OISSEAS the City of Bangor wishes to make application for a grant and receive Federal funds under Title X of the Jobe Opportunity Program, and MMS, Part V of Economic Development Adminiatration application requires that certain certifications and assurances be given by the City of Bangor. NOW THEREFORE M U BESOLVED. by the City Council of the City of Senior that the City of Bangor will assure and certify that: 1. That the City of Bangor is in the process of complying and will comply with the regulations, policies, guidelines and requirements, Including office of banagemenc and Budget Circular No. A-95. and Federal Management Circulars 74-4 and 74-0, as they relate to the application, acceptance and use of Federal funds under Title X of the Jobs Opportunity Program. 2. It possesses legal authority to apply for the grant, and to finance aha contruct the proposed facilities. that fl resolution, motion or similar action has been duly adopted or pmsedras an official act of the applicant's governing body, authorizing the filing of the application, including all understanding$ and assurances m tuntaed therein, am direct- ing and authorising the person identified as official representative of the applicant to act in connectionwiththe application and to provide such additional information as may be required. J. It will comply with the provisions of : Executive Order 11296, relating to evaluation of flood hazards, and Executive Order 11288, relating to the prevention, control, and abatement of water pollution. 4. It will have sufficient funds available to meet the non- Federal on-Federal share of the cast for construction projects. Sufficient funds will be available when construction is completed to assure effective Operation and meintemnce of the facility for the purposes constructed. 5. It will Obtain approval by the appropriate Federal agency of the final working drawings and specifications before the project is advertised or placed on the market for bidding; that it will construct the project, or come it to be constructed, c0 final Completion in accordance with the application and approved plana and specifications; that it will submit to the appropriate Federal agency for prior approval changes test alter the coats of the project, me of apace, or functional layout; that it will not enter into a construction contract(s) for the project or undertake other activities until the conditions of the construction grant program(s) have been met. 6. It will provide and maintain competent and adequate xchitectual engineering supervision and inspection at the c netruction site to insure that the completed work conforms with the approved plane and specifications; that It will furnish progress reports and such other information as the Federal grantor agency may require. 7. It will operate and maintain the facility In accordance with the minimum standards as may be required or prescribed by the applicable Federal, State and local agencies to the maintenance and operation_ of such facilities. S. It will give the grantor agency and the Comptroller General through any authorized representative, access to and the right to examine all records, books, papers or documents related to the grant. 9. It will require the facility to be designed to comply with the "American Standard Specifications for Paking Buildings and Facilities Accessible to, and Usable by the Physically Handicapped," Number AL17.1-1961,modi£ied (41 CFR 101-1).703). The applicant will be responsible for conduatin inspections to insure compliance with these specifications by the contractor. 30. It will not dispose of or encumber its title or other interets in the site and facilities during the expected life of the project facility. 12. It will empty with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and Inaccordance with Title VI of that Act, no person So the United States ahall,on the ground of race, color, o national origin, be excluded from participation in, be denied the benefits of, or be other- wise subjected to discrimination under any prog£aa�or activity for which the applicant receives Federal financial assistance and will immediately take any measures necessary to effectuate this agpeement, If any reel property o structure chereoa is provided or improved with the aid of Federal financial assistance extended to the Applicant, this asshall obligate the Applicant, or in the ca of any transfer ofsuchnproperty, any transferee, for the period during which the real property Or structure is used fora purpose for which Federal financial assistance is extended or for another purpose involving the provision of similar services or benefits. 13. It will establish safeguards to prohibit employees from using theirpositions for a purpose that is or gives the appearance of being activated by a desire for private gain for themselves or others, particularly those with wham they Nave family, business, or other ties. 14.
