Summary This ordinance amendment would change the zoning on a parcel of land addressed at 979 Essex Street from Rural Residence & Agriculture (RR&A) to Low Density Residential (LDR). The applicant is Sun Holiday Park of Southfield, Michigan. The lot currently contains a mobile home park that was lawfully permitted in 1983 but would not now be permitted in its current zone. This makes the lot non -conforming and prohibits many changes, including any that would be considered an "expansion." The park owners want to make circulation improvements to the property and receive permitting for three existing lots that were built but not included in the original permits. These improvements and permitting cannot occur in the current zone. The Comprehensive Plan shows the area, including this 73-acre lot, as Low Density Residential, the same zone as requested. The Penjajawoc Marsh/Mall Commission passed a motion recommending this amendment to the map at their meeting on October 22, 2021. The Planning Board considered this item in a noticed public hearing on November 16, 2021. The meeting was conducted in the Council Chambers at City Hall. Members in attendance were the Chair, Ken Huhn, and Members Reece Perkins, Lisa Shaw, Don Meagher, John Kenney and Ted Brush. Representing the applicant was Shelly Lizotte, PE of Artifex Architect & Engineers. She reviewed the application, noting the property had been approved in 1983 as a mobile home park and subsequently the zoning changed to RR&A, which does not allow mobile home parks. They are not interested in adding more mobile units, but are interested in making some improvements to the property. Currently they cannot make those changes due to the non -conforming status. Staff noted the Comprehensive Plan noted this area as Low Density Residential. The reason why it was zoned incorrectly to RR&A was unclear in the record. It was noted to an abutter when questioned that the Planning Board required a large setback for the park units from Essex Street. The only way to lift that requirement is by application to the Planning Board. Ms. Lizotte repeated that her client had no interest in having more units. Staff also noted that the Penjajawoc Marsh/Mall Commission convened to review the request as the lot is in the overlay district for the marsh. They unanimously passed a motion to recommend the zoning change. Member Perkins made a motion, with a second from Member Brush, to recommend to the City Council that the zone change ought to pass.
