THAT the City Manager is hereby authorized and directed to take all
necessary action to provide for the lease from the Urban Renewal Authority
of land Located on Broad Street for purposes of providing temporary public
parking in the downtown area, a copy of said Lease being attached hereto
and made a part hereof.

This Lease made and entered into this day of
1974, by and between the Urban Renewal Authority of the City of Bangor (Lessor)
and the City of Bangor (Leese¢).
(1') Iv consideration of the rents and the covenants herein contained
on the part of the Lessee to be paid, performed and observed, Lessor hereby
leases to Lessee and the Lessee hereby Leases from Lessor, subject to the
terms and conditions hereinafter set forth that certain Lot or parcel of land
located in downtown Bangor, Penobscot County, State of Maine, to wit:
Beginning at the intersection of the northerly right-of-way
line of Water Street and the westerly line of Rendus keag
Plaza at coordinates N 352324.68, E 429834.23, based on the
Maine State Coordinate System East Zone( thence north 12°-
26'-40" west along the westerly Line of geoduakeag Place for
a distance of 274.95 feet to a point, said point being on
the southerly Line of the proposed Pedestrian Walkway{ thence
south 73--31'-L4" west along the southerly line of the pro-
posed Pedestrian Walkway for a distance of 265.99 feet to the
easterly line of a new right-of-way, to be known as Merchant's
Plaza; theme south 17°-09'-36' west along the easterly line
of said Merchant's Plaza for a distance of 186.52 feet to the
northerly right-of-way line of Water Street; thence South 800-
081-10" east along the northerly right-of-way line of Water
Street for a distance of 269.56 feet to a point; thence
continuing along said northerly right-of-way line of Water
Street on a bearing of N J3--49'-50" exec for a distance of
110.21 feet to the point of beginning.
(2) Lessee shall pay the rental of $1.00 on the date of the execution
of this lease and $1.00 on the anniversary date thereafter. The payment of
$1.00 is hereby mknowledged. The lease Is to be on a month to month basis
with Lessor and Lessee each having the right to cancel said lease upon giving
thirty days notice in writing to the respective party. Eventhough the
cons iteration of said lease is to be paid yearly, it is understood and agreed
by the Lessor and Lessee that the lease is on a month to month basis as
aforesaid.
(3) Lessee shall use said leased land as a public parking lot only
unless Lessee in writing request an additional use or uses of Lessor, with
said additional we or uses not to be unreasonably withheld by Lessor.
(4) Leasee hereby takes the leased area in an as is" condition and
promises to provide and maintain all parking signs in the leased area and
shall keep the leased area free and cleat of all dirt, trash, snow, refuse
and other matter and in general shall keep the leased area an aclean and
sanitary condition.
(5) Leasee agrees not to assign or sublet the leased area without
the consent of Lessor. Lessee agrees to furnish all utilities that are to
be geed in the leased area.
(6) Leasee shall at its own expecte and at all times during the
term of this lease obtain and secure for its protection public liability
insurance in the amount of $300,000/$500,000 and property damage insurance
in the amount of $25,000. Lessee agrees to hold harmines the Lessor from
an'ig)and all claims for injury or damages arising out of or to connection
with itelfperatiou of the parking lot. Evidence of insurance and notice
of cancellation shall be furnished to Lessor.
(7) It is understood by the Lessor and Lessee that Lower in
actively engaged in developing the leased area for commercial we and in
connection therewith Lessee hereby consents and authorizes the Lessor to
permit developers to make soil teats, locate and park equipment on a
portion of all of the leased area, and do such other acts that are customary
in the development of property, if the developer believes this to be
necessary. Lessee further agrees that it shall in no way look or seek
compensation f5® Lessor for any and all injury and damage caused by any
Inconvenience or inability t0 ase said area in conjunction With the
development thereof.
