ORDERED,
THAT the City Manager is hereby authorized and directed, on behalf of
the City of Bangor, to execute an agreement, a copy of which is 6n file in the.
office of the City Clerk, for purposes of providing for a Farmers Market on
Parcel P-6 in the Kenduskeag Stream Urban Renewal Project Area.

BANGOR CORE AFSA DEVEIOPNENT CORPORATION
CITY OF BANGON (hereinafter called "Lessor") agrees to lease to:
MGM COBE AREA DEVELOPMENT CORPIXUTION, a Maine corporation with a place of
business at 55 Washington Street, Bangor, Maine (hereinafter called "Leasee")
the land in Bangor, County of Penobscot, State of Maine, bounded and described
s follows:
Parcel P-6 as shown on the. LandUsePlan for the Benduskeag Stream
.Urban Renewal Project, a copy of which is annexed hereto and marked Exhibit "A".
1. Tenancy under this Lease shall commence on May 15, 1978 and may be
terminated by either party by ten (10) days' written notice given at any time.
Notice to the Lessor shall be. sent to the Lessor by regular mail addressed to
its office at 73 Harlow Street, Bangor, Maine. Notice to Lessee shall be sent
to Lessee by regular mail addressed to its office at 55 Washington Street, Bangor,
Maine, and to the attention of John Libby. Notice of termination shall be complete
When mailing, it being the Intention of this Agreement that either party may
terminate this Lease for whatever reason and at any time.
2. Lessee shall pay rent of $1.00 per year. The fact that said rest is
payable yearly shall not prejudice the right to terminate this Lease at will.
3. Lessee agrees to use said premises solely for the purpose of operating
e Farmers Market for sale of farm products at wholesale and retail.
4. Lessee shall be solely responsible for sanitation, maintenance and
clean-up of said premises and will daily remove from the premises all refuse
deposited thereon. In addition, Lessee shall take all steps necessary to maintain
said premises in a reasonably refuse -free condition during the business day.
5.. Lessee shell be'responsible for assuring that all local codes, license
requirements add ordinances are complied with by. itself and all others. using said
premises.
6. Lessee may place temporary structures on said premises to be used only
for the purposes of this agreement.
]. It is agreed that the Lessor shall have the right to review any sign
proposed to be erected on said premises and shall have the right to reject any sign -
when it deems said sign incompatible with the requirements of the Ordinances of the
ity of Bangor.
S. Upon termination of this Lease, Lessee shall place said pr enises in the
condition it was in on the date of this Lease. -
9. Lessee agrees, to indmmffy and hold Lessor harmless from all liability
incurred as a result Of its occupancy of said premises and it shall provide proof
of .liability insurance rage in the a= of $300,000.00 for each individual and
$300,000.00 for each Occurrence, which coverage Leasee shall maintain during the
term of this Lease.
10. Lessor does hereby authorize Lessee to contract with a third party to
wage and control the day-to-day Waterloo of the premises.
