Assurance.of Cong'lience_rath Federal Requirements___ for Financial Assistance - Union Street Recreation Area By city coyaeit off City afflawyor: $ SBLVMN WMEaS, the City of Bangor wishes to mesa application for and receive Federal and State fonds under the Land and Water Conservation Had Act and the Municipal Recreation Fund program for the development of land adjacent to the New Capehart Housing Area on Union Street for recreational purposes. NOW, TBE;6PVBE, BE 1T RFSpLFEO by the City Council of the City of Bangor that the City of Bangor hereby assumes and certifies that: 1. It will comply With the regulations, policies, guide- lines and requirements, including Office of Mangement and Budget Circulars Nos. A-Z7t A-95, and A-1029 as they relate to the application acceptance and use of Federal funds for this federany-assisted project. 2. It possesses legal authority to apply for the grant, and to finance and construct the proposal facilities; that a resolution, motion cr similar action has bassdulyadopted or passed as an official act of the City Council of the City of Bangor, authorising the filing of the application, including all understandings and assurances Contained therein, and directing and authorizing the City Manger as the official representative of the City of Bangor to act in connection with the application and to provide such additional information as may be required. 3. It will comply with the provisions of: Executive Order 11296, relating to evaluation of flood hazards, and Executive order 11288, relating to the prevention, control, and abatement of water pollution. 4. It will have sufficient funds available to meet the amFedsral share of the cost of construction projects. It will provide and maintain competent and adequate architectural engineering supervision and inspection at the construction site to insure that the completed work comforts with the approved plans and specifications; that it will furnish progress reports and such other infortation as the Federal grantor agency may require. 7. It will operate and maintain the facility in woord- once the mvumum standards as may be required or prescribed by the applicable Federal, State and local agencies for the maintenance and operation of such facilities. It All give the grantor agency and the Comptroller General through any authorised representative access to and the right to examine all records, books, papers, or documenta related to the grant. 9. It will require the facility to be designed to comply with the "American Standard Specifications for Making Buildings ami Facilities Accessible to, and Usable by, the Physically Handicapped," Number A117.1-1961, as modified (41 CFA 101-17.703). The applicant will be responsible for comducting inspections to inure compliance with these specifications by the contractor. W.
