Introduced by Councilor Soulas, and 24, 1976
CITY OF BANGOR
(TITLE) (orb#, -Approving Variances in the Curb Cut Ordinance - Oak
Street
By CUM Coa*sd oftAu Cug of Bangor:
ORDERED,
THAT WHEREAS, the installation of new curbing and sidewalks
on Oak Street is presently being undertaken as part of the
downtown Urban Renewal program, and
WHEREAS,_ driveway openings to existing commercial properties
are being established as part of the new construction to conform
to Chapter VI, Article 9, Sec. 3 of the Laws and Ordinances, and
-WHEREAS, it has been determined by the City Engineer that
the configuration of existing buildings on two properties will
require a variance to the thirty-six foot maximum driveway width
as allowed by said Ordinance, namely, one forty-six foot wide
driveway for Darling's, at 97 Oak Street, and one forty-six foot
wide opening, for Rapaport Auto, 32 Oak Street, and
WHEREAS, the City Engineer comments to said variances in
accordance with Sec. 3.11 of saidOrdinance due to the probable
hardship placed upon the operation of those businesses if the
Ordinance were maintained,
HOW THEREFORE, be it
ORDERED, that said variances be granted.
STATEMENT OF FACT:
In the case of Rapaport Auto, this Order replaces a previous
Council Order requesting a fifty foot curb out against the
City Engineer's consent; however, the other main entrance to
the Rapaport building is being reduced to thirty feet, which
makes the request for a forty-six foot opening not unreasonable.
