(TITLE.) Fesahigy__ _Resolution of Condemnation for 159 Hancock
Street owned by Mary C. Duke and Julia Olender.

MWLVM, THAT, the City of Bangor acquire by Eminent Domain
pursuant to its duly adopted Community Development Program, property
owned by Mary C. Duke and Julia alender and designated as Parcel
15-4, located at 159 Hancock Street, Bangor, Maine and described as
follows:
Beginning an a atone monument on the southerly line of Hancock Street;
thence south forty degrees and forty minutes east at right angles with
Hancock Street about eiLgghtyy-eight feet and eight inches to land
formerly of Charles Hellenbrand; thence easterly and parallel with
Hancock Street, twenty-five feet; thence northerly to Hancock Street
about elghty�elght feet and eight inches to a point twenty-three feet
east of the stone monument begun at; thence westerly on said Hancock
Street, twenty-three feet to the point begun at; together with the
right of passage -way in and over the passage -way of eight feet in
width, one half off of the premises herein described and one-half
off the premises next adjoining, formerly of Ellen Flaming and Catherine
McManus. Also, a second parcel, being about twenty-five feet front
on said street by about eighty-eight feet and eight inches deep,
together with a right in common in an eight foot passage -way between
the premises herein described and the adjoining lot and building now -
or formerly owned by Mrs. Mary A. Foster.
BE IT FURTHER RESOLVED by the City Council of the City of Bangor
that, in accordance with independent appraisal of value of the above
described property, the amount of damages determined to be just com-
pensation for the acquisition of the fee simple interest in the above
described property is $22,000.00. -
STATEMENT OF FACT: 30 M.R.S.A. 54854 authorizes municipalities to
acquire by eminent domain, property in designated slum or blighted
areas. In order to exercise this power, the City Council must first
adopt a "Resolution of Condemnation" to be served upon the property
owner(s). After service is completed the Resolution is resubmitted
to the City Council for its approval or disapproval. I£ the Resolu-
tion is approved, the City Council shall cause an action to be
commenced in the Superior Court.
