THAT the Zoning Ordinance of the City of Bangor as amended, be further amended
as follows:
THAT Article, 21, Section 30, Subsection (3) be deleted in its entirety and
replaced by the following:
Article 21, Section 10 (3) Application procedure.
Persons seeking site plan approval shall file an application and the
required site plan with the Code Enforcement Officer. After the Code
Enforcement 0£ficer has determined that the request conforms to the
requirements of the zone in which the property is located and the require -
mento for site plan submission, he shall then refer the application to
the Department of Development, Research and Planning for staff review
and submission to the Planning Board for review
and approval. The Code
Enforcement Officer shall also at that time notify the owners of property
abutting and/or within one hundred feet of the exterior boundaries of
the property involved, that s request for site plan approval is before
the Planning Board.
A. Me planning Director shall review the plan for technical compliance
with the provisions of this ordinance and shall, within ten days
after receipt of such proposal, notify the applicant of any technical
deficiencies in the application orrended modification. The
applicant may then either amend the application in accordance with
the recommendations of the Planning Director o request Planning
Board consideration thereon without amendment. Me Planning Director
shall then forward the application t the Planning Board with his
recommendations thereon. The Planning hoard shell review the plans
atits next regularly scheduled meeting and shall, within twenty
days after the date of such review, or public hearing if held,
ether approve, approve with modification, or disapprove the site
plan.

Me Planning Board will then return the application to the Code
Enforcement Officer, Mo shall immediately issue, based on the approved
plane, or deny, a building oroccupancy permit.
B. At any Board review or hearing, a party may be represented by an
attorney or agent. Hearings shall not be continued to another time
except for Hood cause, and when requested by the applicant all
advertising costs shell be borne by the applicant.
C. The Planning Board may request such material and testimony from
various sources as s
it deemnecessary and appropriate to properly
review the proposal.
D. Site plan approval secured under the provisions of this Ordinance
by vote of the Planning Board shall expire if the work or change
involved is not commenced within one (1) year of the date on which
said site plan approval is granted, and if the work or change is cut
substantially completed within two (2) years of the date on which
said site plan approval is granted.
PURPOSE: The proposed iesn to the procedure by which the
Planning Board shell be handlingsite plan review. Since the process
in primarily a technical one, it would seem the present procedure i
overly burdensome to the applicant, the general public, and the Board.

THAT the Zoning Ordinance of the City of Bangor as amended, be further amended
as follws:
I. Article 21, Section 10, Subsection (3) be deleted in its entirety and
replaced with the following.
Article 21, Section 10, Subsection (3) Application Procedure. Persons
seeking site plan approval shall file an application and the required
site plan with the Code Enforcement Officer. After the Code Enforcement
Officer has determined that the application and Site plan conform to
the requirements for site plan Sulmsesio,, he shall then refer the
application to the Department of Development, Research and Planning

The Planning Board shall revise the application and site plan at
its next regularly scheduled meeting and shall within twenty (29)
days after data of such review either (1) approve, approve with
modification, Or disapprovethe plan, or (2) if a majority of the
Board shall so under, hold a public hearing on said plan and after
such public hearing, either approve, approve with modification, or
disapprove the application and site plan.
The Planning Director shall then return the application and site

hearing on the above change on May 19, 1975,
The Planning Board, after careful consideration and
review, has recomended that Council Order 194 AC be amended
by the institution of the attached redraft in its entirety,
and then voted to approve the change in the Ordinance for
Site Plan Review as amended. -
