TEAT in accordance With 30 MESA 111911 at sag., as amended, the City Council of the City of Hanger bereby orders the City Clerk to place o a ballot at a Special Municipal Election to be held on December 5, 19]] the following question: "Shall the municipality approve the charter amendment reprinted below?" THAT Article N of the Bangor. City Charter ie hereby emended with Me following: SEC. 9-A Recall'. My member of the City Council may be recalled and removed therefrom by the voters of the City as herein provided: (a)Procedure. Any fifteen (15) qualified voters Of the City may begin the recall procedure by signing and filing with the City Clerk an affidavit containing the na of the member o members of the City Council whose removal is sought. Said affidavit shall also state the specific r why or the removal is desired, whenever requested by said fifteen (15) voters, the City Clerk shall then prepare the proper recall petition forme with a copy of the affidavit attached thereto, whereafter the Clerk shall, during office hours for thirty (30) business days, keep the petition open for signature: by registered voters of the City, and no such petition shall be signed or presented for signature at any place other than the City Clerk's Office. At the expiration of said thirty (30) business days, the City Clerk shall declare the petition closed. (b) Certification of recall petition. Within ten (10) days after the closing Of the petition, the Clerk shall uncertain whether or not the petition is sufficient. In Order to be sufficient, the petition most be signed by -a number of voters of the City equal to at least ten percent (109) of the number of registered voters as determined at the time of the last preceding municipal election. Me Clerk shall attach to said petition a certificate showing the sults of such examination. If the petition is found to be insufficient, the Clerk shall take no further action and the petition will be considered to be null and void. (c) Calling of recall election. If the petition shall be certified by its City Clerk tobesufficient, Me Clerk shall submit the same with the Clarke certificate to the City Council at its next regular meeting aid shall notify the member or members whose removal is sought by such action. The City Council shall thereupon, within ten (10) days after the receipt of the City Clerk's certificate, order a election to be held not less than forty (90) nor e than sixty (60) days thereafter; provided that if a magular municipal election is to occur within ninety (90) days after the receipt of said certi- ficate. the City Council any i its discretion provide for the holding ofa shoval election on the date of Such municipal election.
