Witnesseth, That WHEREAS, The City has requested reconstruction of a portion of the Hagen Road (S.E. 299) and has deposited with the State certain funds as evidence of its intention to participate in a share of the costs;. and WHEPEAS, the State baa received said funds and is willing to reconstruct Hogan Road as a Federally Aided Project with the non-federal share being paid by the City;' NOW THEREROTSE, the parties oncree as follows: 1. The State agrees to do the following: _ A. To award a contract and reconstruct Hogan Road under Federal Aid Project No. M-1490(1), hereinafter referred to as the Project, substantially in accorlarmee with the plans prepared by the State bad generally described as follows: The proposed project, consisting of two "Sections", provides for the widening of Hogan Reed, construction of a raised median and taming lanes, improvements to the Interstate Ramps, and the installation of traffic signals. "Section 1" begins about MO Peet southerly of the Sylvan Road at Station I86+00 and extends 1134' northerly to Station 199+34. From the beginning of the Project to Station 190+00, the roadway, will be widened to two 12 foot travel lanes with 10 foot paved shoulders. p Station 190+00 northerly to Station 199+34, the roadway will be gradually widened to provide two 12 foot travel: inside, two 12 foot tuning lanes and 8 foot paved shoulders sadthen will toper down to match the existing width of Hogan Rand Bridge at $to. 199+34.. 4 Bangor H-1490(1) October 31, 1979 Page 2 of 6 Pages "Sectorn 2" begins at Station 203+88 and curtails northerly 2189 feet to Station 223+95. The first part of this section will be widened to 81 feet. This width will provide two 12 foot travel lane in each direction a variable width needier, two B foot paved shoulders, and 10 foot left tum lanes where necessary. The raised median throughoutthin developed area. will vary: in width, ......with traneistions in width where left torn ldnes and required. The remainder. of Section 2 will be tapered down to match into the existing read - way width. The approaches of all four interstate reaps will be widened to provide improved traffic movements. 'The triangular islands at the intersection of Hogan Road add the northbound end southbound "on ramps will be removed and the ielaods at the "off' rare will be enlarged. Portions of each reap and its shoulders will be repaved. Curbing will be placed around the traffic islands, the median, and at larger entranced to developed properties. Traffic Signals will be placed at the Interstate Hamp intersections and at the intersection of the new shopping center entrance. The entire length of the project consisting of the two sections is 0.629 builds. B. To construct a drainage system adequate to handle all noamnl Surface and aub- surface water for the entire project, and to connect this drainage system into the existing systems, eliminating any drainage structures deemed uweceseary as part of 'the Projecti. 0. To accept as partial payment of the non -Federal Share for the project, the $45,000 already paid by the City to the State. F. To maintain the project in accordance with appropriate statutes, policies and agreements, accept as provided in Article "II, D, and E" below under "The City Agrees". II. The City agrees to do the following: A. To approve the construction of Federal Aid Project N-1490(1) described 1n Item 1 above ander "The State Agrees", within the project limits as set forth in this agreement and ea shown on the plana provided by the State. E. To pay to the State at the time of the sward of contract the remainder of the estimated nen-Federal Share based upon the bid price of the contract. C. Upon completion of the Project to paw to or receive Prem the State, that amount of funds which represents the difference between the actual coats end amount .:..Already Pefd',of the non -Federal Share. D. H. To eliminate and prohibit disposal of any open eewege within the limits of the Project. I. To make such change$ within the City fire clause system, city sew , city water, and city street lighting, including service connections and marbole adjustments and other City owned and maintained utility fixtures (i£ existing) without papoose to the State as'may be required as a result of the Project. Any changed made during the construction of the Project will be coordinated with the contractors operations. J. To spends all claims for damages to private underground utility -type instal- lation wherever the locations may not be shown on the plane for this project; also to be responsible for the removal, replacement, alteration, or relocation of any counting private underground utility -type installation (such as wired, water, sewer, drain pipes) as may be necessary to permit construction of the Project within the previously described project limits. K. To be responsible for (where the control of utilities using the highways is delegated to the City) and to notify all utilities that, except in the case of day emergency, no earvrce opening permits for opening any pavement within the limits Of the proposed project will be issued for a period of five (5) years from the date of completion of the Project. 1. To regulate (where the control of utilities using the highways is delegated to the City) the use by all public and private utilities of ary portion Of the highway within. the Project in accordance with the rules, regulations and policies applied by the State in its control of utility use of highways.
