Certain Requirements under the Public Works EOploysent Act a 1977.

EESOLVED. THAT, the City of Bangorwishesto make an application for end
receive Federal funds under the Public Works Employment Act of 1977. and
WHEREAS, 13 CFR Fort 317 requires that certain certifications
and "compose be given by the City of Bangor in connection with this application;
WOW, THEBEFCPE, HE IT RESOLVED, by the City Council of the City
of Bangor that the City of Bangor hereby assures and certifies that it shall comply
Vito the regulations, policies, guidelines and requlxments, including Office of
Managemut and Budget Circular No. A-95, and Federal Management Circulars 74-4 and
74-7, as they relate to the application, acceptance and use of Federal funds for
this federally assisted project. Also, the City of Bangor gives assurance and
certifies with respect to the great that:
1. It shall require the facility to be designed in accordance
with the provisions of 41 CPA Subpart 101-19.6 "Acco®odations for the Physically
Handicapped." The City of Bangor Shall be responsible for continuing inspections
to insure compliance with this requirement by the contractor.
2. No contract will be awarded in connection with the project
toany bidder Ww will. eeploy any ellen in the United States in violation of the

Immigration and Nationality Act or any other law, convention, or treaty of the
United States relating to the ignigratloq exclusio., deportation, or expulsion
of elders.
3. Thepraj act will be constructed from raw materials mined or
produced in the United States and Prom Halted States manufactures substantially
made from materiels mined, produced or memafactured in the United States, unless
the Assistant Secretary determines that this requirement is not applicable to the
City of Bangor's project.
4. At least 10 per -centum of the amount of each grant bM'be
expanded forminority business enterprises, unless the Assistant Secretary deter-
mines that this requirement is not applible to the City of Burger's project.
For the purpose of this paragraph, the team "minority business enterprise" Opens

in case of a publicly owed buslcesd, at least 51 per centum of the stock of which

5. Special consideration, consistent with euating applicable
collective bargaining agreements and practices, shall be given to the employment
on the project of qualified disabled veterans as defined in 38 MC 2011 (1), and
to. qualified VSet,am-em veterans, as defined at 38 USC 2011 (2)(A).
6. If the grant is made under the previsions of Section 100(e)
of the Act (Pocket oP Poverty), employment engendered by the project will be
offered preferentially to the residents of the neighborhood or cormumnity that
defines the project area. Further, the project will be located pnyea'cally within
the project area as defined in Inhibit S-11-5, previously submitted to ffi .
7. No part of the construction (including demolition and other
site preparation activities), renovation, ....^��..r�epair or other inprovement of the project
shall be performed directly by any dep%ftawnt, agency, or inatruaratality of any
State or local government. Construction of the project shell be performed by
contract awarded by competitive bidding, unleas the Asaintant Secretary determines
that some other nethod of bidding is in the public interest.
B. The. City of Hangorwill comply with assurances made previously
in connection with any, earlier application submitted on Form M-101 for financial
assistance for the project herein described if assistance for the project is approved.
