THAT the City of Bangor acquire by eminent domain, pursuant to its duly adopted Community Development Program, property owned by Maurice and Mary Smith and designated as Parcel 10-12, located at 290-292 Hancock Street, Bangor, Maine, and described as follows: A certain let or parcel of land with the buildings thereon, situate n the northerly aide of Hancock Street and westerly aide of Boyd Street in said Bangor, bounded as follows, viz: Beginning at a granite monument act Into the ground at the intersection of the westerly line of Boyd, Street with the northerly line of Hancock Street; thence northerly on and along the westerly line of Boyd Street forty four and seventy one one hundredths (44.91') feet to point; thence westerly fifty two. and eighty one one hundredths (52.811) feet to a stake recently driven into the ground on the easterly lite of a lot of land conveyed by James T. McCann at ale. to Nicholas Ferris by deed dated November 30, 1909, recorded in the Penobscot County Registry of Deeds, Volume 801, Page 389; thence southerly on and along last mentioned line fifty two and ninety three one hundredths (52.93') feet to an iron spike driven into the ground on the northerly line of Hancock Street; thenceeasterly o and along the northerly line of Hancock Street fifty six and sixty four one hundredths (56.64') feet to the point of beginning. Beingm the same premises conveyed by Nicholas Rogers, a/k/a'Nicholas Rug- gieriyto Maurice and Mary Smith by warranty deed dated October 22, 1960, and recorded in the Penobscot County Registry of Deeds in Volume 1954, Page 393. Be it further resolved by the City Council of the City of Bangor that, in accordance with independent appraisals of value of the Love -described property, the amount of damages determines to be Just compensation for the acquisition of the fee simple interest in the above-described property is $9,000.00. STATEMENT of FACT: 30 M.R.S..A. E 4854 authorizes municipalities to acquire by eminent domain property, or an interest therein, in desig- nated alum or blighted areas. In order to exercise this power, the City Council must first adopt a "Resolution of Condemnation" to be served upon the property owner(s). After service is completed, the Resolution Is resubmitted to the City Council for its approval o disapproval after a public hearing.
