TEAT the City Manager is hereby authorized and directed on
behalf of the City of Bangor to execute a Supplemental Engineering
Contract for the firm of Hoyle, Tanner and Associates, Inc., Con-
sulting Engineers, Londonderry, New Hampshire, a copy of said
agreement being on file in the Office of the City Clerk, for pro-
viding Supplemental. Engineering Services for airport improvements
at Bangor International Airport, Those improvements include:
a. Security Fencing
b. Taxiway Signs
C. General Aviation Apron

Regarding: Supplemental Engineering Contract

Fencing - Taxiway Signs - G.A. Apron
Dear Mr. D'Errico
Our engineering contract for the referenced project
provides for complete engineering services for the project.
However, the extent of the services which would be required
by us during the construction phase of the project could not
be determined when the contract was executed, and therefore,
the contract stipulates that construction phaseservices shall
be provided for in a supplemental agreement (ARTICLE IL, para-
graph A. and B., ARTICLE III, paragraph B.).
Through our meetings with yourself, Mr. Frawley, and
Mr. Donnelly we have determined which services we should pro-
vide and which work can be handled by the City. In particular
for this project the City Engineering Department will have
primary responsibility for inspection of the construction and
for performing and/or arranging for materials testing; and
the City Purchasing Department will have primary administrative
responsibility for securing and tabulating bids and for award-
ing the construction contracts.
Please accept this letter as our supplement to the
following contract dated August 25, 1977.

CONTRACT FOR PROFESSIONAL SERVICES
ENGINEERING AND PROSECT ADMINISTRATION
AIRPORT IMPROVEMENTS
ADAP PROSECT NO. 6-23-0005-06'
BANGOR INTERNATIONAL AIRPORT
We request that the description of work under ARTICLE II SCOPE
OF SERVICES - CONSTRUCTION PHASE be revised as follows to
combine General Engineering Supervision and Resident In-
spection into Construction Supervision:
A. ConstructionSupervision
The CONSULTANT will provide construction supervision during
the bidding period and throughout the construction period.
Those services which will be provided include:
1. Assistance to the OWNER in analysis of bid results,
and furnishing recommendations on the award of a con-
struction contract.
2. Attendance at a preconstruction conference.
3. Consultation and advise to the OWNER during construction.
4. Preparation of supplementary sketches required to re-
solve actual field conditions encountered.
5. Checking detailed construction, shop, and erection
drawings submitted by contractors for compliance with
design concept.
6. Reviewing, analyzing, and approving laboratory, shops,
and mill test reports and certificates for materials
and equipment.
7. Review and approval of periodic estimates for partial
and final payments to the contractor.
8. Preparation and negotiation of change orders and supple-
mental agreements.
9. Making periodic inspections of work in progress, and
providing appropriate reports to the OWNER.

10. Inspecting initial operation of the project or of per-
formance tests required by specifications.
11. Attendance at final inspection of the completed con-
struction and preparation of a report on any deficiencies,
corrective actions required, etc. as determined at said
inspection.
12. Preparation of "as built" drawings based on information
provided by the resident inspector and the contractor.
13. All printing of "as built" construction drawings as re-
quired for distribution to the OWNER, the FAA, and NHAC.
It is anticipated that the OWNER will undertake most or all of
the daily inspection of the construction for the PROJECT. How-
ever, if requested to do so, the CONSULTANT shall provide a
part-time inspector satisfactory to the OWNER, the FAA and the
Maine DOT and when on the job the inspector shall perform .the
following additional construction supervision duties as ap-
plicable;
14. Supervise and control or undertake the layout of the
construction.
15. Prepare daily inspection reports covering the work in
progress, delays to construction, unusual events,
visitors to the work site, etc.
18. Provide "as built" information for preparation of "as
built" drawings of the completed project.
17. Supervise testing and inspection. Arrange for, con-
duct, or witness field, laboratory, or shop tests for
construction materials as required by the plans and
specifications; determine the suitability of materials
on the site and brought to the site to be used in
the construction; interpret the contract plans and
specifications and check the construction activities
to assure compliance with the intent of the design;
measure, compute, or check quantities of work per-
formed and quantities of materials inplace for partial
and final payments to the contractors; and maintain
diaries and other project records to document the work.

We request that paragraph C under ARTICLE V COMPENSATION be
revised accordingly as follows:
The CONSULTANT shall charge for all construction supervision
services provided under ARTICLE II, paragraph A on the basis
of the actual cost of providing such services, plus a Fixed
fee payment. The CONSULTANT's charges for actual costs of
providing services will be computed as the total of (1)
Salary Cost, (2) Overhead, and (3) Direct Non -Salary Expenses,
all as defined in the Federal Aviation Administrations Ad-
visory Circular No. 150/5100-9 dated 1, July, 1972, entitled
"Engineering Services under the Airport Development Aid Pro-
gram".
The CONSULTANT's charges for actual costs shall not exceed
the following limits without the prior written approval of the
Owner, the FAA, and any other agency having jurisdiction:
For actual costs for services under Article 11, paragraph A,
and upset tiof Ten Thousand and 00/100 Dollars ($10,000).
The CONSULTANT's fixed fee payment for work under Article II,
paragraph A shall be One Thousand and Five Hundred and 00/100
DoLlars ($1,500).
We request that paragraph B Article III be revised as follows:
B. During Construction Period the CONSULTANT shall provide
project administrative services during construction and through-
out the remaining project period. The CONSULTANT's services
under this paragraph shall include:
1. Preparation of and/or assistance with forms and sup-
porting documentation required by the Owner to obtain
partial and final grant payments from the FAA and the
Maine DOT.
2. Other assistance with any other administrative type
work reasonably required and requested by the Owner
in connection with the PROJECT.

We request that paragraph D, ARTICLE V COMPENSATION by amended
to include charges for services under ARTICLE III, paragraph B
as follows:
Actual COSI
5. For the actual costs of providing services under
Article III, paragraph E, an upset limit of One
Thousand Five Hundred and 00/100 Dollars ($1,500).
Fixed Fee
5. For providing project administrative services under
Article III, paragraph B, thefixed fee payment of
Two Hundred Twenty -Five and 00 0 Do ars ($225).

consistent with the intent of our original contract. Should

This letter is hereby accepted as a supplement to the Contract
entitled:

BANGOR INTERNATIONAL AIRPORT
Said contract being dated August 25, 1977 by and between the
City of Bangor and Hoyle, Tanner & Associates, Inc.
By this acceptance the City of Bangor agrees to pay Hoyle,
Tanner & Associates, Inc. the additional amounts for com-
pensation specified herein in recongnition of the additional
services to be provided by Hoyle, Tanner & Associates, Inc.
will accept such payments as full compensation for the additional
services.
