"SOLVED, THAT the City of Bangor acquire by eminent domain,
pursuant to its duly adopted Community Development Program real property
owned by Reuben Cohen, Richard Cohen, and Gertrude Halligan (Harry
Cohen Heirs) and designated as Parcel 11-18, located at 248 Hancock
Street, Bangor, Maine, and described as followmEi
A certain parcel of land with the building thereon, bounded and
described as follows, viz: Beginning on the northeasterly side of
Hancock Street at a stake and stones in the dividing line between the
Haynes and Boyd lots, so-called, thence -westerly on said Street thirty
(30) feet; thence northerly one hundred (100) feet on a line parallel
with said dividing line; thence easterly on a line parallel with
Hancock.Street thirty (30) feet to said dividing line; thence southerly.
by said dividing line one hundred (100) East to the point begun at.
Being apart of the same premises conveyed to Harry Cohen by Mollie E.
Ramenkovitz by warranty deed dated July 26, 1943 and recorded in the
Penobscot Registry.of Deeds in Volume 1106, Page 222.
Be it further resolved by the City Council of the City of Bangor that,
n accordance with independent appraisals of value of the above described
property, the amount of damages determined to be just compensation for
the acquisition of the fee simple interest in the above-described prop-
erty is $35,000.00.
STATEMENT OF PACT: 30 M.R.S.A, j 4854 authorizes municipalities to
acquire by eminent domain property, or an interest therein, in
designated slum or blighted areas. In order to exercise this power,
the City Council must first adopt a "Resolution of Condemnation" to
be served upon the property owner(s). After service is completed, the
Resolution is resubmitted to the City Council for its approval or
disapproval after a public hearing. If the Resolution is approved,
the City Council shall cause an action to be commenced in the Superior -
Court.
