By the City Consul of the My of Senior.
ORDERED,
THAT, the revised Final Subdivision Plat for Season College Janda located
between Eawadwey and Kenduskeag Avenue south of Strickland Read,
having been reviewed by the Flaming Board and found to be in general
conformance with local Subdivision lave and State of Baine Statutes,
Title 30, Section 4956 except
THAT the Flaming Board has granted variances on the requirement
for a minimum of 40 foot stele for Saye and the requirement for
Specified engineering detail as authorized under Chapter 12,
Article 13.
Bpon the request of the Planning Hoard to waive the provibieu of
Chapter All, Article 8 of the laws and Crdinance6 of the City of
Bangor. requiring either the completion of improvements or the
reecution of a bond, and upon finding the public interest so
quires, the. City Council of the City of Bangor hereby waives
the foregoing requirements, provided however that each waiver
is subject to the execution of a covenant between Ranson College
and the City of Bangor reserving land in the subdivision for a
future Street. Said covenant in hereby attached to and made a
pert of.

RE: Final Plot for Hasson College land
Gentlemen:
Please be advised that the Planning Hoard has reviewed the
final plat for lands of Husson College. The Hoard has found the
plat in conformance with the subdivision regulations and State of
Maine Statutes except that the Hoard has granted variances to the
requirements for the stele of maps and for the detailed engineering
drawing - based on the large Gave encompassed and that this plat
is, in effect, a parcellization with a further subdivision being
required for development which may take place on any parcel.
In addition, the Planning Sound requests that the City Council
sessions the bonding requirements (Chapter 12, Article 8) recommending
the execution of a Covenant between Houses College and the City
of Hanger svoilar to the attached covenant.
The Planning Pound approved the final plat based on these
modifications on June 16, 1975•

COVENANT
WHEREAS, Husson College is the owner of land described on $.
Final Subdivision Plan by dated.
and filed in the Penobscot Registry of Deeds;.'
and
WHEREAS, Husson College intends to sell certain parcels
designated upon said Plan, but is not intending to become_tha�:.
ultimate developer of uses or structures upon any such parcels; and
WHEREAS, the Final Subdivision Plan filed by Husson. College
and approved by the Planning Board of the City of Bangor on
indicates a strip of land labeled "Reserved"
(hereinafter referred to as "said strip of land"); and
WHEREAS, it is anticipated by Hasson Collegeandthe City. of
Bangor thnt said strip of land may become a means of access td'':
:±ome of the parcels described on ,said Final Subdivision Plan.
NOW, THEREFORE, in consideration of Cne (81.00) Dollar and; "-
other valuable considerations, the receipt of which is hereby
acknowledged by Husson College, it is agreed between Husson
College and the City of Bangor as follows:
1. That parcels of land abutting said strip of land shall
not be conveyed except on "a condition that said strip of land: be
forever kept open and available for use as a right -.of -way or .
public street, and that if the City of Bangor accepts said _strip"
of land as a public street, all interests and rights held by the
ubutt:ing property owners in -aid strip of lend be extinguished and`
terminated.
2. That parcels of land abutting said strip of land shallbe
conveyed on the condition that if said strip is to be laid out and
accepted as a Public street or way by the City of Bangor, the
costs incurred by the City of Bangor in the laying out, acceptance,�i.
construction and improvement of raid strip of land as a public
strmet or way, may be Base^sed against parcels adjacent to and
bounded on said public street or way in accordance with add to,,
the extent provided by the Revised Statutes of Maine, as =ended
Tt is understood that the City of Bangor may lay out and accept'.
i portion of or allof said strip of land.
3. That title to and possession of said strip of land bel -
retained by Husson College, except for use of said strip of land
by abutting property owners as a right -o£ -way.
4. That upon laying, out and acceptance of said strip of 3ahil
as a public street or way, Husson College, or its successors or :
finsigns, shall convey by warranty deed said strip of land to the
City of Bangor upon payment of One ($1.00) Dollar, with apprupeia;Le
reinuaes from any existing mortgages or other liens
5. That Husson Collars shall not, after the date hereof,
convey, mortgage, or in any way encumber said strip of land with-
out first obtaining a written release for such purposes signed by,
the City Manager of the City of Bangor.
6. It Is hereby mutually agreed between the parties hereto
that the above-described strip of land shall not be used for "
building purposes.
