By Ow My COMM W46 CRY of Awt BBBCILVBD, WHEREAS, the City of Bangor wishes to make a second year appiio- ation for and receive Federal funds under Title I of the Housing and Community Development Act of 1974; and, WHEREAS, Section IN of the Housing and Community Development Act of 1974 and Section 570.303(e) of Part 370 of Title 24 of the Code of Federal Regulations requires that certain certifications and assurances be given by the City of Bangor; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Bangor that the City of Bangor will assure and certify that 1,. That the City of Bangor is in the process of complying with the regulations, policies, and guidelines of the requirements of OM Circular No. A-95 and that it will comply with the regulations, policies, guidelines and requirements of Federal Management Circulars 74-4 and 74-7, as they relate to the application for, acceptance of, and use of federal funds under Title I of the Housing and Community Development Act of 1974 (hereinafter referred to as "this program"). 2. It will comply with: (a) Title VI of the Civil Rights Act of 1964 (P.L. 88-352), and in con- formance with all requirements imposed by or pursuant to the Regulations of the Department of Housing and Urban Development (24 CFR Part 1) issued pursuant to that Section, and incco Mance with that Section, no person n the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under say program or activity for which the City of Bangor receives Federal financialassistance and will immediately take any measures necessary to effectuate te this assurance. s If any real property or structure thereon is provided or improved with the aid of Federal financial assistance extended to the City of Bangor, this Assurance shall obligate the City of Bangor, o in the c of any transfer of such property, any transferee, for the period during which the real property or structure isused for a purpose for which the Federal financial assistance i extended, or for afiother purpose involving the provision of similar services or benefits. IN CITY COUNCIL February 9, 1976 Passed CITY 129 AD \i4 EES0EvE Assuring and certifying the City's Compliance 'tFerequirements For Community De e10u Funds. - RECEIVED CITY OF BANGOR CITY CLERK'S OFFICE y tl6 fEB 5 Ftl 2 07 (b) Title DIN of the Civil Right Act of 1960, (P.L. 90-284) as amended, and will administer all programs and activities relating to housing and community development in a manner to affirmatively further fair housing in the sale or rental of housing, the financing of housing, and the provision of brokerage services within the City of Danger's jurisdiction. )c) Section 109 of the Rousing and Community Development Act of 1974 and in conformance with all requirements imposed by or pursuant to the Regulations of the Department )24 CFR Part 570.601) issued pursuant to that Section; and in accordance with that Section, no person in the United States &ball on the ground of race, color, national origin or sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under, any program or activity funded in whole or in part with funds provided under Title I of the Rousing and Community Development Act of 1974. (d) Executive Order 11063 on equal opportunity in housing and nondiscrimination in the sale or rental of housing built with Federal assistance. (e) Section 3 of the Rousing and Urban Development Act of 1960, as amended requiring that to the greatest extent feasible opportunities for training and employment be given lower in r residents of the project area and contracts for work in connectionwiththe project be awarded to eligible business c s which are located in owned in substantial part by, persons residing in the area of the project. (f) Executive Order 11246, and in conformance with all requirements imposed by or pursuant to the Regulations of the Department (24 CFA Part 130) issued pursuant to that Section; and in accordance with that Section, no person shall be discriminated against on the basis of race, color, religion, sex or stational origin in all phases of employment during the performance of Federal or federally -assisted contracts, and that contractors and sub- contractors will be required to take affirmative action to ensure fair treat- ment in employment, upgrading, demotion; or transfer; recruitment o - mitment advertising; layayoff or termination, rates of por other Perms of Compensation and selection for training and apprenticeship. 3. Prior to the submission of its application, the City of Ranger has: (a) Provided citizens with adequate information concerning the amount of funds available for proposed community development and housing activities, the range of activities that may be undertaken, aM other important program requirements; (b) Held two public hearings to obtain the views of citizens on community development and housing needs; and 410 Provided citizens an adequate opportunity to articulate needs, express preferences about proposed activities, assist in the selection of priorities and otherwise participate in the development of the application. 4. The City of Rmgor will (a) Provide fair and reasonable relocation payments and assistance i accordance with Sections 202. 203 and 204 of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 91-646) aM applicable HUD regulations (24 CPR Part 42), to or for families, individuals, partnerships, corporations or associations dis- placed a result of any acquisition of real property for an activity assisted under this program; (b) Provide relocation assistance programa offering the services described n Section 205 of the act (P.L. 91-646) to such displaced families, indi- viduals, partnerships, corporations or associations in the sumer provided under applicable HUD regulations; (c) Assure that, within a reasonable time prior to displacement, decent, safe, and sanitary replacement dwellings will beavailableto such dis- placed families and individuals in accordance with Section 205 (c)(3) of P.L. 91-616; and that such housing will be available in the same range of choices to all such displaced persons regardless of their race, color, religion, national origin, sex or source of income, (d) Inform affected persons of the benefits, policies, and procedures provided for under HUD regulations; and (e) Carry out the relocation process in each a Sooner as to provide dis- placed persons with uniform and consistent services including any services required to insure that the relocation process does not result in different or separate treatment to such displaced persons on account of their race, color, religion, national origin, sex or source of income. 5. the City of Ranger will: (a) In acquiring real property inenonaction with the c unity develop- ment block grant program, be guided to the greatest extent practicable under State law, by the real property acquisition policies set out under Section 301 of the Uniform Relocation Assistance and Real Property Acqui- sition Policies Act of 1940 (P.L. 91-046) and the provision of Section 302 thereof; (b) Pay or reimburse property owners for necessary expenses a specified in Section 303 and 304 of the Act; and (c) inform affected Persons of the benefits, policies, and procedures provided for under HW regulations (24 CFR Part 42). 6. It will give RUD and the Comptroller General through any authorized repre- entative access to and the right to examane all records, books, papers, or documents related to any grunts made under this program. 0. It will comply with the provisions of the Hatch Act which limit the political activity of employees. 8. It will comply with the provisions of: Executive order 11296, relating to evaluation of flood hazards. 9. The Community Development Program has been developed so as to give maximum feasible priority to activities which will benefit low -or moderate -income families and aid in the prevention and elimination of slims and blight. 10. It will establish safeguards to prohibit employees from using positions for a purpose that is r gives the appearance of being activated by a desire for private gain forthemselves or others, particularly those with wham they have family, business, or other ties. 11. It will comply with all requirements imposed by HM concerning special requirements of law, program requirements, and other administrative require- ments approved in accordance with Federal management Circular 74-7. 12. it will administer and enforce the labor standards requirements set forth in 24 CPR Part 570.605 and HM regulations issued to implement such requirements.
