BBHOLV , wHERE05 the City of Bangor wishes to make application for a great and receive Federal funds under Title X of the Job Opportunities Program; and WHEREAS, Part V of Economic Development Administration application requees that certain certifications and assurances be given by the City of Bangor. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Bangor that the City of Bangor will assure and certify that: 1. That the City of Bangor is in the process of complying and will comply with no regulations, policies, guidelines and requirements, including office of Management and Budget Circular No. A-95, and Federal Management Circulars 74-4 and 74-7, as they relate to the application, acceptance and use of Federal Pune under Title X of the Job Opportunities Program. 2. It possesses legal authority to apply for the grant, and to finance and construct the proposed facilities; that a resolution, motion or eimilar action has been duly adopted or passed as an official act of the applicant's governing body, authorizing the filing of the application, including all understandings and assurances contained therein, and directing and authorizing the person identified as the official representative of the applicant to act in connection with the application and to provide such additional information as may be required. 3. It will comply win the provisions of: Executive Order 11296, relating to evaluation of flood hazards, and Executive Order 11288, relating to the prevention, control, and abatement of enter pollution. 4. It will have sufficient faces available to meet the non - Federal share of the cost for construction projects. Sufficient funds will be available when construction is completed to assure effective operation and maintenance of the facility for the purposes constructed. 5. It will obtain approval by the appropriate Federal agency of the final working� drawings and specifications before the project is advertised or placed on the market for bidding; net it will construct the project, or cause it to be constructed, to final completion in accordance with the application and approved plana and specifications; net it will submit to the appropriate Federal agency fox prior approval changes net alter the costs of the project, use of space, or functional layout; net it will not enter into aonstruction contract(s) for the project or undertake other activities until the conditions Of the construction grant program(s) have been met. 6. It will provide and maintain competent and adequate xchitectual engineering supervision and inspection at the construction site to insure that the completed work conforms with the approved plane and specifications; that it will furnish progress reports and such ocher infosnation as the Federal grantor agency hay require. y. it will operate am maintain the facility in accordance with the minimum standards as may be required or prescribed by the applicable Federal, State and local agencies to the maintenance and operation of such facilities.;: 8 It will give the grantor agency and the Comptroller - Oenaral through any authorized representative,_ access to and the right to examine all records, hooka, papers ox documents related to the grant. 9. It will require the facility to be designed to comply . with the "American Standard Specifications for Mking nuildings and Facilities Accessible to, and Usable by the Physically handicapped," Number A117.1-1961,00di£ied (41 CPR 101-11.]03). The applicant will be responsible for conducting inspection to insure compliance with these specifications by the contractor. 10, It will cause work on the project to be communced within reasonable time after receipt of notification from the approving Federal agency that funds have been approved aha that the project will be prosecuted to completion with reasonable diligence. 11. It will not dispose of or encumber its title or ether intexets in the site and facilities during the expected life of the project facility. 12. It will comply with Title vi of the Civil Rights Act of 1964 (P.L. 08-352) and in accordance with Title VI of that Act, no person in the United States shall, on the ground of race, color, or national Origin, be excluded from participation in, be denied the benefits of, or be other- wise subjected to discrimination under any program or activity for which the applicant receives Federal financial assistance and will immediately take any manures Oxy to effectuate this agreement, if any real property o structure thereonim provided or improved with the aid Of Federal financial assistance extended to the Applicant, this assurance shall obligate the Applicant, or 1n the case of any transfer of each property, any transferee, for the period during which the real property or structure to used for a purpose for which Federal financial assistance is extended or for another purpose involving the provision of similar services or benefits. 13. It will establish safeguards to prohibit employees free using their positions for a purpose that is or gives the appearance of being motivated by a. desire foe private gain for themselves or others, particularly those with 'wham they have family, businesay or bother ties. 14. It will comply with the requirements of Title 11 and Title III of the Uniform Relocation Assistance and Reel Property Acquisitions Act of 1918 )P,L. 91-646) which provides for fair and equitable treatment of persons displaced as 6 result of Federal and federally *Ytated programa. •' 15. It will comply with all requirements imposed by the Federal grantor agency concerning special requirements of law, program requirements, and other administrative requirements approved in accordance with Federal Nemgemnt Circular No. 74-7. 16. It will comply with the provisions of the Catch Act which limit the political activity of employees. 17. It will comply with the minimum wage aM maximum hours 'provisions of the Federal Pair labor Standards Act, as they apply to hospital and educetiorel institution employees of State and local governments. 18. No person shall on the grounds of sex be excluded from participating In, be denied the benefits of, or be otherwise subject to discrimination in connection with this project. (P.L. 92.65, Section 112). 19. This project will not include facilities for the generation, transmission or distribution of electrical energy or for the production or transmission of gas. - 20.Thle project is not primarily or essentially designed to serve a Particular firm or industry or eotablisiments engaged to the apparel or garment trade within the textile industry. _ 21. This project will not compete with a privately owned public utility. 22. The funds requested will not be used to reduce any Federal assistance previously authorized or to which the applicant is otherwise entitled. - - 25. (For projects within the geographical boundaries of a Regional Commission.) it has coordinated rhe project with the appropriate Regional Action planning Commission. • 24. Upon completion of the project, the NM Title X Project Report Form will be completed and submitted to the EM Regional Offles with the request for the final project Payment. 25. It will successfully complete the project in a timely summer to the satisfaction of EM. 26. It will promptly Pay all amounts due and swat it willeither complete construction within the amount of the approved construction line items, plan such change orders as are approved by EM, or that it will provide any additional fonds nsaded to successfully eomplets the project in - a tinily menmr.
