HomeMy WebLinkAbout1976-03-08 152 AD ORDER152 At Introduced by Councilor Brountas, March 8, 1976 CITY OF BANGOR 4,6 (TITLE) lk/AYQr Discontinuiqga,Porticonof_Mildred Avenue BY Hw 6\NCauwu ofd My ofBaayur: ORDERED, THAT WHEREAS, a Petition has been received to discontinue a portion of Mildred Avenue for a distance of 470 feet, more or less, extending west from Hammond Street, a copy of said Petition is attached hereto, and waSSPAS, said portion of Mildred Avenue has never been accepted as a public way, nor has it ever been constructed or used as a street, NOW THEREFORE, be it ORDERED, that the City Engineer, acting for and on behalf of the Municipal Officers according to law, be and hereby is directed to discontinue said Mildred Avenue for a distance of 470 feet, more or less,. west of Hammond street, being that a portion which lies adjacent to Lots 2 through 9 and Lots 52 through 45 asn shown o a Plan of Na90n Avenue Lots recorded -- n Penobscot RegistryOf Deeds, Book 16, Pages 25 and 26, and be it further ORDERED, that the City Engineer proceed to give notice of such intention of said Municipal Officers according to law by posting such Notice for seven days in two public places in the City of Bangor and in the vicinity of said right-of-way, and the City Bngineer is further ORDERED, to make a writtenreturn of said proceedings containing the bounds and admeasurements of the portion of said right -o£ -way to be discontinued, and the damages allowed t0 anyperson or persons asresult of said discontinuance, all in accordance with the Lawsof the State of Maine. i IN CITY CCUMCIL 152 M I61 March 9, 1976 City Engineer directed to p R D E R r advertise public hearing, to be field in ths.evenipq. The undersigned respectfully request that the City discontinue and abandon its interest in the first four hundred seventy feet, sore r less, of the. street known as Mildred Avenue, which intersects t Nuanced Street and which is adjacent to Lots 2 - 9 and Lots 52 - 45 as laid down on Plan of Nason Avenue Lots recorded in Plan Book 16, ' -Pages 25 6 26. The street known as Mildred Avenue is shown on said plan as a continuation of Mason Avenue. The discontinuation of the City's interest is requested because .the City has never accepted such easement nor has the street been constructed. It would be beneficial to the adjacent landowners if said street were discontinued. -- Re ctfullyw
