WBEABAS, the City Council of the. City of Bangor finds that discrimination
against families withminor children in the leasing or renting of housing
accommodations exie4s within the City of Bangor; and
WIIREAS, the City Council further finds that the existence of such dis-
crimination imposes a substantial threat to the health and welfareof a
sizeable segment of the comity, namely, families with minor children;
and
WB68EAS, the City Council finds that such discrimination creates a
shortage
Of housing suitable for families with minor children within the City; end
WHEREAS, the City Council finds that a Iw vacancy rate exists in all
rental housing throughout the ,City; and
WiEREAS, the existence of discrimination against families with minor
children, together with the shortage of housing and law vacancy rate
for rental housing creates an untenable situation for the children of
the City of Bangor; and -
WIRNBAS, the City Council finds that the overall direct of such discrimin-
art= is t0 encourage families to move t0 Other communities and therefore
has -en overalldetrimental effect an the composition of the City, the
stabilitof neighborhoods, the preservation of family life within the
City, and the living condition of she children, the quality of Bangor
schools, and the viable activities of children's activities and
organizations, -
NOW, THEREFORE, Be f4 ordained by the City Council Of the City of Bangor,
as follows;
THAT Chapt4r viI of the ordinances of the City of Bangor be amended
by adding a new Article 16, as follows:
ARTICLE 16 - DISCRIMINATION IN RMSENG
AGAINST FAALLIES WITH MOR CHILDREN
Sec. 1 prohibited Activities. It shall be unlawful for the own
lessor, lessee, subleases, real estate
broker, assignee, or other person having the right of ownership,
the right of possession, or the right to rent or lease any housing
accc®odatim% or any agent or employee of suchperson to:
1.1 Refuse to rent or lease, or otherwise deny or
to
withheld from any per such a oaon

such person has a minor child c
child o children who shall
occupy the leased or rented premises with such
person; or
1.2 Represent to any person because of the potential
terwncy of a minor child or children that housing
accommodations are
not available for Inspection o
rental when such dwelling is in fact so available; or
1.3 Make, print, or publish, or cause to be made, printed
or published any notice, statement, or advertisement,
with respect to the rental of housing aceommodatLons
that indicates any preference, limitation, or dis-
crimination based we the potential tetany of a minor
child or children; or
1.4 Discriminate against any person in the terms, conditions,
r privileges of the [ental of housing accommodations o
e
in the provision. of a rvice r facilitieai ection
therewith, because of the potential tenancy of as minor
child or children; or
1.5 Refuse to rent after the making of a bAm fide offer,
r to refuse to negotiate for the restal of, or otherwise
make unavailable or deny, housing accommodations to any
person because of the potential tenancy of a minor child
or children; or
1.6 Include in any lease or rental agreement: of housing
accommodations; a clause providing that as a condition
of continued tenancy the tenants shall remain childless
or shall not bear children.
For purposes of this Article, the term 'housing anommodations"
shall mean a residential rental unit consisting of me or more
roams in which cooking facilities are available.
Sec. 2 Tenant Us policy Not prohibited. In residential buildings otherwise
covered by this Article, where the
eer has publicly established and carried out a policy of renting
clusively to persons who are defined herein as elderly, said owner
or any other person enumerated in Sec. 1 hereinabove shall
be exempt from the provisions of this Article, provided,
hwever, that deviation from or abandonment of said policy
7 shall automatically subject said owner to all the provisions
of this ardinests.
For purposes of this Article, the term "elderly persons"
shall meaall persons who have attained the age of sixty-
two (62) or more years.
Sec. 3 Requirements of Financial Obligations Not prohibited. This
ordinance
shall not prohibit the person having the right to rent or lease
the premises from requiring the same financial obligations of
prospective tenants with minor children as he or she may require
of prospective tenants without children However, o disc oration
in the amount a ar of payment of said financial obligations
shall be permitted.
Sec. 4 Severance Clause. If my section, subsection, paragraph, sentence,
clause or phrase of this Article, or any part
thereof, is for any reason held to be unconstitutional or invalid
or ineffective by any court of competent jurisdiction, such decision
shall not affect the validity Oreffectiveness Of the remaining
portions of this Article or any part thereof.
Sec. 5 Penalt . Any person who shall violate any provision of this Article
shall be guilty of a civil violation and subject to a fine
of not more
a than SIM for each violation. Each day such violation
continues to exist shall be deemed a separate Offense.
