A similar arrangement has been in effect at the Airport for many years. PROTECTION AGREEMENT 71 AF This agreement, made ard entered into this lstday of December 1977 pursuant or the authority of the Act of May 27, 1955, C.1051 Sections 1 - 5. P.L. 46, (69 Statute 66) 42 B.S.C. section 1856 - 1856d, and M;R.S.A. ItLlf�'.. 30, Section 1951 by aM between the Secretary of the Air Force, acting through the Maine Air national Guard and the USPPO for the State of Maine, here- inafter called the Government, and the City of Bangor, hereinafter called the City. Whereas, it is feasible and desirable for the parties. hereto to enter, into a joint agreement whereby personnel, equipment, supplies, a:sl real property are committal to provide fire protection for military and civilian . aircraft and property within the boundaries of Bangor International Airport. MCM plumuradr, the parties hereto do mutually agree as follows: 1. Equipment. Fire equipment listed below and issued by the Federal Government to the USPFO for MCANG use, will be made available to the City for joint use in accordance with the provisions of this agreement. It is further understood and agreed that the fire equipment is the property of the Federal Government and will continue to be. Subject to coordination with the City, the Government reserves Me - right of utilization of any or all equipment for any purpose. The Government Replaces Crash 6 Rescue Agreement Dated 1 April 1974 Which is hereby termlreted. y shall furnish all necessary maintenance, modification save repair of the vehicles and equipment furnished hereunder. Vehicle fuel and lubricants Bill be provided by the Government She City agrees that equipment covered by this agreement will be checked on a daily basis and a i`ecora of such . checks will be maintained by the person or persons performing such checks..' If there is a failure to make such checks on Ne pert of any employee or agent of the City and Mob failure results ih damage to the equipment, the City agrees m bear the coat of repairing or replacing the equipment se - damaged by its employee or agent. The Government may make available for use by the City those various items of equipment, such as bunker clothes, air packs, etc., as the same - may be available to the MCANG. Special authorisations will not be established.. solely to support requirements of the City. The City shall not enter into any mutual aid or reciprocal fire protection agreements with any third party which involve use, or potential veer of Federal Government fire equipment outside thebboundaries of Bangor International Airport. It is also understood that Government fire wouipment will Act be used outside the boundaries of Bangor International Airport for . any purpose unless first coordinated with either the Air Coamander, Chief of Support Services, Base Fire Marshall or Base Fre Chief. 2. Facilities. The Government shall provide facilities in which fire equipment and personnel will normally be housed, more particularly described as Building 512. aepaio, mainteauwe, utilities and janitorial costs associated with said facility will be borne by the Government. 3. personnel. Vee City will furnish fire protection personnel trained in aircraft fire protection principlesasoutlined in this paragraph to' operate equipment listed in Paragraph 1. Said meaning shall consist of a minimum of five personnelonduty 24 hours a day. Training will be supervised by the Government and conducted jointly by the City and the Government am,`; will comply to requirements of ANG directives. FAA Advisory Circular 139.49-1 and NFFA Standards for airfield firefighters. City fire protectima personnel will be required to meet ANG licensing reuuirements for vehicle '. operators and fire protectionskill levels. The City shall furnish the Government a list of firefighters who are qualified to work at the ANG Fire Station by virtue of their training. Command of operations will rest with the Government (ANG Fire Chief) on all incidents involving both military and. civilian aircraft. In his absence the City Officer in charge assumes oorarri. The City will assume full responsibility for the structural fire protection of all Government property on Hanger International Airport. Except for command of operations as specifically outlined above, the military Fire Chief or his designated representative will have the authority to direct work accomplishment,- . for vehicle/equipment inspections and vehicle preventive maintenance. 4. Lim. Each party waives all claims against the other party for compensation for any loss, damage, personal injury, or death accuring as a. consequence of the performance of this agreement. 5. Term. This agreement shall become effective o 1 Dec I] and shall remain in full force and effect, without formal renewal, unless notified or terminated by either party as herein provided. 6. Consideration. Reimbursement shall be madelby the City to the government for all firefighting agents expended by either party to suppress fire in civilian aircraft. No other reimbursement shall be made by either party for costs incurred pursuant to the performance of this agremmant, beyond the mn- 1.: s. tribution of equipment use, personnel, structures and supplies herein provided. 7. Renegotiation. Either party may demand, on 30 days notice renegotiation or termination of this agreement.
