Summary This Land Development Code amendment would change language for the conditional uses in the Government and Institutional Service District (G&ISD) to allow emergency shelters. In 2013, the use was created as a definition along with transitional housing. There was an attempt to place emergency shelters as a permitted use in the G&ISD and Urban Service District; this failed to pass both Planning Board's recommendation and the City Council. The use is offered here as a use under the conditional use provisions in G&ISD. Conditional uses receive greater scrutiny by the Planning Board in their review and deliberations as to building appropriateness and location, as well as traffic. The public process is also heightened with posting requirements. WHEREAS, at present, the Government and Institutional Service District statement of purpose indicates the district is established to preserve and protect those areas of the City occupied by public and nonprofit institutional buildings or uses; and WHEREAS, emergency shelters are part of the types of provisions that may be considered public service uses; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor is amended as follows: § 165-97 Government and Institutional Service District (G & ISD). D. Conditional uses. Tyson Cartwright also spoke against this and felt there needed to be a more comprehensive approach to homelessness. Mr. Cartwright submitted photos of the encampment near his home.
