11HER:g3, Section 104 of the Housing and Co®onity Development
Act of 1994 and Section 570.303(e) of Part 570 of Title 24 of the Code of Federal
Regulations requires that certain certifications and assurances be given by the ,
City of Ranger;
NOWs THEREFORE, RE IT'RFSOLVED, by the City Council of the City
of Bangor that the City of Carper will assure and certify that:
1. That the City of Bangor is in the process of complying with the regulations,
policies, and guidelines of the requirements of OM Circular No. A-95 and that
it will comply with the regulations, policies, guidelines end requirements of
Federal Mang®ent Circulars 94-4 and 94-7, as they relate to the application
for, acceptance of, and use of federal funds under Title I of the Housing and
Cosmmnity Development Act of L994 (hereinafter referred to as "this program").
2. It will comply vide:
(a) Title VI of the Civil Rights Act of 1964 (P.L. 63-352), and in con-
Pormence with all requirements imposed byor pursuant to the Regulations
of the Department of Housing and urban Development (24 CFA Part 1) issued
pursuant tothatSectimy and in accordance with that Section, no person
in the United States shall, on the ground of race, color, or national -
origin, be excluded from participation in, be denied the benefits of, o
be otherwise subjected to discrimination order any program or activity
for-vhich the City of Rangor receives Federal financial assistance and
hill iumadiately take any measures necessary to effectuate this
If any real property or structure therein is provided or improved with the
aid of Federal financial assistance extended to the City of Ranger, this
assurance shall obligate the City of Censor, or in the edge of any transfer

property or structure is used for a purpose for which the Federal financial

(b) Title VIII of the Civil Rights Act of 1968, (P.L. 90-284) ss amended,
and will administer all programs and activities relating to housing and
:mmwmity development in a mabser to affirmatively further fair housing in
the sale or rental of housing, the financing of housing, end the provision
of brokerage services vithin the City of Bangor's jurisdiction.
(c) Section lOb of the Housing and Community Development Act of 1944 and
in conformance with all requirements imposed by or pursuant to the Regulations
of the Oepodtmmt (24 CFR Part 540.601) issued pursuant to that Section; end
in accordance with that Section, no person in the United States shall on the
ground of race,
color, national origin or ex, be excluded from participation
n, be denied the benefits of, or be subjected to discrimination under, any
program or activity funded in whole or In pact with fonds provided under
Title I of the Housing and Community Development Act of 1944.
(d) Executive Order 11063 on equal opportunity in housing and nondiscrimination
inthe sale or rental of housing built with Federal assistance.
(e) Section 3 08 the Housing and Urban Development Act of 1968, as amended
requiring that to the greatest extent feasible opportunities for training
and employment be given lower income
residents of the project a and
contracts for work in connectionwiththe project be awarded to eligible
business concerns which are located in, or owned in substantial part by,
persona residing in the area of the project.
(f) Executive Order 11246, end in conformance with all requirements imposed
by or purauant to the Regulations of the Department (24 CFR Part 130) issued
Pursuant to that Section; and in accordance with that Section, no person
shall be discriminated against on the basis of ra color, religion, sea
or national origin in all phases of employment during the performance of
Federal or federally -assisted contracts, and that contractors and sub-
contractors will be required to take affirmative action to ansure fair
treatment in employment, upgrading, demotion, or transfer; recruitment or
recruitment advertising; layoff or termination, rates of pay or other
forms of compensation and selection for training and apprenticeship.
3. Prior to the aubmiasion of its application, the City of Bangor One:
(a) Provided citizens with adequate information concerning the amount of
fonds available for proposed community development and housing activities,
the range of activities that may be undertaken, and other important program
requirementan
(b) Held tun Public hearings to obtain the views of citizens on community
development and housing needs; and
(c) Provided citizens an adequate opportunity to articulate needs, express
preferences about proposed activities, assist in the selection of priorities
and otherwise participate in the development of the application.

4. The City of Bangor will
(a) Provide fair and reasonable relocation payments and assistance in
accordance vith Sections 202, 203 and 204 of the Uniform Relocation
Assistance and Real Property Acquisition Policies Act of 1970 (P.L.
91-646) and applicable HUD regulations (24 cFR Part 42), to or for
families, individuals, partnerships, corporations orsiations dis-
placed as s Ault of any acquisition of real property for an activity
assisted under this progress.
(b) provide relocating assistance programa offering the services described
n Section 205 of the Act (P.L. 91-646) to such displaced faffi1ies, Indi-
viduals, partnerships, corporations or associations in the cancer provided
under applicable HUD regulations;
(e) Assure that, within a reasonable time prior to displacement, decent,
safe, and sanitary replacement dwellings will. be available to such dis-
placed families and individuals in accordance with Section 205 (c)(3) of
P.L. 91-646; and that such bousing vill be available in the sane range of
choices to all such displaced persons regardless of their race, color,
religion, national origin, sex or.souree of income;
(d) Inform affected persons of the benefits, policies, and procedures
provided for under HUD regulations; and
(e) Carry out the relocation process in such a sooner as to provide dis-
placed persona with unifam opal consistent services including anyservices
required t0 in are that the relocation process does not result in different
r separate treatment to such displaced persons o ount of their race,
color, religion, national origin, are or source of income.
5. The City of league ai11:
(a) In acquiring real property in connection with the coommunity develop-
ment block grant program, be guided to the greatest extent practicable
under State law, by the real property acquisition policies set out under
Section 301 of the Uniform Relocation Assistance and Real Property Acqui-
sition Policies Act of 1970 (P.L. 91-646) and the provision of Section 302
thereof;
(b) Pay or reimburse property owners for necessary expenses as specified
In Section 303 and 304 of the Act; and
(c) Inform affected persons of the benefits, policies, and procedures
provided for under HND regulations (24 CFR Part 42).
6. It will give HUD and the Comptroller general through any authorized repre-
sentative access to and the right to examine all records, books, papers, or
documents related to any grants made under this program.
7. It will comply with the provisions of the Hatch Act which limit the
political activity of employees.
8. It will comply with the provisions of: Executive order 11296p relating
to evaluation of flood hazards.
9. The Community Developnent Program has been developed 80 as to give maximum,
feasible priority t0 activities which will benefit low--or moderate-income
families and aid in the prevention and §limination of alums and blight.
10. It will establish safeguards to prohibit employees from using positions for
a purpose that isor gives the appearance of being motivated by a desire for
private gain for thanselveat or others, particularly those with Mom ther-AwYe
family, business, or other ties.
11. It will comply'with all requir®ments imposed by HUD concerning special
requirements of law, program requirements, and other administrative require-
ments approved in accordance with Federal Management Circular 74-7.
12. It will administer and enforce the labor standards requiraaents set forth
in 24 CFA Part 570.605 and END regulations issued to implement such requirmsents.
