ORDERED,
THAT the attached report of the city Engineer relative to
the establishment of sewer easements for the installation and future
maintenance of the Kenduskeag Stream Interceptor Sewer Extension
from Interstate Highway I-95 to the Capehart-Sewage Treatment
Plant be and hereby is accepted and be it further
ORDERED, that said easements be established as noted therein.

plan prepared by the City of Bangor Ingineering Department, entitled
"Kenduskeag Interceptor Sewer Extension, Bangor, Maine, Right -of -Way
Plan and Profile", Plan No. R-868, Sheets 3 thru 17, dated February
21, 1975, said plan on file in the office of the city Engineer.

The above described easements include a temporary construction
easeent width of 50 feet, measured 25 feet either side of the center-
. linemof the pipe, and a 20 foot wide permanent maintenance easement,
measured 10 feet either side of the pipe. The easement would permit
the City or its agents to install, remove, repair,a1lter, replace,
restore, clean, and otherwise maintain the sewer lines and all
" .appurtenant structures within the specified limits.
There appeared at the time and place set for the meeting Mr. John E.
Quirk, representing Village Subaru; Mr. NOrman D. Carlisle; Maynard
A. Call/ Allan Strout; Carlton Strout; Luther Scores; Luther Gary, Jr.;
James Ring o£ the Engineering Department, and the City Engineer.
The City Engineer explained the scope and purpose of the project,
with its primary goal being to permit the elimie tioniof the Capehart
Treatment Plant, with the new Interceptor Sewer to convey the sewage
from the Capehart area to the main treatment plant located on Main
Street. The entire route of the sewer
was shown on a map, and each
individual property owner present w shown the specific construction
plans as they pertained to his property. The property owners
w
assured at every attempt will be de to keep the alteration that mathe
shoreline to asince it is the City's intent to try to pre-
seive the natural beauty of the Stream area.
The City Engineer explained that he would not recommend the payment
of damages for any of the sewer easements, since chmfelt that the
benefits far outweighed the damages; the elimination of the pollution
caused by the Capehart Treatment Plant will clean up the Stream and
should thereby increase property values; the location of the sewer
s close to the shoreline, where present zoning regulations would
not permit the construction of structures, so that the pipe would
not impede the development of the land; and free entry would be
allowed into the Interceptor Sewer by all property owners abutting
the sewer. The City Engineer explained that the cost of new
isnormallyassessed against the properties which are benefited,
and
a normal assessment would average about $3.00 per foot of frontage.
The free entry would thus have considerable value when compared 'to
the encumbrance to the land caused by the sewer. The City Engineer
informed those property owners present that connecting stubs would
be provided in the sewer line upon request during construction which
could be used by them for connecting to the sewer. Connecting stubs
Mr.e requested by Mr.. Carlisle, Mr. Moores, Mr. Call, and Mr. Quirk.
.Moores pointed out that he has a well located approximately
80 feet from the proposed sewer line, and was concerned about
contamination as a result of the construction. He was advised that
the well would be tested before and after the sewer nstallation,
and that the Contractor would be required to have sufficient insurance
coverage to protect all adjacent property.

It is recommended that the sewer easements be established asnoted
above, and that free entry into the sewer be allowed to all adjacent
property owners in exchange Ear the payment of damages for the
easements
