WITNESSETH Whereas, Bangor and Brewer both have a police force, and Whereas, the need arises from time to time -for additional police manpower in each municipality, and Whereas, Bangor and Brewer are desirous of -protecting `. the life and property of their citizens, and Whereas, Bangor and Brewer are interested in entering into a Mutual Assistance Compact for Police Protection. NOW THEREFORE it is agreed by and between the Parties as follows: 1. That request for assistance under this Compact will be made only when the requesting police agency has exhausted or fully committed its available police manpower and resources, and/or where additional manpower and/or resources are require8 toprotectlife or property, to maintain order, to prevent the commission of criminal acts, or to prevent the escape of a person who has committed a criminal act. 2. That requests for assistance under this Compact will be made only by the Chief of Police of either party, or in his absence by the sworn officer who is authorized to act in behalf _z_ of the Chief of Police. 3. That the amount of police manpower and resources to be providedshallbe at the sole discretion of the Chief of Police, or other authorized police official of the responding department, who must take into consideration the continuing amount of police protection required within his ownjurisdiction. 4. That police officers of the departments shall be duly appointed and sworn in as special officers or constables in the departments of both the Cities of Brewer and Bangor. That such officers will have authority to exercise police powers in the jurisdiction of a party to this Compact only when their assistance is officially requested by the Chief of Police, o his authorized representative of either municipality. 5. That special officers or constables shall serve and hold their appointments at the sole discretion of the Chief of Police of the departments for which they are appointed special officers or constables pursuant to this Compact. 6. when assistance is requested under this Compact, the Chief of Police or his designee of the requesting, department shall be in charge of the entire police operation within his jurisdiction, but, officers of responding department shall command their own men unless otherwise directed by the Chief of Police or his designee of the requesting department. - y. while on duty, officers rendering aid to a requesting department shall have the same powers, duties and privileges as do members of the requesting police department. 8, That each municipality shall pay the salaries and fringe benefits of its own officers. -3- 9. That all equipment of a responding department which is lost, damaged or destroyed will be the responsibility of the owning department. - 10. All personnel of a responding departaent injured while in the process of providing aid shall be compensated by the responding department. 11. All liability incurred to third parties by a responding department for darage to property or injuries to persona shall be paid to the third party by the responding department 00 12. Each municipality hereto has the right to unilaterally withdraw from this Compact upon giving thirty (30) days written notice of its intention to do so to the other party of the Compact, and thereafter the Compact shall be null and void at the end of said thirty (30) days. 13. Any unforeseen problems developing as a result of this Compact shall be resolved by the joint action of the Chiefs of Police, or their authorized agents. -4- 14. This Compact agreement constitutes the entire under- standing between the municipalities. Any modification of or additions to the terms and provisions hereof shall be in writing and executed in the samemenner and with the same formality as this agreement. 15. This agreement shall remain in full force and effect, subject only to the conditions set forth in paragraph 12, supra. 16. Council orders authorizing the respective city managers and Chiefs of Police to enter'. into this Mutual Aid Compact shall be attached hereto and made a part of said agreement. In witness whereof, the City of BANGORhascaused this Compact to be signed in its Corporate name and sealed with its Corporate - seal by John Flynn, its City Manager, and Francis Woodhead, its Chief of Police, both duly authorized; and the City of BREWER has caused this Compact to be signed in its Corporate name and sealed with its Corporate seal by Earle Stevens, its City Manager and David Roman, its Chief of Police, both duly authorized, on the day, month, and year first above written.
