— THAT Chapter IX of the ordinances Of the City of Bangor is hereby
repealed and replaced with the following;
CHAPTER 1X
BUILDING COBE
See. 1 Building Code Adopted. In accordance with Title 30, Section
2156, Maim Revised Statutes Annotated
of 1964, as amended, '"fbe BOLA Basic Building Code/1975", Sixth
Edition, published by, the Building officials & Code AdmEnl-
sirators Ipternational, Inc., is hereby adopted and Incorporated
by reference, as the minimum standard for the construction,
alteration, addition repair, removal, demolition, use, location,
occupancy, and maintenance of all buildings and structures and
their service equipment, both existing and proposed, located
within the City of Bangor.
Sec. 2 emendments to Published Version. Said Building. Code is adopted
in its published form as if
fully set forth herein, except as follows;
{1) Article 1, Section 101.1 is amended to read as
follows;
101.1 Title; These regulationsshall be kn bn,

(2) Article 1, Section 101.2 is amended to read as
follows:
101.2 Scope: nese regulations shall control all
matters concerning the construction, alteration,
addition, repair, r val, demolition, use, location,
occupancy and maintenance of all buildings and
structures and their service equipment as herein
defined, and shall apply to existing or proposed
buildings and structures in the (,ane-efyarfed £adieu)
City of Bought{ except as such =items atotherwise
provided for in the local jurisdictional charter, or
other ordinance or statutes, or in the rales and
regulations authorized for promulgation under the
provisions of this code.
(5) Article 1, Section 105.1 is amended to read as -
follows:
105:1 Continuation of existing one: The legal use
and occupancy of airy structure existing on (date -of

ordinancer for which it had been here�e approved,
may beontinued without change, except as may be
specifically covered In this code and the housing code
or as =y be demand necessary by the building official
for the general safety and welfare of tax occupants and
the public.
(4) Article 1, Section 107.1 is deleted andsxeplaced with
the following:
307.1 Bui�ldf_�g £ficial: Further references in this
code to the 'rbuio�ficfai" shall be interpreted
to mean the Zoning & Code Enforcement Administration
Officer of the City'of Bangor.
(5) Articled, Section 114.3 is deleted and replaced with
the following:
114.2 Capitation of Permit: Any permit issued shall
become invalid if the authorized work is not commenced
within am (1) year from the date of issuance, or if the
authorized work is suspended or abandoned for a period of
aix (6) months after the time of commencing the authorized
work.

Article 1, Section 118.4 is
deleted and replaced with
.the following;
118.4 Moving of Buildings: The fee for a building
permit for the removal of a building o structure from
one lot to another r to a ,mw location on the same
lot shall be $10.00.
(7) Article 1, Section 118.5 is deleted and replaced with
the following:
118.5 Demolition: fne fee for a permit for the
demolltlon welling or struetnie shell be $10.00,
plus $5.00 for eachstory over three stories. In
addition, a belated fee of $10.00 will be charged where
demolition has been concerned prior to issuance of a
demolition permit. The fee for a permit for the
demolition of a SMIL structure, such as a garage or
shed, with to sewer connection, Shall be $5.00.
(8) Article 1, Section.122.3 is deleted and replaced with
the following:
-122.3 Violation penalties: Any person who shall
folate !Provision of the Basic Code or shall fail to
comply with any of the requirements thereof or who shell
act, construct, alter or repair a building or structure
in violation of an approved plan or directive of the
building official, or of a permit or certificate issued
under the provisions of the Basic Code shall be guilty of
misdemeanor, punishable by a fine of out lees than
$10.00 nor more than $100.00 for eachsuchviolation.
Each day such violation continues shall be deemed a
separate offense.
(9) Article 1, Section 123.2 is deleted and replaced with
the following:
123.2 Unlawful continuance: Any person who shall
continue any work in or about the structure having
been served with a Stop Work Order, except such work
as he is directed to perform to remove a violation or
safe condition, shall be liable to a fine of not
less than $10 nor more than $100.
(10) Article 1, Section 126.3 is amended to read as fellows:

(11) Article 2, Section 200.1 Is amended to read as follows:
200.1 Scope: The provisions of this article shall
control the classification of all buildings an to
e group and type of Construction; and the definition
of all terms relating thereto in imams-a€-}ax4ei4ee 4es)-
the City of Bangor.
(12) Article 2, Section 200.3 is deleted and replaced with
the following:
200.3 Application of other laws: Nothing herein
contained shall be Succeed to nullify any previsions
of the Zoning Ordinancerany other ordinance of the
City of Bangor pertaining to the location, use or
type of construction of buildings, except as may be
specifically required by the provisions of thin code.
(13) Article 3, Soetlbu,300.1 is amended to read as follows:
300.1 Scope: The previsions of this article shall

hereafter erected, and extensions to existing buildings
hereafter altered or enlarged as
affected by the fire and

and equipment.
(14) Article 3, Section 901.2 is deleted and replaced with
the following:
301.2 Fire limits: The fire limits shall comprise all
areas wicity limits of the City of Bangor except
those areas zoned Residential (R-1 through R-5), Neighbor-
hood Commercial (C-1), and Park 6 Open Space (PW} Zone.'
(15) article 13, Section 130F.2.1 is amended to read as follows:
130).2 .1 Deep excavations: Whenever a excavation i

to be made, if afforded the necessary license to enter
the adjoining premises, shall preserve and protect from
injury at all tines and at his own expense such adjoining

shall than be the dutyofthe owner of the adjoining
promisee to make his building orstructure safe by
installing proper underpinnings or foundations or
other-
wise; and such owner, if it be necessary for the
prosecution of his work shall be granted the
necessary license to enter the premises where the
excavation or demolition in contemplated.
(16) Article 13, Section 1309.2.2 is ascended to read as follows:
1307.2.2 Shallow excavations: wherever an excavation is
made to a depth less et a (xmbev) 3 feet below the
curb, the owner
of a neighboring building or structure,
the safety of which any be affected by the proposed
excavation, shall preserve and protect from injury and
shall support his building or structure by the necessary
underpinningor foundations. I£ necessary for that
purpose, he shall be afforded a license to enter the
premises where the excavation is contemplated.
(17) Article 14 is deleted in its entirety.
(18) Article 17 is deleted inits entirety.
(19) Article 19, Section 1900.5 is amended to read as fellows:
1900.5 Conflicting laws: Nothing hereincontained
shall be deemed to nullify any provisions of the
rating laws or any other statute or legally adopted
