Town Maine O4 68'' Decenber 2, 19?. ' Ms. Alvaro Byard City Clerk City 3011„73 Harlow Street Bangor, Maine 04401 Dear Mc.. Byard:. _ I am enclosing a copy of a letter I have sent to the Bangor _ Daily News, olong with an outline of Burane Information Services' oii:al control program. In the long run, such a program will be for more valuable to the city of Bangor thou the "only 3 cats" ordinance that has, been prop000d. A program like the one written up by humane Information Scrvicec would actually control pct overpopulation, disease, and public nusinnces without persecuting and driving away Bangor's most. !:open e cat owners, its rcputablo breeders and. humane workers„ wither whose contribution to innate education, ant core education, and anti -cruelty work, Bangor's cat control problems would be far worse. than they are. Wherever theme "only 3 onto" ordinances have been passed, it has spolled dimoater for these reputable breeders and owners of nevercl sp. Jed, neutered, well -kept cats. Rather than part with show Cats valued at hundreds of dollars or house pets as treasured as any child, seeing them wither put to sleep or sent to, lesser home these hui::cne peoplehave had to sell their homes end leave the coua.unity.. Those that hove stayed to longer dare make the kind of: .' contribution to humane work that they did in the past;; with any, kind of contact with the public they risk being found out and seeing thei well -sept pets destroyed. They dare not even report genuine cruelty, cases, for fear that the investigator will see their cats, or that the perpetrator of the cruelty will file a complaint against them in retaliation. The nonly 3 cats" laws reward the contributions of then r..ode1 citizens with persecution, when in .fact it would cost any com- wunity o small fortune to replace the contribution these people make as unpaid volunteers, towards promoting responsible pet ownership. No wonder none of these people spoke up at city council hearings! Most are afraid that they will pay with the lives of. their pets fori` making themselves known to the "authorities".. This very thing has happened in places like lot Angeles County, which has an "only 3 pet ordinance. Situations like the one involving the two elderly women with 20 cots each are rely Lively uncommon, and people like this often avoid. "only 3 cots" laws anywoy by allowing the cats be roar free and dis- claiming ownership. An ordinance lime Humana Information Services would eliminate these woo.on and any health hazard connected with the 4O cuts. So might an irveztigotion by the state :numane officer, who would save jurisdiction if any neglect of the cats (surely the come disease problem exists) w in evidence. An "only 3 cats" urdinae would go after these talo isoletal macs at the expense of the lives of perhaps hundreds of well -kept, altered cats and valuable purebred shoe cats belonging to rmpor:,ibl.a owners with four or more cats. I will be happy to furnish ,on with a copy of humane ons' complete ordirviuce nr 'i i:h nn. ol:har infreieekin disposal..I will also be glad tc address the next meeting of the Bangor City Council When this ordinance comes up for further discussion. Places feel free to contact re of my office at the University of Maine (581-9941), or at home (827-2900). To the City Councilmen, City M:-uager, City Attorney, and City - Clerk of Bangor, Maine:: The city of Chicago, Illinois woe kine enough to rush me a copy of its revised animal control ordinance.I have enclosed e copy for each of you. This isas excellent ordinance, one o1 the beat in the nation, and it is an example of what o city can do . in the way of Constructive animal control when those formulating the ordinance are well-informed and have the welfare of animalo on well as people in mind. I hove circled in red the portions of the Chicago ordinance which .pertain particularly. to:Bengon's cat control problems and needs. You will note that 'cats are. requiredto be kept under restraint in the some manner asdogs}+that shelters say not adopt out.andmmla without o spaying requirement,."that unepayed or vnneutered dogs require a higher licensing foe, and that strict provisions are made for ;he control of health hazards posed by say cats (or other animals.) having communicable disease ov parasites. Cstteries are strictly licensed, and the licence fees tend to hold down the number of data to that which the owner can and will care for properly. Such an ordinance is a credit to any Community end promote* public health, enimal welfare, animal population eontrol, and public musibnce control goals all at the same time.. I I- '- In contrast, the "only 3 cats" proposal node in Bangor would be ualversolly deplored by humane people and organizations. Consider the responsible cat owner who has just four or five spayed„ neutered„ beautifully caredfor cats, free from parasites or disease, and kept. within the safety of his own home. The "only 3 cstm"'proposal would' force this person to either sell his home and move, or else decide which one =two of his treasured pets he must either have destroyed or else place in a home where they will almost certainly receive a lesser standard of care. In Los.Angelas County, which hoe such s rule,. owners of four oats have beep fined, and animal conbrol officers have in &owe cases arbitrarily Maimed, impounded$ and destroyed on the spat one oI the tour cats as well, In contrast, such rules do nothing to control the owner of one, -twos' or throe-unepayed or unnautered oats,. which roam the neighborhood, spraying$, howling et night, ripping opera garbage bags, and producing several litters conn, year (it is possible: for such a .founle to producefive littera of eight kittonm yearly) a which ore either abandoned or must be destroyed by the already over- burdened humane shelters. It is those animals which are usually On- voccinoted and ars infested with floss, ear mites, worma, and akin diseases contagious to man. Animals have rights, toe, no the toying goes among humanitarians,. sad we meet not have laws that force the destruction of the well -kept pet While ignoring those that constitute tho true public Chaisson. -- I have a national reputation in the humane field and in thenet fancy, anal on one of Maine's leading_outhoritias on the proper cars and control of cats. I Maintain soonest with humane organizations and animal control authorities. throughout the United Ststea, and am familina with their latest methods, idea's, and legislative efforrtn. Places do reconsider the "only 3 oats"' proposal, and permit me to work with you on a oat control ordinance that Bangor eau 'truly Ae reed of. Ton Bangor City Councilors, City Phnager, City Solicitor, City Clark. 'I am enclosing a copy of a model animal control ordinance written by the Humane Society of the United States (BSUS). MUS is probably the largest humane organization in America. Its proposal contains the following important points: 1) Both dogs and cats require licensing. Unspayed females require a sufficiently high fee to force the spaying or humane euthanasia of all unspayed females except the show -quality pure- breds owned by reputable breeders. This provision goes a long way towards solving the pet overpopulation problem, which is the major cause of all animal nusiances. . 2) Nusiance cats would be impounded and their owners fined. No longer would cat owners be "beyond the law" when their pets created a hazard to wildlife or public health or bothered other persons. 3) Pet shops are strictly regulated. Pet shops are usually outlets for the puppy and kitten mills and backyard breeders, all of which are undesirable elements. Pet shops also tend to screen buyers poorly and give animals the cheapest care possible. They are a major source of pets acquired "on impulse"' end later neglected so they become s public nusiance. 4) Strict standards are net for kennels.. These could readily be extended to cover catteries, with a cattery being defined as any home having more than a certain number of cats.. Such a provision would be ideal for requiring that large numbers of cats either be kept in sanitary conditions, or not kept at all. I have enclosed a report by HSUS on animal control and also the control of pot animal overpopulation. Here BEDS stresses the " need for a strong, comprehensive community animal control ordinance. low-cost 1 They also give statistics showing the value of community financed from the proceeds neuter -snag programa, which are usually of pet -licensing programs. iThe RUDE makes another important point, one made by the HIS animal control ordinance, the C'hicagoordinence, and my mm outlined NOT be to proposal: humane societies and animals without pounds must permitted a neuter -spay requirement. adopt out unaltered Shelters adopting out unaltered animals are a major source of overpopulation, animal nusiances, animal abandonment, and the destroyed in Bangor alone hundreds of unwanted Puppies and kittens by many shelters and pounds EACH.DAY. MUS advocates a system used agreement across the country: the new owner must sign a spaying adoption. Much of this expense is required for the feeding d vire of unwanted animals during the 5 to 10 days they are held for adoption. She outstanding special feature of our draft is elimination of the customary provision regulating only the licensing of doge and sub- stitution of a requirement that a permit be obtained before any kind of animal (except certain miner species) may be kept within a city. In other respects the proposed ordinance is not unusual. Permits for animal Owners instead of merely licenses for doge will eliminate, nr greatly alleviate, many municipal problems of animal control and of preventing cruelty to animals. the permit system provides for penalties against animal owners she violate the ordinance, me merely impoundment and death for animals. An owner who offends against the ordinance can be effectively restraimed from continuing or repeated offences by a simple revocation of his Permit, a procedure much easier than action in court. The provision that regulations shall be promulgated by the Director Of Licenses (this may be any authority desired) affords a simple means of getting a precise definition of standards to be maintained by animal amr s in housing and fending of animals, etc., of control- ling public nuisances, and offing_.animals_&ua-abuses-CfiaP—--------_ -are-eeriEftledn ccmmov emee but wbich may not offer adequate ground for prosecution in court. The permit fee for the keeping of unepayed dogs and tate should he sufficiently high sa as to encourage sterilization. Surplus animals e a financial burden on the commmity and represent a dangerous Public nuisance. It is imperative that an accurate record keep - ins System be developed so as to prohibit false claims by pet Ocam-8 trying to avoid payment of the fee for unepayed cats and dogs. To eliminate apposition resulting from the regulation of eats the Ordinance offers cat owners the same impoundment protection as that guaranteed dog occurs. The Ordinance -elm bane roadside menageries and prohibits animal giveaways, thus solving problems that have long plagued municipal officials and humane societies. The Director of Licenses has been granted authority to regulate the keeping of exotic animals as Pete and can insure that public safety and humane treatment We. "since are Out violated.
