ORDERED.
TEAT the building or structure, located at 225 Ohio Street, Bangor,
Maine, on a lot described in volume 2139, Page 896 and Volume 2530, Page
38, Penobscot Registry of Deeds and owned by Harriet B. Curtis and Elizabeth
{3. Trials, le hereby adjudged to be a nuisance and dangerous, as provided in
Title V, NAIVE REVISED STATUTES of 1964, Sections 2851 through 2853, as
amended, and shall be disposed of as follcwe;
(1) Said building or structure Shall be demolished by
the owner(s) within thirty (30) days of the d 4 re:
of passage of this Order, said demolition to be
in conformity with the loss and Ordinances of the
City Of Bangor.
(2) In the event said building or structure is not
demolished within thirty (30) days as provided
above, the City Code Enforcement office shall
cause said building o structure to bedemolished
as soon an passible, all expenses incurred thereof
to be paid by the -o er(s) o assessedagaine the
property ia�accotdance with 17 MRS Section 2853.
(3) The owner(s) of aafd building or structure shall
remove all personal property located therein, and
in the event that the owner(s) fail to comply with
this Order, the City Code Enforcement Officer shall
remove and dispose of said personal property.

The Bangor City Council held a public hearing o the above property c l y

Chairmen Saucy asked if anyone in the audience wished to speak. ,
Basil D. Eaton, Code Enforcement Officer for the City of Bangor, indicated
that he bad pictures of the subject property and asked the City Solicitor to
pass them around after he had read the descriptions on them. in 1976 the ell
of this building was
condemned by this Council. Lacer, we found out that the
Bangor Savings Bankhadartgage o the building. Also, it was learned that
the FBA had insured the mortgage. It has taken a year to get the building
entirely inn
order for condemnation. After the ell had been condemned, three
embers of the FMA (McMahon, Scanlin and Cawley), the City Attorney and I
sited the structure. I had never
r been aide the building before.Mr. Eaton
stated that be would like CD read a Setter it= Mr. McMahon which was
sent to
the head office in Washington. 'The mortgagee, Bangor Savings Bank, hasrequested
a 30 -day extension of the time to appeal, to July 24, 1976, in order that this
insuring office may request advice from our Central Office.ag
The Housing Mane-
tDirector, Realty Specialist, and Loan Specialist from this office have
visited the property, and it is the opinion of these 3 staff members that the
property in its entirety should be demolished." (Noce, the letter is dated
June 18, 19]6)
At this point, Mn Baton passed the pictures and indicated their comber and
description: -
picture #1 - clapboards gone, corner rotten And foundation moved out 2 feet
picture #2 - same exposure
Picture #3 - ell, part of the main house and what was a porch
Picture #4 - all porches '
picture #5 - looking from the rear Co the front of the foundation
picture #6 - porch leading to the rear apartment
picture #] - wall has moved out 14"
picture #8 - bank has secured the building to some degree
Picture #9 - wooden shingles on rear of building dry and hazardous to fire;
and doesn't protect the building.
Chairman Soucy asked if anyone else had any questions and if not, we would close
the public heating.
John Mc%ay, in his capacity as attorney for the Bangor Savings Bank, stated that
hewas
appearing not i apposition c the Order, but to indicate the positionof
the Bank. The bank has submitted the abstract to Mr. Miller and the mortgage is
under foreclosure which will ripen in September. The bank, in the meantime, will
Iain the property.

be turned over
to the

Chairman Soucy asked if the building was occupied
Mr. McKay responded that the building was ort occupied as a dwelling. However,
it is broken into a lot and several times the bank has had to go up and replace
boards. It has been a real problem.
Chairman Soucy was a little confused as to Mr. McKay's position.
Mr. McKay stated that the Bangor Savings Bank does have an interest in the
property be haven't neglected the property. We have of asked for a delay.
it was his understanding that there may have been same minor defects in the
order last year and this is why the building as a whole is being considered
tonight.
The public hearing was declared closed.
Councilor Zendzfan I move for passage of the hider.
