Twitchell, on behalf of Rapaport Auto Co., requesting a 50 Soot wide curb cut on Oak Street be and hereby is accepted, and be it further ORDERED, that said variance be granted. STATEMENT OF FACT: Chapter VI, Article 9, Sec. 3 of the Laws and Ordinances of the City, of Bangor allows curb out entrances up to a maximum width of 36 feet, with variances to begranted by City Council Order only, subject to the consent of the City Engineer. The City Engineer does not feel that an opening greater than 36 feet is justified in this instance, since the property owner is also requesting two additional curb cuts of 36 feet and 34 feet on Oak Street. rya 16�j IN CITY COUNCIL. Frawley City engineer City of Bangor City Rall Bangor, Maine 04401 Re: Rapaport Auto Co.'- Curb Cuts Dear John After my letter to you of May 30, 1978 and your reply back of June let and our meeting up at Rapaport Auto Co., I have come up with another suggestion which Mr. Rapaport and I would like to have you consider and if necessary present to the City Council. I have photostated the section of the map which you furnished to me and have revised the curb cuts as follows: The southerly curb cut should start at the oil manhole and proceed north for a distance of 36 feet which brings u up to the end of your tapered curb cut at Eta. 6+82. I have indicated this in red on the drawing. The next piece of curbing should then run along to Eta.. 6+98. This has been colored in green on the plan. This curb should stop at that station because to run it further north will put in right in the way of the southerly overhead door going into Rapaport's garage. The next curb cut should proceed for a distance of approximately 34 feet which brings it or to the start of the doorway by the service bays. The curb could then be put in where I have indicated in green for a distance of 8 or 9 feet. This will have to be measured to make it exact. From the end of this curb we would then like a cut running 50 feet in a northerly direction also as indicated in red on the plan. To summarize this, I don't believe we would need to ego to the Council for the first two curb cuts as they are 36 feet or less, but would only need Council approval on the 50 foot cut. Page Two A portion of this 50 foot curb cut is necessary i order for cars toget into the northerly most bay in the garage building and the rest is required to get to and from the lot where Rapaport Auto displays its new and used automobiles. After you have had a chance to look this over, please get back in touch with me and I would appreciate it if you could get this on the Council's agenda at its next meeting. Sequence of Events May, 1976 Site Plan submitted.. June 7, 1976 Planning Board approved Site Plan with conditions. February 16, 1977 City of Bangor entered into a lease with James A. Rapaport for a 50 foot strip of Urban Renewal land abutting Washington Street adjacent to Rapaport Auto site. August 2, 1977 City Engineer drafted a memo indicating that Rapaport Auto site work was not in conformity with the approved Site Plan. August 15, 1977 A meeting was held by the Code Enforce- ment Officer, Mr. Eaton, representatives of the Engineering and Community Develop- ment Departments,Mr. Twitchell and Mr. Rapaport to inform Mr. Rapaport of the discrepancies between the improvements as installed and the approved Site Plan. August 24, 1977 A letter was written to Mr. Rapaport spelling out the problems of non-com- pliance discussed at the meeting and citing the requirements of the Urban Renewal Plan and the Zoning Ordinance which must be met if a "new" Site Plan were to be submitted. (Copy attached.) September 9, 1977 A letter from Twitchell, Gray and Linscott was received by Mr. McKay indicating that Rapaport Auto intended to submit "A Revised Site Plan'. November 25, 1977 A copy of a "New Plan' with cover letter from Twitchell, Gray and Lin- scott was mailed to Mr. McKay. December 30, 1977 A letter was written to Mr. Twitchell indicating the requirements of the Kenduskeag Stream Urban Renewal Plan, which the proposed "New Plan" did not meet. January 11, 1978 A letter was received from Mr. Twitchell acknowledging our letter of December 30, 1977, indicating that the letter and Plan had been referred to the person preparing the "Revised Site Plan". The letter also mentioned discussion of curb cuts on Oak Street with Mr. Frawley. May 22, 1978 A letter was written by Robert Miller, City Solicitor, to Orman G. Twitchell requesting the filing of a revised site plan by June 9, 1978. June 19p 1978 A letter from Mr, Twitchell to Mr. Frawley requesting a variance for the 36 foot maximum curb cut width was received thus precipitating the current Order before the City Council. B. status Of Site Plan The present development is not only not in accord with the filed Site Plan as to layout, curbing, drainage and Landscaping,but it is 'in violation of the set -back and landscaping requirements of the Urban Renewal Plan. The site plan approved on June 7, 1976 is no longer valid as two years have expired since its approval (Chapter VII, Article 21, Section 10 (3) (d)). After considerable discussion the Board voted unanimously to recommend to the City Council that the curb cut variance request be denied and that the City Council investigate such action as it deems necessary to discontinue the use of the property which is not in conformity with the approved site plan.
