The proposed right-of-way is laid out to a width of 751feet; measuring to the northwest; the northeast, and the southeast, respectively, from the tangents of the above described line. 'B' STREET Beginning at a point on the southwesterly right-of-way line of the Hammond Street Bulge, so called, approximately 3,200 feet north of Odlin Road, and 1,119.58 feet northwest from a granite monument at the point of tangency of a curve in said right-of-way line; thence South 550-52'-00" West for a distance of 299.96 feet; thence along a curve to the right having a radius of 435.18 feet, said curve being tangent to the last described line, for a distance of 531.49; thence North 480-08'-00" West along a line tangent to said curve at the last described point for a distance of 308.49 feet to a point; thence along a curve to the left, said curve having a radius of 1,056.65 feet, and being tangent to the last described line, for a distance of 545.14 feet to a point, said point being on the westerly right-of-way line, and at thenortherlyterminus of 'A' Street. Said right-of-way is laid out to a width of 75 feet, measuring North and at right angles to the above described line. The above described rights-of-way are shown on a Plan prepared by City of Bangor Engineering Department entitled "Bangor Target Industrial Plaza,. Rightof-Way and Easement Plan", Plan No. R-869, Sheet 1 of 1, dated Idly 25, 1975, to be recorded In Penobscot Registry of Deeds. And the City Engineer proceeded to lay out a grade for said roads as follows 'A' STREET GRADE Beginning at the intersection of the southwesterly right-of-way line of the Hammond Street Bulge, so called, and the center line of the right-of-way of 'A' Street at elevation 167,60; thence descending on a grade of 3.00 per cent for a distance of 100 feet to elevation 164.60; thence along a concave vertical curve having a length of 300 feet and an external of 1.31 feet to elevation 160.85; thence ascending along the tangent to said curve on a grade of 0.50 per cent for a distance of 100 feet to elevation 161.35; thence along a convex vertical curve having a length of 200 feet and an external of 0.325 feet to elevation 161,05; thence descending along the tangent to said curve on a grade of 0.80 per cent for a distance of 300 feet to elevation 158.65; thence along a concave vertical curve having a length of 400 feet and an external of 0.73 feet to elevation 158.37; thence ascending on the tangent to said curve on a grade of 0.66 per cent for a distance of 200 feet to elevation 159.69; thence along a convexxeeticaksutde havinga4a5t$4h' of 400 feet and an external of 0.98 feet to elevation 158.41; thence descending along the tangent to said curve on a grade of 1.30 per cent for a distance of 100 feet to elevation 157.11; thence along a concave vertical curve having a length of 600 feet and an external of 1.56 feet to elevation 155.57; thence ascending along the tangent of said curve on a grade of 0.786 per cent 693.7 feet to elevation 161.02, at the southerly right-of-way line of 'B' Street. 'B'STREET GRADE ' Beginning at the southwesterly right-of-way line of the Hammond Street Bulge, so called, at elevation 174.83, being on a tangent having a grade of -2,955 per cent; thence along a concave vertical c e having a length of 300 feet and an external of 0.8 feet to elevation 169.50; thence descending along the tangent to said curve on a grade of 0.60 par cent for a distance of 1, 363 feet to elevation 161.32, being at the northerly projection of the centerline of 'A' Street. Deeds, Volume 1245, Page 98 Area to be acquired: 0.53 acres Recommended Damages; $5,300.00 It was learned that the land awned by Barbara Simpson is subject to a purchase sales agreement with Land Investments, Inc., represented by Nate Smith of Bangor. On Friday, July 25th, the City Engineer was advised by Mr. Edward Keith, Esq., Attorney for Barbara Simpson, that the question of damages or benefits would not Involve his client, but would directly involve Land Investment, Inc. Notices of the hearing had previously been sent to Mr. Smith and to Mr. James Lynch, Esq., attorney representing Mn. Smith. Mr. Smith and Mr. Lynch had previously Indicated that the location of the proposed roadways, especially the acquisition of Parcel No. 4, would seriously damage the remaining property located along the Hammond Street Bulge. Mr. Edward McKeon, Executive Manager of the Bangor Target Area Development Corporation, indicated that attempts would be made to alter adjacent property lines so that the development of the frontage would be restored. At the public hearing, Mr. Lynch indicated that he was opposed to the laying out of the rights-cf-way as described above due to the damaging effect that it would have upon his client's land; however, Mr. Lynch further indicated that his client would be willing to dedicate Parcel No. 2 and Parcel No. 4, at no charge, provided that satisfactory adjustments could be made to the adjacent property lines, and that no further road or sewer assessments would be made against his client's property as a result of the proposed road and sewer construction, with the exception of previous defamed assessments which may exist. The City Engineer advised Mr. Lynch that he would recommend the payment of damages In the amount of $6, 260.00 as described above for Parcels 2 and 4, but would further recommend that road and sewer assessments be made against Pame] No. 2; representing fifty per cent (50%) of the proportionate share of the construction costs, as provided by the Laws and Ordinances of the City of Bangor. He was further advised that the assessments are presently estimated to total $13,400.00, but would be based upon the final construction costs. No damages are recommended for the acquisition of right-of-way across the Bangor Target Area Development Corporation d0nab. since the land has been dedicated for She rights-of-way, with no sewer or road construction assessments to be levied. It is recommended that the roadways be laid out and established as public ways as described above. It is further recommended that the damages noted above be paid to Land Investments, Inc. and that the proportionate share of the road and sewer construction costs be assessed against said Land Investments, Inc., if a dedication of the right-of-way is not received within fourteen (14) days of the acceptance of this report by the City Council.
