ORDERED, 2tl1T the City Manager be and hereby is authorized o behalf of the municipal officers to enter into the attached Agreement with State Department of Transportation relative to the reconstruction of the State Street Bridge Over xenduskeag Stream; the approaches, and other appurtenant facilities.. STATEML'NT OF FACT The Agreement contains various specific conditions which have been the subject of many previous discussions with the State pertaining to street, sidewalk, curb, and street light improvements, both within their project area and in the _areae beyond each 'end of their project limits, which will result in a complete rehabilitation of.6he Hammond -State Street area between Central Street and Exchange Street. I _ Introduced ayd fv'i� r � ' r ]ma Bangor &tF-u-01-3(6) Jauuary 6, 1976 Page 1 of 6" CF,wMENT Attachment -1 TTj AGRE THIS AG4EFMENT entered into this day of In the year of our Lord one thousand nine hundred and seventy-si , by and between the State of Marine, through its Department of Transportation, Bureau of Highways, duly autborgzed by the laws of the State of Maine, hereinafter referred to as 'the State' and the City of Bangor, Penobscot County, a body corporate, by and through its City Manager, thereunto duly auth- orized, hereinafter referred to as 'the City'. WHEREAS, 'the State' is planting the layout and reconstruction of a portion of H nd Street and State Street as shown on plane for the proposed project, the limits of which will begin at Station lOWO on Hammond Street and extend easterly about 505 feet to Station 15+05± for the purpose of this agreement, and will be defined as Federal Aid Project PBF-U-of-3(6), and will hereinafter be referred to as 'the Project'. NOW THFAEFORE, 'the State' agrees to do and perform the following: I. To let a contract and construct Federal Aid Project BRF-U-01-3(6) substantially In accordance with the plans prepared for 'the Project' by 'the State'. A bridge will be constructed over the west channel of Kenduskeag Stream as well as a bridge over the seat channel of Kenduakeag Stream. The bridges as pro- posed will have 49 foot curb to curb roadway with 10 foot sidewalks on each side of both bridges. The roadway between the two bridges will have a 49 foot curb to curb width. Approaches will consist of a hot bituminous overlay from about Station 10+00 to Station 10+45 coal from Station 14+00 to about Station 15+05. AM existing sidewalks within the limits of 'the Project' which are removed will be replaced. U. db construct a drainage system adequate to handle all surface and subsurface water for the entire project, and to connect this drainage system into the exiating sewer systema, eliminating any drainage structures deemed unnecessary as part of 'the Project'. To maintain at least two lanes of traffic during the period of constructIon and to provide one sidewalk for pedestrian access across the bridges. IV. To provide temporary sidewalks and access to all buildings during the period of construction within the limits of 'the Project'. V. To remove and replace the parking eater poets as required within the limits of 'the Project'. - VI. To renove a portion of a 36 Leh reinforced concrete drainage pipe located left of centerline, and to abandon the remainder in place, except if 'the City' wishes to salvage the pipe, than 'the City' will remove said pipe at no expense to Rhe State'. VII. To install anchor bolts provided by 'the City' for the bus shelter. VIII. To install light bases, standards, arta, Conduits and pull wires, within 'the Project' limits, for the proposed lighting system. IX. To maintain, aftercompletion, the bridges constructed as a part of 'the Pro- ject' except for snow removal add ice control. X. All encroachments presently existing within the flight of Way limits of Rhe Project' such as signs, elevators, fire escapes, sidewalk heaters, etc., will be allwei to remain. AND, 'the City' agrees to do and perform the following: I. To approvethe layout and construction of Federal Aid Project BHF -U-01-3(6) described in Item I above under 'the State' agrees within, 'the Project' Untie as set forth in this agreement and as shown on the plans provided by 'the State' including authorisation for 'the State' to utilise the existing sewer systems for new drainage as described in Item II, above under 'the State' agrees, and give 'the State' the right to remove or discontinue any drainage structures deeded unnecessary as part of 'the Project'. II. To acquire and Provide to 'the State' all land and rights in land necessary for 'the Project'. Bangor BRF-u-01-3(6) January 6, 1976 Page 3 of 6 -3- Attachhant - 1 III. To pay for all construction costs outside the limits from Station 10+45 to Station I4400 as shown on plane. for `the Project'. N. To install all wiring and luminaires for the new lighting system within 'the Project' wuta. V. To jay the non-federal share for all street lighting items within the limits of 'the Project', except for work done by 'the City' under Article N above, under "'the City' agMse". VI. To remove all existing light standards which are to be replaced for the new lighting system within the limits of 'the Project'. M. To remove, store, and replace all parking meterheeds which must be moved as a result of 'the Project', and to store the existing parking meter posts. VIII. To mark the locations of parking hater posts at the time of reinstallation, such work should be done in cooperation with 'the State' and its contractor. U. To furnish and locate anchor bolts for securing the has shelter located on 'the Project'. R. To remove, store and replace the bus shelter located on 'the Project'. U. To sashed all future maintenance and power costa for street lighting providing an intensity comusmsurate with highway safety standards of approximately two foot candles, within 'the Project' limits. XII. To assume all responsibilities and coats for onow aid lee control for the entire 'Project', and all responadbilities and costs for mainteeunce of 'the Project', accept for maintenance of the bridges as provided in Article IX above under ^'the State' agrees". X111. To provide signing, (except guide signs) and traffic control devices, as neces- sary, such as striping and croaswalk markers. M. To eliminate and prohibit the disposal of any open sewage within the limits of 'the Project'. ` Bangor BBF -u-01-3(6) January 6, 1976 Page 4 of 6 -4- Attachment - 1 1N. To make such changes within 'the City' fire alarm system, city sewers, city water, and city street lighting, including service connections and mannole adjustments and other 'City' owned and maintained utility fixtures (if exlst- ing) without expense to 'the State' as may be reluired as a result of 'the Project'. Such changes as may be necessary should be coordinated with work being done on 'the Project' by the highway contractor. M. To assume all claims for damages to private underground utility -type installa- tion, wherever the locations of such installations are not known by 'the State' or the contractor, or which locations may not be shown on the plans for this project. Also, to be responsible for the removal, replacement, altera- tion, or relocation of any existing private underground utility type installa- tions (such as wires, water, sever, drain pipes) as may be necessary to permit construction of 'the Project' within the previously described project limits. XVII. To be responsible for and to notify all utilities that, except in the case of an emergency, no service opening permits for opening any pavement within the limits of the proposed project will be issued for a period of five (5) years Iran the date of completion of 'the Project'. XVIII. To regulate (where the control of utilities using the highways is delegated to 'the City' the use by all pub16C end private utilities of any FaTtion of the right-of-way of the highway within 'the Project' in accordance with the rules, regulations, and policies applied by 'the State' in its control of utility use of highways. M. To make the attached "Backfilling nNuiress ts" or "City Ordinance" a part of all service opening petits for work within the limits of 'the Project'. U. (Continued) by the public, and are properly maintained or removed at no expense to 'the State'. Any existing encroachment that is removed shall not be replaced without prior approval of this State' and the Federal Highway Administration. YYI. To prohibit ary new encroachments within the right-ot- ay of 'the Project' after the effective date of this agreement, unless prior approval is obtained from 'the State' and Federal Highway Administration. Me material shall be uniformly distributed in layers of not since than 8 inches, loose measure and each layer thorougbly compacted by one of approved connection be- fore successive layers are placed. When backfill is being placed around a pipe r structure, operations shall be so conducted teat the fill is always at approximate- ly the same elevation on both aides of the structure. Water &ball be added when neces- sary to. increase the moisture content of the backfill material to obtain cacpaction. Puddling or jetting of backfill will not be allowed. All sheeting and bracing used during execration shall be renoved by the utility follow- ing the completion of the work, and all voids resulting from the use of the sheeting and bracing backfiued where necessary unless otherwise directed by the 'Department's' Engineer.
