Please be advised that the Planning Board at its regularly
scheduled meeting of January 3, 1978 voted 5 in favor and 0
opposed to recommend approval of the above zoning amendment
After careful deliberation, the Board concluded that the
proposed amendment had adequate safeguards to protect the
rural areas from any negative impact from such home occupation
or profession uses and that the additional flexibility given to
property owners aver -weighed other considerations..

THAT Chapter VIII, Article 5, Section 3 (2) be amended as follows:
(k). A name occupation or profession authorized under Article
21, Section 2 (1) (h).
THAT Chapter VIII, Article 21, Section 2 (1) be mounted as follows:
(h) Notwithstanding the requirements of subsections (a), (b),
W. and (g) above, the use of land and/or buildings for
purposes of a. home Occupation or profession shall be
authorized as a special exception in Ne Agricultural Zoon;
provided that such use shall conform with the following:
1. The home occupation or profession shall be conducted
only in the applicant's primary residence or a separate
structure located On the promises of such residents.
2. The hone occupation or profession use onforms 1n all
respects with therequirements of subsections (d),
(e), and (f) of this Section.
3. Me groes floor area to be utilized in'the conduct of
the home occupation or profession shall not earned

4. The minimum lot area for any promises utilized for a
hots occupation or profession authorized under this
subsection shall be at least 5 acres.
5. If the home occupation or profession is to be conducted
from a separate structure, such structure shall be located
with a setback of not leas than 75 feet from any public may,
and shall have ar yard and side yards of not lees than
100 feet from any public way or property line.

SO&T&CT: Proposed Amendment to the
At the request of the Planning Board, the Planning Staff with
assistance from the Assistant City Solicitor added some standards
And conditions to the original language of this proposed zoning
amendment. (attached to minutes)
The Planning Board did not address the question of amending
the language of the original request at its December lath. meeting.
However, the staff strongly recommends that if the Council decides
to approve the proposed amendment, it uses the revised proposal to
insure that the safeguards contained therein are included.
