August 13, 1975 TO: City Manager FROM: City Clark SUBJECT:. Temporary Occupancy Permit - Bolidry Perk On June 25, 1974 a Mnbilosome Construction Permit was issued by this office for the Thomas Walsh mobilehome park on Essex Street. According to the existing Mobilehome Ordinance this permit was for 12 months. On Way 112 19 ]5 the ordinance covering the length of time for construction permits waschanged from 12 months to 24 months. (Chapter XI, Article 4, Sec. 1.6). On June 23 1975 the City Council a wed a nolication Eor a Remporary Oauoancv Permit for 25 lots in Holidayk nfor a term of 6 months. (C.O. 200 AC). Soon after this, a mp Teorary Occupaary Permit w issued bythe -Boning and Code Enforce- ment Office; however, according to Chapter XT, Mt. 4, Sec. -3 this Permit is to be issued ued by the City Clerk. It is my understanding that Basil Eaton notified Orman Twitchell of this must explained to him that the Temporary Occupancy Permit issued by his office was void. There seem to be a difference of opinion an to whether the Construction Permit sued June 25, 1974 w automatically extendea an additional 12 months by the M Ordinance Amement oP May 12, 1975 or not. I have told Mr. Twitchell that I feel that the Construction Permit expired June. 25, 1975 and s "No Temporary Occupancy Permit Shall issue for a period beyond the expiration date of the Mobile Nems, Park Construction Permit.” (Chapter XI. Art. 4, Sec. 3.1)f I have not issued the Temporary Occupancy Per mit approved on June 23rd by the Council. Mr. Twitchell said the construction will goo and C e Patti will continue to be occupied because he feels that the Construction Permit will not expire until June 25, 1976. I also told Mr. Twitchell that, a9 he well amore, my legal training is extremely limited and 1£ I resolve' a Mem from wr C1ty Solicitor that Ne Construction Permit will be i effect untr w i 7 , I x _ ffi very happy tc issue see temporary Occupancy Barn it.
