TEAT the attached report of the city engineer relative
to the establishment of an easement to permit the installation
and future maintenance of a drainage ditch in Stillwater Park
between Birch Street and Stillwater Avenue be and, hereby is
accepted, and be it further
ORDERED, that said easement be established.

And that the said City Engineer mel at the time and place of meeting spesifled ma the potieei
and proceeded to IV out,- aid dreinage easement follows:
Beginning at a point located 25 feet southwest of the
southwesterly line of Fern Street and 5 feet southeast of
the northwesterly property line of Let No. 13, a shown o
a Plan entitled "Stillwater Park Project, Bangor, Penobscot
County, Maine" Plan No. UR986E, Sheet 8 of 9, dated 1 dune
1965, said Plan being recorded in the Penobscot Registry of
Deeds; thence in
asouthwesterly direction on a line para-
llel to, and 'five feet southeasterly from said northwesterly
property line for a distance of 400 feet, said line crossing
Lots 13, 12, 11, 10 and a portion of Lot 9. The above
described line represents the centerline of the proposed
drainage easement, Which is laid out to a width of 10 feet,
measuring 5feet on either side of said line. The purpose
of the easement is to allow the city to construct a drainage
ditch within the above described limits for the purpose of
conveying surface drainage in a northeasterly direction to
an fisting catch basin located near Fern Street, and to
maintain a grade for said ditch which is sufficient to
permit the flow of water.
There appeared at the time and place set for the
meeting Mr. Ernest Whitney of 414 Birch Street, Mr. Keith
NcReen of 426 Birch Street, Mrs. Sheila Carter Of 231
Stillwater Avenue, Mrs. Lillian Doughty of 219 Stillwater
Avenue; Mr. David Bower, 422 Birch Street, and Mrs. Wilda
Philbrick, 438 Birch Street. The City Engineer explained
that a drainage ditch was installed in 1964 as part of the
Stillwater Park construction but since that time, the
adjacent land has been regraded and the slope of the ditch
has been altered so as to cause the back-up and ponding of
water, and has resulted in an
sightly and unhealthy
condition at the rear of the subject lots since an easement
was not reserved by the Urban Renewal Authority at the time
of the original ditch installation. The easement will be
required to permit the City to enter the land and to perform
the regrading work. Those present were advised that the
area disturbed by the regrading would be loamed and seeded.
No damages or assessments
ants are recommended as a result
of the acquisition of theeasement or the installation of
the ditch. it is felt that the ditch will benefit the
adjacent properties, and the easement will not interfere
with the present use of the property.
it is recommended that the easement be established so that
the ditch may be installed this fall. -
