(9rib-U12rirC9f Amending Chapter FIT of the Laws and ordinances of City of Bangor - Sale of Personal Property upon Residential premises Be it ordained by the City Cmmeit of the City ofBanyor, ou (ohms: THAT Chapter VII of the Laws and Ordinances of the City of Ranger be ameaded by the addition of a new Article 15 as follows; CHAPTER VIx ARTICLE 15 - SALE OF PERSONAL PROPERTY Sec. 1 Definitions, For the purpose of interpreting this Article, the following terms shall have the meaning given herein: 1.1 Counted personal property. The term "donated pereoeal property" shall man the personal property of persons other than those residing on the residential Frescoes where such sale is to take place, such personal property being dpwted to a church or charitable organization, and the entire proceeds from cuch sale being donated to the sponsoring church of haritable organisation. 1.2 Residential premises. The term "residential premises" shall mean a building or structure having at least one dwelling unit, boarding r lodging rsand the lot of land associated therewith, and any accessory structures. -Sec. 2 Permit required. No person shall sell or offer for sale personal - property on any residential premises as defined herein, without first obtaining a permit for such purposes fram the Zoning d Code Enforcement Advinistration officer. The Zoning A Code Enforcoment Administration Officershall only issue a permit for the sale of personal property upon residential premises if such sale La of donated personal property, or of personal property owned, used or maintained by persons residing upon such residential premises. 2.1 Application. A permit my be obtained by submitting a completed application to the Zoning h Code Enforcement Administration Officer upon forma provided for such purposes, together with a fee of One ($1.00) Dollar. 2.2 permit limitations. NO permit aball be Issued for sales of personal property upon residential premises for a period Of more than three (3) consecutive days, and n e roue two (2) permits shall be issued for such sales upon a residential premfae in any can calendar year. Sec. 3 signs. Notwithstanding the provisions relating.to signs under CMpter VI, Article 3 of these ordinances, one sign containing not more than four (4) aquare feet in a my be placed uponaresidential premise where the sale of personal property has been permitted. Sec. 4 provisions not applicable. The provisions of Chia Afa(cle) shall not apply to Sales of personal property made under Court order or process. 108 AC Amendment 5/12/75 CHAPTER Vil ARTICLE 15 - SALE OF PERSONAL PROPERTY Het. 1 Definitions. Me term "donated personal property" shall mean the personal property of persons other than those residing on the residential premises where such sale is to take place, such personal property being donated to, or being conducted by, a tax-exempt religious or charitable organization, and the entire proceeds from such sale being donated to, orretained by, the sponsoring tax-exempt religious or charitable organization. 1.2 Residential oremiees. The term"residential premises" shall -man a building orsucture having at least one dwelling nit, boarding or lodging room, and the lot of land musemiated therewith, and any accessary structures; and any lot of lard within a residential zone. Sec. 2 Permit required. No person shall Bell or offer for sale personal property from any residential premises, as defined herein, 8 cept as permitted by this ordinance. Only the sale of donated personal property, as defined herein, and the sale of personal property owned,sed and maintained for personal use only by the seller, and not for resale to the public, shall be permitted to be sold from residential premises, and only after issuance to the seller of a permit far such purposes, as follows: 2.1 Application. Applications and permits required order this ordinance shall b, approved as to form by the City Council. Sac. 6 Penalty. Any person, firm Or corporation conducting any sale regulated under this ordinance without teing properly licensed therefor or who shall violate any of the terms of this ordinance, shall, upon conviction, he fined not less than $25 n than $100.
