THAT the provisions of Cbspter x of the Ordinances of the City of Bangor be
deleted and replaced with the following:
See. 1 Title. This Chapter of the Ordinances of the City of Bangorshall
be titled Property Maintenance Code.
Sec. 2 Back Basic Property Maintenance Code Adopted. In accordance with 30
M.R.S.A. g 41 6 "The
SOCA Basic Property Maintenance Code/1978" (First Edition), published
by the Building Officials & Code Administrators International,. lm.,
is hereby adopted as the Property Maivtenmce Code of the City of
Bangor for control of buildings and strnetures as herein prw dedl
and each art all of the pmmisions of said Cede are hereby referred
to, adopted, and made a part hereof, as if fully set out herein, except
as follows:
1.1 Section PM -100.1 is deleted and replaced with the following:
PM -100.1 Title: These regulations shell be known as the
Property Maintenance Code of the City of Bangor hereinafter
seYerred to as the property maintenance cede or "this code."
1.2 Section PM -109.2 is deleted and replaced with the following.:
PM -109.2 Peneityt Any parson, firm or corporation,. who shell
violate any provision of this code shall, upon cowictionthereof,
be subject to a fine Of not less then $10 nor more then $100 at
the discretion of the start. Each day that a violation

1.3 Seetioa PM -110.2 is deleted and. replaced with the following:
PM -110.2 Appeals Board: In order to protect existing
straithce: in the City of Bangor by vigorous enforcement of
the provisions oP this code, there shell be sed is hereby
rreated a Property Maintenance Code Appeals Board, hereafter
eferred to as the Board, consisting of five (5) seashore who
shall be residents of the City of Bangor and appointed by the
City Council. The members shell elect a ehaiemen. All members
serving on the Housing Appeals Board at the time this Ordinevice
is adopted shall remain on the Propetty Maintenance Code Appeals
Board until their terms expire. The Board may adopt from time
to time such written rales and regulations as itmaydeem

ato carry into effect the provisions of this Ordinance.
All meetings of the Board shall be open to the public. A qutrmm
shall consist of four (4) members. The Board shall keep minutes
of its proceedings, recording the vote of each member upon each
question and indicating the absence or failure to vote ofany
member. The final disposition of appeals shell be recorded
by resolution indieating the Board's reasons, all of which
shell be a public second.
1.4 Section is deleted Abel replaced with the following:
P 210.2.1 Board Procedure: At such hearing the petitioner
shall be given an opportunity to be heard end to show why said
decision as interpretation should be modified or reversed.
The hearing will be commenced not later than ten (10) days
after the date on which the appeal was filed; provided, that
upon application of the petitioner or.the Zoning and Code
Enforceannt Administration Officer said hearing may be post-
poned to a date as may be established by the'Chairsan ofthe)
Board. After said hearing the Board shall give written notice
of its decision to the Zoning and Code Enforcement Administration
Officer and to the petitioning party. And person aggrieved
by the decision or the order of the Board may. appeal to the
Superior Carat in accordance with Rule 808, M.R.Civ.P, ire
Zoning and Cede Evforceasnt Administration Officer shall appoint
one member of his staff to serve as secretary for the Board.
1.5 Section PM -111.4 is deleted and replaced with the following:
