RESOLVED. THAT the City Council finds that the notion to go into executive

BBBOLV6D, THAT the City Council finds that the motion to Be into executive
session and the recording of the vote on March 21. 1977 failed to comply with
Chapter 1, Article g of the Ordinances of the City of Bangor and that the
Heating .was a legal nullity.

Pursuant to Charter 1. Article 8, Section 4 of the Ordinances
of the City of Bangor, we, the undersigned Councilors, hereby petit o-.
you to request full Council review of a proceeding, which was held
on Monday. March 21, 1977 at 7i1$ P.M., which we believe was in,
violation of the Public Proceedings provisions of both Baine State
Stautute and City Ordinance.
Chatter 1, Article 8, Section 4 of the Bangor City Ordinances ,{
statest "Violations - ...in the event three members of .the Citv
Council oftheCity of Bangor, believe that any such proceedincs -
or action has been intentionally or unintentionally conducted or.
taken in violation of the requirements of this ordinance, auch coup-
cilors may seek review within ten (10) days, or at the next regular
meeting of the City Council after such proceedings or'action...by
written petition addressed I to the Chairman of .the City Council..;
The Chairman, shall refer the petition to the full Council,for
review Of the proceedings or action in question..."
We seek this review for the following reasons,
1) The motion t0 go. into executive Session was improperly posed.
The motion was neither "precise", nor was there a formai "re-
corded vote of 3/5 of the -members,-present and voting-�, regv ra
by State Statute and City Ordinance.
2) several matters were discussed during the meeting which were
not included in the motion. Furthermore, these subjects were
not appropriate topics ofdiscussion during an executive session*
These subjects ineludedt
a) discussion of a public bid for the Civic Center and a protest
lodgedagainst certain bids.
b) discussion of the use of city vehicles by certain city empioyces,-
d) discussion about an 'expense account for the Csy Manager.
d) discussion of the purchase of "merit medallions".
e) discussion about the value of. the City manager belonging
.o various civic 'organizations and clubs.
