Be it ordained by W City Council of City ofBanaor, as/ollows:
THAT the provffifam of Article 5, Chapter IV of the ordinances of the City
of danger be hereby repealed.
Statement of Fact: Theexistingprevisions of Article 5 relate to the
licensing of dealers in secondhand articles and junk. The ordinance has
retained its basic form since the late 19th Century when it was initially
adopted. At the present time, junkyards and other activities covered by
the Ordinance are now regulated by other ordinances or under the general
statutes.

Sec. 1 LiceneaerWred. accept as hereinafter provided, mo person,
firm or corporation shall deal in secondhand
articles, or conduct, operate o sponsor a sale of secondhand
Striping, in the City of Bansor without having first obtained
a Dealer'in Secondhand articles License. For purposes'of this
Ordinance, .the term "e coMhand, articles" shall be construed
as used personal property having a arose sales price in excess
Of Twenty-five ($25.00) Dollars.
Sec. 2 Licensing requirements, application for a Dealer in Secondhand
Articles license shall be made to the
City Clerk and shall state thereon the name of the applicant, the
applicant's address, and the address at which Said .e andhand
articles are to be sold. The actual fee for such license shalt
be Twenty-five ($25.00) Dollars; provided, however, in the case
of a bale of Secondhand articles at a single location and with
more than one participant, the sponsor of Ouch Sale shall obtain
one (1) license as required by this Ordiomnee7 --- In addition, each
participant in said sale Shall obtain anon-transferrable permit
at a fee of Oar ($1100). Dollar to be leased by the City Clerk
for a. duration of rot more than three (3) consecutive days. The
license Shall continue in force until the last HOMay in May
next following. Ferry person licensed or granted a permit under
this Ordinance shall keep a record of all secondhand articles by
him purchased, and offered for Sale in the City, together with
the date of purchase, Dace and address of the seller and a
description of each article bought. Such record shall be kept
open for public inspection at all times by representatives of the
City of Stuart.
Sec. J Exemptions. The provisions of this Ordinance shall not
apply to such persons or businesses orating
duly licensed automobile graveyards, junkyards, pawnshops -,4 or
Lice mad As ler dealers in old gold, silver and precious metals o
operating under a permit for the sale of ,personal .property.
pursuant to Chapter VII, Article 15 of these Ordingutes, or
to casual sales or sales of used motor vehicles.
Sec. 4 penalties. Any person who shall in any manner
violate any of
the provisions of this Ordinance or -violate any
conditions of any License or permit granted under the provisions
hereof, shall on conviction thereof be punished by a fine of not
leas than Fifty ($50.00) Dollars nor more than One Hundred'
($100.00) Do liars.
