HomeMy WebLinkAbout1975-12-08 58 AD RESOLVE58 AD Introduced by Councilor Bigney, necencer 8, 1975 CITY OF BANGOR (TITLE) PSOIUg�_.......xaeoucio,� aF wa C.+v cwwaR of w aiFwaawar: RESOLVED, THAT, the City of Bangor acquire by Eminent Comic pursuant to Its duly adopted Co®umity Development Program, property owned by Violet Stern and designated ea Parcel 11-7 , located at 29 Carr Street Bangor, Was, and described as follows: A eertain lot or parcel of real estate, with the buildings now standing thereon, situate in said Bangor and bounded and described as follows, to wit: Beginning on the east line of Carr Street at a point forty-three and ane -half (43 1/2) feet south of the soutk line of York Street, thence east at right angles with said Cafe Street to the line dividing lots numbered thirteen and fourteen, Joseph Treat's plan of two acres and one hundred rode recorded in the Penobscot Registry of Deeds Plan Book No. 1, Page 57, hereby referred to; thence south on cold line sixty -ore and one-balf (61 1/2) feet to the eomer of said lots; thence west on the aouth line of ,said lot numbered thirteen to said Carr Street{ thence north on the east line of said Carr Street to the 'point begun at. heaIDng herebyto convey all of Bois lot numbered thirteen except the north part thereof conveyed by one of the tomer owners thereof W F. H. Dilling- ham by deed recorded in said Registry, Book 186, Page 464. being the -same premises conveyed by Congregation of Beth Israel, by Max Cohen its Co®ittee duly authorized, to the above named grantors, said Hyman Isit's name being spelled "leght", by deed dated November 23, 1908, and recorded in said Registry, January 18, 1909. Be it further Resolved by the City Council of the City of Bangor that, in accordnnoe with independent appraisal of value of the above described property, the amount of damages determined to be just oompansation for the acquisition of the fee simple interest in the above described property 10$1,500.00 STATDWENT OF FACT: 30 MRSA Section 4854 authorizes municipalities to acquire by Element Domain, property in designated slum or blighted areas. In order to exercise this power, the City Council must first adopt a "Resolution of Condemnation" to be served upon the property omner(a). After service is completed, the Resolution is resubmitted to the City Council for its approval or disapproval. If the Resolution is approved, tie City Conseil shall cause an action to be commenced in the Superior Court.
