. J 2.6 Parking Prohibited Near. Fire Hydrants. To atop, stand or park, along the side line of any traveled way, any vehicle, either o cupied o not, within twelve (12) feet of any fire hydrant. 2.7 Parking PcoM1ib i[ed in Driveways, Sidewalks and Esplanades. All such meters shall comply With the conditions as set forth in the first paragraph of Chapter III, Article 1, Section1.12 and said meters shelf be undee4he management, supervision and control of the City Manager of the City of Impact. 4.1 Establishment of Parking Meter Zones. On -street and off-street parking meter zones shall be established by the City Manager with approval by orderof the City Council. The City Clerk shall maintain a schedule of ail such approved packing meter zones. 4.1.1 on -Street Meter Zones. There shell be five parking meter zones s for on -street Parking which shall be designated as follows: (a) Five Hour Meter Zones. Parking in this zone for more than five (5) hours during th; hours of nine a.m. and five p.m., except on Sundays and holidays and shall b, unlawful and in violation of this Article. A fee of ten cents for five hours is hereby designated for this zone and meters installed therein shall be des Lgnatdd to accommodate ten cent coins only. (d) Twelve Minute Meter zones. Parking in this zone for more than twelve minutes during the hours of nine a five p.m except on Sundays and holidays shall be unlawfuand i violation of this Article. A fee of o cent fotwelve minutes is hereby designated for this 2 and maters therein installed shall be designed to accommodate pennies. (e) Designative of Metered Zones. The streets o portions of streets t0 be included in each zone shall be designated by the City Manager and approved by order of the City Council. The City Clerk shall maintain at all times J a record Of the areas included in each metered zone. 4.1.2 Off -Street Meter Zones. The following public parking areas e hereby designated and declared to be off-street parking meter zones, (a) Abbott Square. Abbott Square, so-called, is hereby designated to be an off-street meter This area is to be divided into two general zones, e to be known a the shopper parking area and the other to ba known as the aLl-day parking area. Parking for more than 120 minutes s in the shopper e Parking area during those hoursof the day specified in Section 4.1.1 (b) of this Article is hereby prohibited. All day parking shall be allowed in the all -day parking area. A fee of ten cents for 120 minutes is hereby designated for the shopper Parking area and a fee of ten cents for e half day ortwenty c s for all day is hereby deafgv[dd for the all day parking area. (b) Haymarket Square. The area to the south of Pickering Square only knowns Haymarket Square is hereby declared to be an meter, ne offstreet meterand Parking therein form ethan 120 minutes during those hours of the day specified in Section 4.1.1 (a) of this Article is hereby pxohlbited. A fee of ten cents for 120 minutes is hereby designated for this off-street parking zone. (c) Moser House Parking Area. The area [®only known as the burger House Parking Area and move particularly described as follows: Being that portion of Onion Park new remaining following the 7 impletion of the new Bangor -Brewer Toll Bridge and bounded as follows: on the south by Summer Street, on the north by Ramp "A" approach to the raw bridge, in the east by Union Street, i the at by My Street, and more fully shown on a State Highway Commission Plan of the Bangor -Brewer Bridge, Sheet No. 2Bdated ]anuary, 1953, and also being a portion of the area a described' In a Penobscot Registry of Deeds, Volume356, Page 4, and also recorded in the City of Bangor Deed Book, Volume 1, Page 74, is hereby declared to be an off-street metered zone and shall be divided into two general s to bekknown a shopper -parking area and the other a the aLlBday parking area. Parking form a than 120 minutes in the shopper parking area during the hours of n . to five p.m. is hereby prohibited. All day perking shall be allowed In the all -day parking area. A fee of tencents for 120 minutes is hereby designated for the shopper Parking area and a fee of ten cents for o e -ha Lf day r twenty cents for all day is hereby designated for the all -day parking area. (d) Columbia Street Parking Area. The area commonly known s the Columbia Street Parking Area and more particularly described as follows: The lower Level of the City -owned propertybounded by Columbia Street, Middle Street and Hotel Terrace is hereby declared to be anoff-street metered zone aM parking therein for more than 120 minutes during those hours of the day specified In Section 4.L.1 (a) of this Article is hereby prohibited. A fee of ten cents for 120 mina[s in hereby designated for this off-street parkinga one. (e) Atlet Hotel Parking Area. The area commonly known as the Arles Hotel Parking Lot and more commonly known and described as follows; The Ctcy-owned Parking area bounded on the south by Spring Street, on the West by Harlow Street, on the north by Cumberland Street and on the east by privately owned land. This a s hereby declared to be a off e street metered x anx dshall'be metered for aLl-day parking. A fee often cents for one -ball day or twenty cents for all day is hereby designated. (f) Water Street. The area on Water Street, conmeenaing at Broad Street and extending easterly to Henduskeag Stream Is hereby declared to be an off- street metered lone and parking therein for more than 120 minutes during those hours of the day specified in Section 4.1.1 (a) of this Article is hereby prohibited. A fee of ten cents for 120 minutes is hereby designated for this off- street parking zone. (g) Kenduekeaq Stream Parking Lot. The area commonly known as the &enduskeag Stream parking Lot and more commonly described as follows; The City -caned parking area bounded by the State and intended Street Bridge on the north, the Washington Street Bridge on the South, the rear of privately owned property on Broad Street and the rear of privately owned property on Exchange Street. (h) Nigh Street Parking Area. The area only known as the High Street parking Lot and more particularly described as follows: The upper level of the City-ownedproperty bounded by Nigh Street, Middle Street and property owned by Milan is hereby declared to be an off-street entered zone and all day parking shall be allowed in this A fee of ten cents for o:d-half day or twenty cents for all day is hereby designated. (i) Stetson Square Tackled Lot. Theecommonly known as the Stetson Square Parking Lot and more particularly described an follows. The City -owned parking area bounded on the north by State Street, on the South by York Street, on the west by the All Souls Church property and on the east by First National Stores, Inc. property is hereby declared to be ane off-street metered v and all -day parking is allowed in this a A fee ofn t cents far one-half day or twenty cents for all day is hereby designated. (j) Bangor International Airport. All metered parking lots within the area heronly known as Bangor International Airport are eby declared off-street metered a A fee of ten cents for twenty minutes is hereby designated. 4.2 Time Limitations. The provisions of Section 4.1 shall not apply to vehicles parked in on -street o off-street individual metered parking spatewithin the areas hereinabove designated, when such vehicles a a parked between the hours of five p.m. and nine a , Mondeythrough Friday of each week. The provisions of this section shall also not apply on Sundays or legal holidays. 4.3 Truck Zones - Covering Meters. WMnevex, to the opinion of the City Manager there isnot sufficient justification for the establishment of a truck zone, he may, upon written application for any person owning or operating a piece of business fronting on a meter wage upon recommendation of the Chief of police, authorise the Chief of Police to issue to the applicant a device or cover to be used for c ealing a parking meter head at such time it y be n ary for the purposeof reserving a parking space ma to permit loading and unloading of true" and for no other purpose. The device orcover shall be issued for a period of one year but may be reissued for subsequent one year periods upon application for renewal. The applicant shall pay to the Police Department a feed five ($5.00) dollars for the fbrst year and one ($1.00) dollar for each renewal. Said device or cover shall be used only c eat one parking meter to be specified by the City Manager. Said device ocover shall bear n it the number of the me which it i obeused. It shall us only be ed when ne ary to reserve parking space for loading and wLoading of crows. Any such device issued in accordance with this ordinance may be recovered and permit revoked, by the Chief of Police, whenever he shall find that it is being used contrary to the terms of thin Article. 4.4 Collection of Parking Meter Coins. The City Meager shall designate aone person o persons to collect the coins deposited in parking meters. In collective such coins, the person or persons so designated shall. record the reading of the coin register and shall deliverthe coins collected to the City Treasurer of the City of Bangor. The Treasurer of said City shall count the coins so delivered, and deposit the a credited to the City of Bangor. The persona collecting said coins shall provide the Treasurer with a statement of the reading of the coin registertand the aerial banker of each individual meter. 4.5 'Meter Violations. It shall be unlawful and flv iolation of this Article for any person to: 4.5.1 Park, or permit to remain parked, a vehicle in v metered Parking apace when the time signal o the parking meter for such space indicates that the permissible parking time has expired. 4.5.2 Park a vehicle in a metered parking zone for a period of time exceeding the maximum time established for parking in said zone. 4.6 Willful Damage to Parking Meters Prohibited. it shall be unlawful and violation of this Article for any sets onto deface, injure, tamper with, open or willfully break, destroy or impair the usefullness of any parking mater installed under the provisions of this Article. 4.7 Suposit of Slugs in Meters Prohibited. It shall be unlawful and a violation of this Article to deposit or cause to be deposited 1n any parking meter, any device,slug o metallic substance o any substitute for a ane cent,five cent or ten cent currency of the Unit€d States. Sec. 5 Establishment of Truck Zones. Truck zones for the leading and on - leading of merchandise, may be established in a parking meter zona, by the City Manager with the appxoV_akrby order of the City Council. It Shall be unlawful and a violation of this Article for any passenger vehicle to park in such truck zones. It shall also be unlawful and aviolation of this Article for truck to park Insuch truck zone a period of time longer than is required for the loading and unloading of merchandise. Sec. 6 Off -Street Permit Parking. It is hereby declared to be a policy of the City of asngor to provide for off- set permit parking. From time to time the City Manager may, with approval of the City Conceal, take all necessary action to provide ,for off-street parking areas within the City for . parking of motor vehicles by permit only; said permits to be issued by the. City Manager under such terms and conditions as may be promulgated by said City Manager and with approval of the City Council. 6.1 Off -Street Permit Parking cots Established. Off -Street permit Parking lots shall be esrabl lshed by the :City Manager, with approval of the City Council, with a descrkption thereof to be filed with the City Clerk and made available for inspection at any reasonable hour. 6.2 Removal of grauthorized Vehicles. No =tax. vehicle shall he permitted within any off- street permit peeking lot established pursuant to the provisions of this Sectionunless a permit for such purposes has been issued as piw ided 'herein. In addition to the other remedies provided hexefn, any officer of the Sweden Police Department Is hereby authorized to remove and tax away,or ua the removal and towing way, of any vehicle parked in violation of this SEcrt:4pk:.. Any 10 such vehicle shall be restated to its lawful owner upon payment of all costa of removal, including, but not limited to, toving fees and service charges. 6.3 Violations. It shall be unlawful and in violation of this Section for any person to: 6.3.1 sense, allow, permit orsuffer any vehicle registered in the na of, or operated by such person, to be parched within any established off-street permit parking area within the City unless a permit fox such purposes has been issued to such person As provided herein. 6..3.2 cause, allow, permit or suffer any vehicle registered in the lame of, at operated by such per o be parked within any established p'J off-street permit peeking area within the City In violation of the terms add conditions of any permit issued as provided herein. 6.4 Waiver of Court Hearing for Violation. Any person accused of violation of a provision of this section selected to off-street permit parking my Voluntarily waive his or her tight to appear and defend before any Court of judicial tribunal the charge made against him or bar for such illegal parking by paying to the municipality the sum of Three ($3.00) Dollars within five (5) days of the timesuch alleged offense was committed. Members of the police Department e hereby authorized to refrain from instituting prosecution for the alleged offense far a period of five (5) days from the time such alleged offense was c o®ftted. 6.5 Penalties. Any person, firm or corporation who shall violate any provision of this section shall, uponcnviction thereof and in addition c any other remedies provided herein, be subject to a fine of not less than Ten ($10.00) dollars nor v¢ than One Hundred ($100.00) dollars. every day that a iolation continues shall he Nested a separate offense. Sec. ] Marking Off of Parking Spaces. The City Manager is hereby authorized and directed to designate and mark off individual parking spaces along streets and in off-street public Parking areas, s he deems necessary. Sec. 8 Free Parking Spaces provided. Nothing in this Article shall be ons trued as prohibiting the City of Harper from providing free parking spaces for taxicab stands. Sec. 9 Prim Facie Evidence, In accordance with 30 HASH §2151 the fact that a vehicle is in a metered parking space when the time signal on the parking meter for such space indicates no parking permitted without the deposit of a coin or voice; shell be prima facie evidence that said vehicle has been parked in said parking space longer than the lawfully permitted period. In addition, the fact that vehicle Is unlawfully parked shall be prima facie evidence of the unlawful parking of such vehicle by the person to whose name such vehicle is registered. gee. 10 waiving Court Nearing for violation. 10.1 Any person accused of a violation of any portion of this Article relating to parking at an expired an ter, overtime parking or illegal occupancy Of two parking spaces may voluntarily waive his or her right to .appear and defend before any Court of judicial tribunal the charge made against him or her for such illegal parking by paying t0 the municipality the am of fifty cents within the first thirty (30) days of the time such alleged offense was committed or one dollar ($1.00) within the second thirty (30) days of the time such alleged Offense was committed. 10.2 Any person accused of a violation of any portion of this Article relating to parking in a no parking area r parking on M e wrong side of the street any voluntarily waive his r her right to appearand defend before any Court or judicial tribunal the charge made against him or herfor such illegal parking by paying to the municipality the am of three dollars ($3.00) within five (5) days of the time such alleged offense was committed. 10.3 Any person sed of a violation Of any portion of this Articleprohibiting double parking, parking In a hazardous illegal night parking or illegal interference or blacking of snow m oval y voluntarily waive his or her right to appearand defend before any Court As judicial tribunal the charge made against him or her for such illegal parking by payingtothe municipality the am of five dollars ($5.00) within five (5) days of the time such alleged offense was committed. 10.4 Any person accused of a violation of any portion of this Article other than those violations specified in subsections 10.1, 10.2 and 10.3 above way voluntarily we fve his or her right to appear and defend before any Court or judicial tribunal the charge made against him or her for such illegal parking by paying to the mu icipalitythe a of two dollars ($2.00) within five (5) days of the time such alleged offense was cadmitted. 10.5 'Members of the Police Department are hereby authorized to refrain from instituting prosecution for the alleged offense far aperiod of five (5) days from the time such alleged offense was committed. Sec. 11 Repeal. .Article 6 o Chapter III of the Ordinances of the City of.,9angot, formerly existing, is hereby repealed except that said Article 6 shall remain in full far and effect for the trial and punishment of all pas[ violations of it and for recover of penalties and forfeitures already incurred.
