Plenum be advised that the planning Board held a public
Hearing on December 1, 1975 to consider the above change in
the coning ordinance.
The Hoard gave consideration to the effect of much control..

as Me enforcement problems.
The Board voted disapproval of the amendment as drafted,
but further voted 4-1 to recommend approval of the ordinance
amendment, amended as follows:

I am enclosing a copy of a letter I have sent to the Bangor _
Daily News, olong with an outline of Burane Information Services'
oii:al control program.
In the long run, such a program will be for more valuable to
the city of Bangor thou the "only 3 cats" ordinance that has, been
prop000d. A program like the one written up by humane Information
Scrvicec would actually control pct overpopulation, disease, and
public nusinnces without persecuting and driving away Bangor's most.
!:open e cat owners, its rcputablo breeders and. humane workers„ wither
whose contribution to innate education, ant core education, and
anti -cruelty work, Bangor's cat control problems would be far worse.
than they are.
Wherever theme "only 3 onto" ordinances have been passed, it
has spolled dimoater for these reputable breeders and owners of
nevercl sp. Jed, neutered, well -kept cats. Rather than part with
show Cats valued at hundreds of dollars or house pets as treasured
as any child, seeing them wither put to sleep or sent to, lesser home
these hui::cne peoplehave had to sell their homes end leave the
coua.unity.. Those that hove stayed to longer dare make the kind of: .'
contribution to humane work that they did in the past;; with any,kind
of contact with the public they risk being found out and seeing thei
well -sept pets destroyed. They dare not even report genuine cruelty,
cases, for fear that the investigator will see their cats, or that
the perpetrator of the cruelty will file a complaint against them in
retaliation. The nonly 3 cats" laws reward the contributions of then
r..ode1 citizens with persecution, when in .fact it would cost any com-
wunity o small fortune to replace the contribution these people make
as unpaid volunteers, towards promoting responsible pet ownership.
No wonder none of these people spoke up at city council hearings!
Most are afraid that they will pay with the lives of. their pets fori`
making themselves known to the "authorities".. This very thing has
happened in places like lot Angeles County, which has an "only 3 pet
ordinance.
Situations like the one involving the two elderly women with 20
cots each are rely Lively uncommon, and people like this often avoid.
"only 3 cots" laws anywoy by allowing the cats be roar free and dis-
claiming ownership. An ordinance lime Humana Information Services
would eliminate these woo.on and any health hazard connected with the
4O cuts. So might an irveztigotion by the state :numane officer, who
would save jurisdiction if any neglect of the cats (surely the come
disease problem exists) w in evidence. An "only 3 cats" urdinae
would go after these talo isoletal macs at the expense of the lives
of perhaps hundreds of well -kept, altered cats and valuable purebred
shoe cats belonging to rmpor:,ibl.a owners with four or more cats.

organizations. 'Phis would:
1) License all cats. Spayed aid neutered cats would require e

of irresponsible owners aid the major sourceof pet overpopulation,

3) Prohibit shelters from adopting out unspayed or unaltered

The city of Chicago, Illinois woe kine enough to rush me a
copy of its revised animal control ordinance.I have enclosed e
copy for each of you. This isas excellent ordinance, one o1 the
beat in the nation, and it is an example of what o city can do .
in the way of Constructive animal control when those formulating
the ordinance are well-informed and have the welfare of animalo
on well as people in mind.
I hove circled in red the portions of the Chicago ordinance
which .pertain particularly. to:Bengon's cat control problems and
needs. You will note that 'cats are. requiredto be kept under restraint
in the some manner asdogs}+that shelters say not adopt out.andmmla
without o spaying requirement,."that unepayed or vnneutered dogs
require a higher licensing foe, and that strict provisions are made
for ;he control of health hazards posed by say cats (or other animals.)
having communicable disease ov parasites. Cstteries are strictly
licensed, and the licence fees tend to hold down the number of data
to that which the owner can and will care for properly. Such an
ordinance is a credit to any Community end promote* public health,

In contrast, the "only 3 cats" proposal node in Bangor would
be ualversolly deplored by humane people and organizations. Consider
the responsible cat owner who has just four or five spayed„ neutered„
beautifully caredfor cats, free from parasites or disease, and kept.

force this person to either sell his home and move, or else decide
which one =two of his treasured pets he must either have destroyed
or else place in a home where they will almost certainly receive a
lesser standard of care. In Los.Angelas County, which hoe such s rule,.

'I am enclosing a copy of a model animal control ordinance
written by the Humane Society of the United States (BSUS). MUS
is probably the largest humane organization in America. Its
proposal contains the following important points:
1) Both dogs and cats require licensing. Unspayed females
require a sufficiently high fee to force the spaying or humane
euthanasia of all unspayed females except the show -quality pure-
breds owned by reputable breeders. This provision goes a long
way towards solving the pet overpopulation problem, which is the
major cause of all animal nusiances. .
2) Nusiance cats would be impounded and their owners fined.
No longer would cat owners be "beyond the law" when their pets
created a hazard to wildlife or public health or bothered other
persons.
3) Pet shops are strictly regulated. Pet shops are usually
outlets for the puppy and kitten mills and backyard breeders, all
of which are undesirable elements. Pet shops also tend to screen
buyers poorly and give animals the cheapest care possible. They
are a major source of pets acquired "on impulse"' end later neglected
so they become s public nusiance.
4) Strict standards are net for kennels.. These could readily
be extended to cover catteries, with a cattery being defined as any
home having more than a certain number of cats.. Such a provision
would be ideal for requiring that large numbers of cats either be
kept in sanitary conditions, or not kept at all.

Section 4. Upon a shoving by any applicant for a permit that he

Director of the Bureau of Licenses, a permit shall be issued
following payment of the applicable fee, as follows:

(h) for any nonlogical garden or animal act, covering

(i) for each livery or riding stable, covering all horses
kept, $50;
(J) for any abbatoir, stockyards, hatchery, livestock
auction, or other place where livestock or poultry
are regularly bred, kept, offered for sale, or
slaughtered for commercial purposes, covering all
animals kept during the year, $100;
(k) no fee shall be required of any however society,
veterinary hospital, or municipal animal control
facility.

Section S. A permit, if not revoked, shell be valid for one
year from the date of issue. A new permit shall be obtained
each year by every owner and a new fee paid. If there is a
change In ownership of an animal or facility, the new am"
may have the current license transferred to his nam upon
payment of a me dollar ($1.00) transfer fee.
Section fi. The Director of the Bureau of Licenses may revoke -
my permit if the person holding the permit refuses or fails

the Director, or any state or local law governing cruelty to
animals or the keeping of animals. Any person whose permit
is revoked shall, within ten days thereafter, humanely dispose
of all animals being tweed, kept or harbored by such person
and no part of the permit fee shall be refunded. It shall he
condition of the issuance of any permit to any owner of animals
kept fore ercial purposes that Humne officers and Inspectors
Of the Bureau of Licenses &hall be permitted to inspect all animals
and the premises where animals are kept at any time and the Director

Section 8. All dogs shall be kept under restraint

control officer or the Humane Officer and impounded in an animal

found at large, the animal control officer, Humane Officer, o
police officer may issue to the knew ower of such animal a notice
of ordinance violation. Such notice shall impose upon the owner a
penalty of $10 which my, at the discretion ofthe animal owner, be
paid to any agency designated by the Director of the Bureau o4 the
Licensee within s enty-tw (72) hours in full satisfaction of
the assessed .penalty. In the event that such penalty is not
paid within the time period prescribed, a criminal warrent shall
W initiated before a magistrate and upon conviction of a violation
of this ordinance, the owner shall be punished as provided in
Section 22 of this ordinance.
Section 12. Every female dog or cat in heat shall be confined in
a building or secure enclosure in such manner that such female dog

Section 16. No person shall keep or permit to be kept on his
greatest any wild or vicious animal for display or for exhibition
purposes, whether gratuitously or for a fee, Ih18 section
shall not be construed s0 as to apply to a zoological garden,
theatrical exhibit or circus as defined in Section 1 of this
ordinance, except that no theatrical exhibit or act shall be
held in which animals az encouraged to perform through the
use of chemical, electricalor mechanical devices.
Section 11. No person shall give away any live vertebrate
animal asa prize for, o inducement to enter, any
contest, Same or other competition, or as an inducement to
enter a place of amu ent; or offer each vertebrate as
incentive to enter into any business agreement whereby the
offer was for the purpose of attracting trade.
Section 18. Any animal which bites a person shall be quarantined
for ten days if ordered by the Director of public Health. During
quarantine the animal shall be securely confined and kept press

Section 21. Airy Humane Officer shall have police powers in
the enforcement of this ordinance and no person shall doter -
fare with, hinder, molest or abuse any Houses Officer in the.
exercise of such powers. -

Section 22. any person violating a" provision of this ordinance
shall be deemed guilty of a misdemeanor and shall be punished
by a fine of not less than 410 nor more than $200. I£ any
violation be continuing, each day's violation shall be deemed
a separate violation. If any person be found guilty by a court
of violating Section 14, his permit to own, keep, harbor
or have custody of animals shall be deemed automatically _
evoked and no new permit may be issued for a period of one
year.
Section 23. All other ordinances of the city of
that are in conflict with this ordinance are hereby repealed.
Section 24. If any pare of this ordinance shall be held invalid,
curb part shall be deemed severable and the invalidity thereof
shall not affect the remaining parte of this ordinance.

SUGGESTED STANDARDS FOR MODEL ORDINARCE
1. STANURD.S FUR PET SHOPS
All pet shops, as defined herein, including pet shops run
in conjunction with another holding facility, shall in addition
to the other requirements of this ordinance empty with the
minimum standards of this section, failure to meet these standards
shall be grounds for denial of a Permit or revocation of a permit.
Standards:
(1) liater: There shall be available hot water at a minimum temperature
of 160 degrees for washing cages and disinfecting, and cold water easily
accessible to all parts of the shop. Fresh water shall be available
to all species at all times. Containers are to be cleaned and dis-
infected each day. All water containers shall be mounted so the animal
cannot turn them over add beremovablefor cleaning.
(2) Room temperature: The room temperature of the shop shall be maintained
at a level that his healthful for every species of animals kept in the shop.
(3) Cages and enclosures: All cages and enclosures are to be of a non -
sufficient size that the animal will have ram to stand, turn and stretch
out to his full length.
(4) Feeding: All animals under three months of age are to be fed at least.
three (3) times par twenty-four (24) hours. Fond for all animals shall
be served in a clean dish so mounted that the animal cannot readily. tip

(5) Birds: Each bird most have sufficient roam to sit o a perch. Perches

temperature that is healthful.
(7) There shall be sufficient clean, dry bedding to meet the needs
of each individual animal.
(E) All animals moat be fed, watered and cages cleaned every day,
including Sundays and holidays.
2. STANDARDS MR RIDING SCHOOLS OR STABLES
All riding schools or stables as defined herein shall in addition
to otber requirements of this ordinance comply with the minimum
standards of this section. Failure to meet these standards shall
be grounds for a denial of a permit or revocation of a permit.
Standards:
(1) Feeding: All animals shall be provided with daily food and
water, free from contamination, and such food and water shall
be wholesome, palatable and of sufficient quantity and nutritive
value to meet the normal daily requirements for the condition and
sine of the animal.
(2) Riding equipment; All equipment used for riding moat fit
properly for each individual animal.
(3) Sanitation: All buildings and sheds used for stabling
animals shall be well lighted and ventilated and provide pro-
tection item the weather. .

comply with these standards shall be grounds for denial of a permit
or revocation of a permit.
Standards.
(I) Rene must have at least six foot (ba) high fences completely

sets of this ordinance comply with the minimum standards of this section.

or revocation of a permit.
Standards
(1) Enclosures must be provided which shall allow adequate pro-
tection against weather extremes. Flora of buildings, runs and walls
shall be of at impervious material to permit proper cleaning and
disinfecting.
(2) Building temperature shall be maintained at a comfortable level.
Adequate ventilation shall be maintained.
(3) Such animal shall have sufficient space to stand up, lie
down and turn around without touching the _sides or tap of cages.
(4) Cages are to be of material and construction that permit cleaning
and sanitizing.
(5) Sege floors of concrete, unless radiantly heated, shell have a
resting board or area type of bedding.
(6) Runs shall provide an adequate exarcise area and protection from
the weather. Runs shall have an impervious surface.
(T) All solve. quarters and runs are to be kept clean, dry and in
a sanitary comities. -
(8) The food shall be free from contamination, wholesome,
palatable and of 'sufficient quantity and nutritive value to meet the
mrmal daily requirements for the condition and size of the animal.
(9) All animals shall have fresh water available at all times.
Water vessels shall be mounted or secure in a manner that prevents
tipping and be of the removable type.
