(Orbao Authorizing City Manager to Enter into Attached Agreement with MOT - State Street and Hogan Road Reconstruction By City Coyncl of City ofBawy ORDERED, THAT WHEREAS, the City has previously entered into an Agreement with the Maine Department of Transportation for the reconstruction of the intersection of State Street and Hogan Road under the Federal Urban Program, and WHEREAS, MOT is now prepared to advertise for bids for the construction of said improvements subject to the receipt of an Agreement with the City, a copy of which is attached, NOW, THEREFORE, be it ORDERED, that the City Manager be and hereby is authorized to sign said Agreement on behalf of the City of Bangor. The State fees to do the following: A. To award a contract under Federal Aid Project No. TCR -1401(1) hareirefter referred to as the Project, and perform Work substantially in .accordance With the plans prepared. by the State. ®d generally described ae follows: The Project begi+W on State Street at uta intersection .with Hogan Ross at Station 10+00end ext Wade northeasterly along State Street 0.123 miles toStation16 50. On Hagen Road the limit of imprw®ent shell erten! from State Street at Station 1C+00, 1000 feet to Station 20+00. The improvement consists of constructing traffic control islands and realigning the intersection to improve traffic operations. A Fleshing Beacon Will be installed at the intersection' of Hogan Ross end State Street. B. To acquire and pay for all land, rients in lard, and baildiasS necessary to construct and maintain the Project, except those donated by the city to the State. D. To provide striping end traffic control signs asnecessary en a first- time basis. II. AFD the City agrees to do and perform the followine: A. To approve the. layout and coratruction of Federal Aid Project TSM -1401(1) described in Item 1 above under the State agrees. B. To donate to the State all land or ifghts in land owned by the City which are required for the. Project. - C. To authorise the State to alter or eliminate any drainage or drainage, structures deenea unnecesaary ac; part of the Project. D. To pay or snoods any and ;all coats (if required) for the treatment ar,i ultimate disposal of day discharge from storm drainage oysters constructed as part of the Project. E. To furnish, install: and assume all future maintenance area power caste for street lighting providing a minimum average inteiaity of Adbebrimately .0.2 foot candles. F. 1. To assnce all maintenance and power costs for the flashing beacon and ar;,y other signal equipment installed or modified as part of the Projects, end to erpeditioualy correct any deficiency in the fleshing beacon when rewired. 2. To preserve the visibility of said flashing beacon causing any impeir- ant of visibility t0 be assured. 3. Should the Heading beacon be removed or replaced in the future, -avid equipment shall become the property of the State 'without cost 4o the State. To eliminate and prohibit disposal of any open sewage within the limits of the Project. I. To make such charges within the city fire claim, system, city sewers, city water and city street lighting, including service conrectione, manhole adjustments and other city owned and maintained utility fixtures (if eAeting without expense to the State as may be required as a result of the Project._ Any Changes made during the construction of the project will be coordinated. with the contractor's operations. J. To aeerme all claims for damages to piavate underground utility -type instal - lotions where the locations may net be shown on the plana for this project; also to be responsible for the removal, replacement, alteration, or relo. cation of any existing private underground utility type installation (such as wires, water, scene, drain pipes) as may be necessary to parent construg- tion of the Project within the previously described project limits. R. To be responsible for and to notify all utilities that, encept in the case of city, emergency, no service opening peamits for opening city pavement within the limits of the proposed project will be issued for a period of five (5) years from the date of the Project 1. The material shall be uniformly distributed in layers of not more than 8 inches, loose measure and each layer thoroughly compacted by use of approved compaction before successive layers are placed. When backfill is being placed around a pipe or strocture, operations shall be so conducted that the fill is always at approximately the same elevation on both aides of the atrncture. Water shall be added when necessary to increase the moisture content of the backfill material to obtain compaction. puddling or Jetting of backfill will not be allowed. All cheating And bracing used during excavation shall be removed by the utility follow- ing the completion of the work, and all voids resulting from the Use of the sheeting and bracing backfilled slices necessary unless onervide directed by theDepartment'e Engineer.
