Councilors Introduced Filed by ting not Gass and zendzian.' _CT 14 CLEIM •••••• _Councilman ��/ MINIMUM STANDARDS FOR GENERAL AVIATION FIXED BASE OFERATffi(3 ON BANGOR INTERNATIONAL AI AR'T- DECEMBER 8, 1976 The following seta forth the proposed minimwo standards and policies for General Aviation Fixed Base. Operators on Bangor International Airport in order to foster, encourage, promote and develop general aviation and related aeronautical activities. Contingent upon his qualifications, his meeting the established minimum standards, the execution of a written agreement with the city and the payment of the prescribed rentals, fees and chargee, the operator shall have the right and privilege of engaging In and conducting the. activities on the city's airport as specified by a written contract. The granting of such right and privilege, however, shallnot be construed in any manner as affording the Operator any exclusive right of use of the promisee and facilities of the airport other than those premises which may J y be leased exclusively t0 him and then only to the extent provided in a written agree eat. The city reserves and retains the right for use of such airport by others who may derive to use the same pursuant t0 applicable federal, state and local laws, ordinances, codes, minimum standards, and other regulatory measures pertaining to such use. The city reserves the further right to designate the specific airport areas in which the individual or a combination of aeronautical services may be conducted. Such designation shall give consideration to the nature and extent of the Operation and the areas available for such purpose consistent with the orderly and safe Operation of the airport involved. z A prospective General Aviation Fixed Base Operator shell submit to the Airport Department of the City of Bangor the following information and, thereafter such additional information as may be requested by the city. a. Intended Scope of Activities. The prospective operator most submit a detailed description of the scope of the intended operation and the means and methods to be employed to accomplish the contemplated operating standards in order to provide high-quality service to the aviation and general public. ib. Financial Responsibility. The prospective operator must provide e statement satisfactory to the city, in evidence of his financial responsibility from a source acceptable to the city and readily verified through normal banking channels. The prospective operator net indicate his ability to provide working capital to carry on the contemplated operations, once initiated. c. Experience. The prospective operator .shall also furnish the city with astatement of his past experience in the specified aviation services to be supplied by him on the city's airport. d. Requirements of a written agreement. prior to the commencement of operation, the prospective operator will be required to enter into a written agreement with the City of Bangor. e. Performance Bond. Upon demand by the city, the prospective operator shall, concurrent with the execution by him of the written agreement, furnish a performance bond acceptable to the city or a cash deposit in an amount satisfactory to the city. f. Hold -Harmless Requirement. S. Insurance. h. Compliance with Laws, etc. The operator shall at all times comply with federal, state and local laws, ordinances, codes and other regulatory measures applicable to the specific types of Operation required ander the minimum standards. *must also be approved by Exxon i accordance with the Fuel Storage 6 Dandling Facilities AU eement, page 5, para.8 which states: FIXED BASE OPERATOR: Lessor shall have the option of appointing itself General Aviation Fixed Use Operator (hereinafter referred toe wFBO"). Lessor shall have and retain the right to appoint another ISO to parts= such function subject, however, to said FED's ability to enter into satisfactory contractual arrangements with Exxon.., The operator shall procure and maintain during the term of the agreement, all licenses, permits and urban similar authorizations required for the conduct of his business operation. Description of facilities available: Bldg. 121 - office and related space Bldg. 115 - aircraft storage 6 maintenance hangar Bldg. 457 - maintenance hangar Aircraft parking apron paved Equipment and parte inventory Mandatory Services. For the purpose of these Service Standards, r "general aviation aircraft and users" is defined as all aircraft, operators and users of the airport who.desire to utilize any o all services offered by the General AvlatLon Fixed Base Operator with the following exceptions! The Airport Department is the operator of the fuel storage and distribution system underual agreement between the city and Exxon Corporation.�Contract customers of the fuel supplier will be serviced by the fueling agent. The aviation services division of the City of Bangor Airport Department i the fueling agent. Mis division is also the ground -handling agent for all non -tenant air -carriers. Me aviation services division under the Exxon fuel agent agreement between the city and Exxon has use of the fuel hydrant system. All retail n - ontract fuel sales will be provided by the General Aviation Fixed alae Operator. The following are those services that must be provided by the General Aviation Fixed Base Operator at the airport, a. Aircraft retail fuel and oil dispensing I. Aircraft parking, tie -down; and hangar storage c. Airframe, power plant and accessory a rvices d. Radio and instrument services a. Air turf and charter service f. Flight training g. Aircraft sales and rental I. Courtesy car transportation 4 A. Aircraft Fee and Oil Dispensing Service 1. Provide into -plane retail delivery of aviation petroleum products required n the operation of all types of General Aviation aircraft normally fre- quenting the Airport. Tse City of Bangorserves the right to enter into a agreement as petroleum supplier.e 2. Fueling Facilities.- Mobile AVGAS and Jet Fuel dispensing trucks, with adequate and appropriate filtering devices, meters, grounding cables and of sufficient capacity to refuel aircraft likely to be serviced. 3. Aircraft Service Equipment. Energizers, standard starting equipment, oxygen, appropriate fire extinguishers and towing equipment shall be Provided to meet the needs of general aviation aircraft. 4. Fueling procedures.- Shall conform to recommendations and standards a set forth in Federal Aviation Administration Advisory Circular 00-34A, 7/29/74 "Aircraft Ground Handling and Servicing", as well as Bangor International Airport rules and regulations. 5. Personnel., At least two (2) properly trained and qualified ramp service personnel shall be on duty during hours for fuel dispensing. 6. Minimus Hours of Operation. Fuel and lubricant servicing shall be available sixteen (16) hours per day and seven (7) days a week. B. Aircraft Parking Tie -Down and Hangar Storage 1. Ramp Ayes a) Provide taxi lines to refueling, tie -down and hangar areas for directional convenience and safety of transient and local based aircraft. b) Provide ramp area with ground rode for refueling. c) Comply with Federal Aviation Administration Advisory Circular 00-34A, 7/29/74 "Aircraft Ground Handling and Servicing" in aircraft servicing and operations in subject areas. d) Disabled Aircraft - Me parking of unsightly "]mak" or unairworthy aircraft is in violation of Federal Aviation Administration AC 150/5380-u which establish" a program to improve the appearance of airports and to the flying public exposed to such false image of aviation safety. 5 2. Tie -Dawn Aircraft a) Installation of suitable tie -down anchors, ropes, chokesmarking and spacing as set forth In Federal Aviation Administration Advisory Circular 20-35B, 4/19/71 "Tie -Down Sense". 3. Hangar Storage a) Sufficient hangar Storage Space is to be provided for transient and local based customer aircraft, have proper fire extinguishers with employees trained in their use. - b) Possess equipment for moving aircraft such as tow tug with tow bar attachments to fit general aviation aircraft. C. Air Frame, Power Plant and Accessory Services Repair and maintenance services for general aviation aircraft, including executive type jet aircraft, shall provide, as a minimum the following: 1. Certification - Obtain and keep in force and effect as set forth under .Federal Aviation Regulations volume V, Part 145 "Repair Stations" s Domeatic Repair Station with Limited Ratings for each specific make and model aircraft, power plant and accessory designated in proposal. 2. Equipment - Sufficient equipment, supplies and parte to perform services in accordance with manufacturers' recommendations, or equivalent. 3. Personnel - Qualified Certificated mechanics along with other properly trained personnel as may be required to adequately perform in an efficient manner the various maintenance and repairs so offered. 4. Hours of Operation - The minimum Operating hours shall be from 8:oo a.m. to 5:(9,.p.m. five (5) days a week. During all other times, even O) days per week, a certificated mechanic, shall be on call - available to respond to emergency customer services. D. Radio and Instrument Services Radio and instrument repair services for general aviation aircraft, including executive type jet aircraft, shall provide as a minimum the following: 1i Certification - Obtain and keep in force and effect Limited Ratings covering Radice and Instruments of s particular make and model as per item 145.33 of Federal Aviation Regulations Part 145. 2. Equipment -.Sufficient equipment, supplies and parts to perform installations, calibrations and services in accordance with Federal Aviation Regulations, Federal Communication Commission and manufacturers requirements and recommendations. N 3. Personnel - Qualified technicians holding necessary Federal Aviation Administration mechanic and Federal Caommcations Commission license$ to adequately perform in an efficient manner the various radio and instrument services so offered. 4. Hours of operation - The minimum operating hours shall be from 8:00 a.m. to 5:00 p.m., five (5) days u week. During all other times, seven O) days eek, a Federal Aviation Administration mechanicand/or Federal Communication Commission licensed specialist she 11 be on call, available to respond to Emergency customer services. B. Taxi and Charter Service In providing subject service the General Aviation Fixed Base operator must hold eet Federal Aviation Administration Air Taxi Commercial Operators Certificate according to effective current amendments of the Federal Aviation Regulations, Part 135, and shall provide, as a minimum the following: 1. Personnel - for operation of each aircraft, a pilot or pilots, each certificated with appropriate ratings to conduct the air taxi services offered. 2. Aircraft - Aircraft must comply with all the requirements of the Air Taxi Commercial Operator Certificate held. Such operated aircraft shall be owned or leased to the lessee by an emagreent in writing. Maintenance of such aircraft shall meet all applicable requirements of Federal Aviation Regulations, Part 135. 3. Hours of Operation - Such Air Taxi service shall be offered at all times, when requested; however, this may be dependent upon the availability of personnel and aircraft. F. Flight Training The General Aviation Fixed Base Operator shall engage in flight training by providing, as a minimum, the following: 1. Certification - In compliance with Federal Aviation Regulations, Part 141 (revised 5/29/)5) obtain and keep in force 06 Federal Aviation Administration "Pilot School Air Agency Certificate" covering the flight training c urge$ offered. 2. Personnel - Proper certificated flight instructors with appropriate ratings must be provided for type of training offered as specified under the Federal Aviation Administration Air Agency Certificate. 3. Aircraft - Properly certificated aircraft of type as required for flight course designated in the Air Agency Certificate aba1L be owned or have Leased, in writing, to the Lessee. 4. Hours of Operation - The minimum hours of operation shall be ten (10) hours a day. six (6) days a week. G. Aircraft Sales and Rental The General Aviation Fixed Base Operator shall offer to the public, Aircraft Bales (new and used) and Aircraft Rental and provide, as a minimum, the following: 1. Aircraft Sales - Provide for on-site, spare parts and repair service necessary to meet any warranties o warranty for the make and model of aircraft for which sales privileges are granted. a) As a dealer and/or distributor must be authorized to represent at least me major aircraft manufacture, and shall have available or on call at least one current demonstrator representative of the appropriate franchise. 2. Aircraft Rental - Shall have available currently licensed, airworthy aircraft, owned by or leased in writing to the lessee. At least two (2) aircraft shall be designated far rental. a) me single engine aircraft. I) one multi-engine aircraft equipped for IFR flight. 3. Personnel - A properly certificated and rated pilot shall be available for the type of aircraft to be demonstrated and far check-out of pilot for aircraft to be rented. 4. Hours of Operation - The minimum hours will be from 8:00 A.N. to 6:00 P.M., six (6) days per week.' N. Courtesy Car Transportation The General Aviation Fixed Base Operator shall provide courtesy car transportation to and from the General Aviation area of the airport and the air-carrier area of the same. Section III - Optional and/or Special Miscellaneous e autical activities and Special s not herein provided for, may be onductedby the General Aviation Fixed Base Operator upon application to and approval of the Airport Committee. Reasonable terms and conditions for the privilege of engaging in these other services will be commensurate with the nature and scope of the activities/ services proposes, win consideration given to availability of suitable facilities. Such operations Include but ate alt limited to the following: 1. Banner towing and aerial advertising 2. Aerial photography or survey 3. Power line or pipeline patrol 4. Any other operations specifically excluded from Part 135. of the Federal Aviation Regulations. Nothing in these Minimum Standards is to be considered as restricting or prohibiting the Airport Committee from leasing land or availablefixed improvements, r from granting operating rights to o ,e firms engaged in providing Special Services to aircraft own and u Examples of special facility shops and the like without limiting the nature and number thereof a Aircraft upholstry, painting, avionics, contract maintenance, overhaul and modification, etc. Normally, special services x111 notencompass mandatory services required of a General Aviation Fixed Base Operation. Fees and rental for fuel and building space and available equipment will be subject to negotiations and contained in the terms of the "Agreement".
