HomeMy WebLinkAbout2021-05-10 21-171 Order 05/10/202121-171 05/10/2021 21-171 Airport Order 001-001 Title, Order Authorizing Execution of a Second Amendment to the Lease Agreement with Nate Holyoke Builders, Inc. This Order will authorize the City Manager to execute a second lease amendment between the the City of Bangor and Nate Holyoke Builders, Inc. If approved, the Airport and the tenant agree to share the cost to epoxy the hangar floor, which will help protect and extend the useful life of the hangar floor. The tenant has agreed to pay for the total improvement of $6000 up front. The City's share, not to exceed $3000, will be paid through a lease credit of $1500 for two months. The current lease is in year 2 of a 5 year term, that includes a 5 year extension. All of the terms within the current lease will remain in full force and effect. This amendment shall be in final form as approved by City Legal. Airport Committee 05/03/2021 Recommend for passage 50 Staff recommends approval. Consent 05/10/202121-171 CITY OF BANGOR ORDER 05/10/2021 21-171 Sprague Authorizing Execution of a Second Amendment to the Lease Agreement with Nate Holyoke Builders, Inc. WHEREAS, the Lessor is the owner of an Airport, commonly known as “Bangor International Airport”, formerly known as Dow Air Force Base and located in the City of Bangor, County of Penobscot, State of Maine (hereinafter sometimes referred to as the “Airport”); and WHEREAS, the Lessee desires to and does lease from the Lessor certain facilities at said Airport for lease of a hangar to house its aircraft and conduct business, including use of office space; and WHEREAS, the City of Bangor and Nate Holyoke Builders, Inc. are parties to an Indenture of Lease dated August 30, 2019 wherein they lease certain facilities from the City; and WHEREAS, Nate Holyoke Builders, Inc. leases Bay #1 of Building 123 (also known as the Corporate Aviation Hangar) at the airport; and WHEREAS, As a capital improvement, both the airport and Nate Holyoke Builders have agreed to epoxy the hangar floor and cost share this investment; and WHEREAS, This improvement will help protect and extend the useful life of the hangar floor. NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, That Catherine M. Conlow, City Manager, is hereby authorized on behalf of the City of Bangor to execute a second amendment to the lease between the the City of Bangor and Nate Holyoke Builders, Inc. to cost share the facility improvement to epoxy the hangar floor. The estimated total cost for this improvement shall not exceed $6,000 with the City's share not to exceed $3,000. Nate Holyoke Builders Inc. will receive a credit towards the rental of the hangar. All of the terms within the current lease will remain in full force and effect. This amendment shall be in final form as approved by City Legal.
