THAT Sections 1 and 2 of Chapter Ex of the Ordinances Of the City of Bangor
be repealed and replaced with the following:
ARTICLE 1 - BOILDIRG CODE
Sec. I Building Code Adopted. In accordance
ordance with Title 30, Section 2156,

incorporated by reference, as the minim, standard for the constmction,
alteration, addition, repair, removal, demolition, use, location,
occupancy, and:maintename of all buildings add structures mW their
service equipment, bath existing and proposed, located within the
City of Bangor.
Sec. 2 Amendments to Published Version. Said Building Code is adopted in
its published form as if fully set
forth herein,except as follows:
(1) Article 1, Section 100.1 is amended to read as follows:
100.1 Title: There regulations shall be know as the Building
Cade ofthe City of Bangor hereinafter referred to as "this code."
(2) Article 1, Section 100.2 is amended to read as follows:
100.2 Scope: These regulations shall control all matters
concerning the construction, alteration, addition, repair,
removal. demolition, use, location, occupancy and maintenance
of all buildings and structures and their arrvice equipment a
herein defined, and shall apply to existing or proposed buildings
and structures in the City of Bangor;
except a such matters are
otherwise provided for in the local Jurisdictional charter, or
other ordinance or statutes, or in the rules and regulations
authorized for promulgation under the provisions of this code.

(3) Article 1, Section 105.1 is amended to read as follows:
105.1 Continuation of existing u The legal use and
occupancy of any structure existing on the effective date
of this ordinance or for which it had been heretofore
approved, may be continued without change, except as may
be specifically macovered in this code and the housing code
or as y be domed necessary sary by the building official for
the general safety and welfare of the "regents and the
public.
(4) Article 1, Section 107.1 is deleted and replaced with the
following:
107.1 Building official: Further references in this code
to the "building official' shall be interpreted ta:mean the
Zoning & Code Enforcement Mministration Officer of the City
of Hanger.
(5) Article 1, Section 112.3 is deleted and replaced with the
fallowing:
112.3 By when application is"made: Applications for a
permit shall be made by the owner or lessee of the building
or structure, or agent of either, or by the licensed engineer
or architect employed in cection with the proposed work.
Me full names and addresses of the owner, lessee, applicant,
and of the responsible officers, if the owner r lessee is a
corporate body, shall be stated in the application.
(6) Article 1, Section 113.2 is amended to read as follows:
113.2 Suspension of permit; Any permit issued shall
automatically become invalid if the authorised work is not
comenced within six (6) months after i of the permit,
r if the authorized work is suspended or abandoned for a
period of six (6) menths after the time of commencing the work.
(7) Article 1, Sections 117.3 and 117.3.1 are deleted and replaced
with the following:
117.3 New Construction and Alterations: The fee for a building
permit shall be based on the following schedule of fees:

(8) Article 1, Section 11744 is deleted and replaced with the
following:
117.4 Boylan of Buildings: The fee for a building permit
for the removal of a building oron
structure from e lot to

the same Lot shall be $10.00.
(9) Article L, Section LI7.5 is deleted and replaced win the
following:
117.5 Demolition: The fee for a permit for the demolition
Of a dwelling or structure shall be $10.00, plus $5.00 for
each story over three stories. Io addition, a belated fee
of $10.00 will be charged where demolition has been commenced
prior t0 issuance Of a demolition permit. The fee for a
permit for the association of a small structure, such as a
garage or &had, with no sewer connections, shall be $5.00.
(10) Article 1, Section 121.4 is deleted and replaced with the
following:
121.4 violation Penalties: Any Person who shall violate a
provision of the Basic Code or shalt fall to comply with any
of the requirements thereof orwho shall erect, construct,
alter o repair a building o structure in violation of a
approved plan or directive of the building official, or Of a
permit or
certificate issued under the provisions of the Basic
Code shall be guilty of a civil violation and subject to a fine
of not more than $loo for each violation. Each day such violation
continues shall be deemed a separate offense.

(11) Article 1, Section 122.2 is amended to read as follows:
122.2 Unlawful continuation: Any person who shall continue
any work in or about the structure after having been served
with a stop work order,except such work as he is directed to
parts= to remove a violation or unsafe conditions, shell
be liable to a fine of not less than LIO nor more than $100.
(12) Article 1, Section 125.3 is amended to read as follows:
125.3 Compensation of board of a The third member
of the board shall receive for his services a fee of 350
to be paid by the appellant.
(13) Article 2, Section 200.1 is amended to read as follows:
200.1 Scope: The provisions of this article shall control
the classification of all buildings as to use group and type
of c nstructiag and the definition Of all terms relating
thereto in the City of Bangor.
(14) Article 2, Section 200.3 is deleted and replaced with the
following:
200.3 Application of other laws: Nothing herein contained
shall be deemed to nullify any provisions of the Zoning
Cadivance or any other ordinance of the City of Bangor
pertaining to the location, use or type of construction of
buildings, except as may be specifically required by the
provisions of this ends.
(15) Article 3, Section 300.1 is amended to read as follows:
300.1 Scope: The provisions of this article shall control
the division of the City of Bangor into fire limits and the
general limitations of height and area
of all buildings,
hereafter erected, and extensions toexisting buildings here-
after altered or enlarged as affected by the fire and life
hazard incident to type of construction, use group, density
of development, exterior exposure and accessibility
ssibility of
buildings and structures to fire -fighting facilities and
equipment. -
(16) Article 3, Section 301.2 is deleted and replaced with the
following:
301.2 Fire limits: The fire limits shall comprise all
areas within the city limits of the City of Bangor except
those areas zoned Residential (R-1 through R-5), Neighborhood
Commercial (C-1), and Park 6 Open Space (PW) Zone.
(17) Article 13, Section 1307.2.1 is amended to read as follows:
1307.2.1 Deep excavations: Nhenever an excavation is made
to a depth Of more than 3 feet below the established curb, the
person who causes such excavation to be made, if afforded the

necessary license to enter the adjoining premises, shall
preserve and protect from injury at all times and at his
own expense such adjoining structure or premises which
may be effected by the excavation. If the necessary license
1s not afforded, it shall than be the duty of the owner of
the adjoining premises to make his building or structure
safe by installing proper underpinnings or foundations or
otherwise; and such owner,
a
if it be necessary for the
prosecution of his work shall be granted the necessary license
to enter the premises where the excavation or demolition is
contemplated.
(18) Article 13, Section 1307.2.2 is amended to read as follows:
1307.2.2 Shallow excavations: wherever an excavation is
made to a depth less than 3 feet below the curbthe owner
of a neighboring building 7;r structure, the safety of which
may be affected by the proposed excavation, shall preserve
and protect from injury and shall support his building or

structure by the necessary underpinning or foundations, lf
necessary for that Purpose, he shall be afforded a license
to enter the premises where the excavation Is conteaplated.
(19) Article 14 is deleted in its entirety.
(20) Article 17 is deleted in its entirety.
(21) Article 19, gentian 1800.5 is amended to read as follows:
1800.5 Conflicting laws: Nothing herein contained shall
be deemed to nullify any provisions of the zoning laws o
any other statute or legally adopted rule pertaining to g
building construction of the City of Bangor in respect to
the location, u , height o rof a building and type
of construction, a maybe specifically exempted in
these provisions; nor shall anything herein contained have
the effect of increasing working stresses or reducing egress
facilities and healthprovisions as prescribed in this code.
Statement of pact: The purpose of this ordinance is to provide
for the adoption of 'The SOCA Basic Building Code/1978", Seventh
Edition, published by the Building Officials & Cade Administrators
International, Inc., as the Building Cede for the City of Bangor.
