City Solicitor - city Ball Bangor, ISE 04401 Be: Banmak Associates - Bangor Mall Subdivision Bear Bob: This letter is written as a follow up to our telephone conversation relative to the above captioned subdivision. It is my understanding -that Sam members of the Council have erpresaeed concern that approval of the final subdivision plan may impose sure Obligation on the Citywith regard to Bangor Mall Boulevard because .the plan bears the notation "to be dedicated to the City of ¢angor." I will take this opportunity to alleviate that concern and do hereby assure you that Banner Associates In Say intends this language to in anm Say. obligate the City to accept Bangor Mall Boulevard as a public way or to impose any other obligation upon the City with regard to the Boulevard. I have been authorized on behalf of Bmmak Associates to give the Council every assurance that approval of the final plan will in way impoa obligation on m on the City nor will they ever make any future assertion to that effect. As you know, we have by separate agenda item requested the City to - accept the Boulevard as a public way, but this IB An entirely separate issue and will rise or fall on its-oun merits. I would like to point out that further delay in approval of the sub- division could be critical in its development. We have several parties who are interested In purchasing aM developing the lots but we cannot consu®ate any transactions until final approval. These parties would like to start construction as soon Ins weather allows, but they all need to obtain site plan approvals for their projectsfromthe City and the DU and to make arranamments for final- ization of financing before beginning construction. it is almost Robert E.
