Summary
This ordinance would change a .33 acre parcel of land located at 350 Union Street from URD-1 to URD-2. The
property owners, Christina Murphy, Chee Sing Lee and Pamela Murphy, made this request as part of a planned
project to turn an existing barn into a second residential unit on the property. The barn size exceeds the
requirements for an Accessory Dwelling Unit in the URD-1 zone, and there is already a principal dwelling unit on
the property.
Though the building is not on a historic list, it is a significant building in Bangor's history, and saving and
reusing the existing barn is a positive element of the proposed project.
The 2012 Comprehensive Plan labeled this property as URD-1, and it is surrounded by URD-1, but there are
many other existing two-family residences in the area. The policy of the City Council has been, in the last few
years, to create housing units where reasonable and feasible.

ORDINANCE, Amending Chapter 165, Land Development Code, District Map by Changing the Parcel of Land
addressed at 350 Union Street from Urban Residence 1 (URD-1) to Urban Residence 2 (URD-2).
WHEREAS, the buildings at 350 Union Street represent an important corridor development of residential
homes in Bangor; and
WHEREAS, it is common to reuse barns for residential units;
WHEREAS, there are many other two-family residences in the area of 350 Union Street; and
WHEREAS, the City Council has a policy to create new residential units where feasible;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor is amended as follows:
The Zoning District Map is hereby changed by changing the parcel of land at 350 Union Street from Urban
Residence 1 (URD-1) to Urban Residence 2 (URD-2). Said parcel contains approximately .33 acres in size and
being more particularly indicated on the map attached hereto and made a part hereof.

Zone Change — 350 Union Street — Map -Lot 033-011 — from Urban Residence 1 District
(URD-1) to Urban Residence 2 District (URD-2) — Applicant: Christina A. Murphy,
Chee Sing Lee, and Pamela Murphy
Please accept this memorandum as the recommendation from the Planning Board for the noted item
The Planning Board considered this item in a noticed public hearing on October 5, 2021.
The meeting was conducted in the Council Chambers at City Hall. Some members of the public, as
well as the Assistant City Solicitor, attended on the city's Zoom account. Members in attendance
were the Chair, Ken Huhn, Reece Perkins, Mike Bazinet, Don Meagher and Ted Brush.
One of the applicants, Pamela Murphy, presented the application. They are looking to convert the
existing barn to house a dwelling unit to create multi -generational family housing on the property.
The Chair read an email received by a neighbor in support of the project.
Member Perkins made a motion, with a second from Member Meagher, to recommend to the City
Council that the zone change ought to pass. The motion carried with Huhn, Bazinet, Meagher and
Brush in favor and Perkins dissenting.
Member Perkins provided a minority opinion that he sees these requests as spot zoning. He reads
the Comprehensive Plan as limiting multi -family to keep single family neighborhoods intact. His
understanding of the Affordable Housing Work Group was to increase housing. He added that the
Board should consider rezoning areas to URD-2 if that's what we want to do instead of piecemeal
approaches.

I strongly support the zone change for the property at 350 Union Street, Bangor.

The current owners of this property have upgraded over the last year and, have taken exceptional
care to return the house to its original grandness. The zone change will provide total
independence for an intricate part for the family members. There is more than adequate open
space to allow for R-2 utilization. Our property abuts this property along the North / East bound.
