Streets as Public Ways: ,Fenton Way, By the City CowwcH of de My ofBw .- THAT WHEREAS, the construction of the streets in the Third Phase of the Judson Heights Subdivision, including Shady Lane, Fenton Way, and Balsam Road, has been satisfactorily completed to acceptable City standards, and WHEREAS., the Developer and Owner of said Subdivision, Judson M. Grant, Jr., has, by the attached petition and Deed, offered to transfer said streets to the City without claim for damages for the purpose of accepting them as public ways in accordance with Sec. 3025 of Chapter 304, Title 23, M.R.S.A., NOW, THEREFORE, be it ORDERED, That the City Treasurer be and hereby is authorized to accept the attached Deed for said streets from Judson M. Grant, Jr., and be it further ORDERED, That said streets, including Shady Lane extending from Judson Boulevard to its termination at a cul-de-sac, Balsam Road extending from Shady Inane to Burleigh Road, and Fenton Way extending from Judson Boulevard to Balsam Road, be accepted as public ways, and be it further ORDERED, That said streets be added to the Official City Map, to be named and known as noted above. Kindly review the copy of the proposed deed and, if it meets with you approval, please notify Attorney Everett W. Gray, of the firm Twitchell, Gray, Linscotb d Badger 82 Columbia Street in Bangor; upon notice of your approval of the proposed deed, the original deed in executed form will be submitted to you for presentation to the Eangor City Council in order that the Council may consider formal acceptance of the Judson Heights - Section 2 streets as public ways. Please advise Mr. Gray of any further requirements which the City may have for the acceptance of these etreetg. JThank you for your attention to this matter. GRANT, JR., of Bangor, County of Penobscot, State of Maine, for cansideratior, paid, release to the CITY OF BANGOR, a body corporate and politic, located at Bangor. County of Penobscot, State of Maine, thefollowing described real estate, together with the improvements thereon, situated in said Bangor, County of Penobscot, State of Maine, via Certain portions of the land show on three subdivision plans entitled 'Judson Heights - Section 2, Bangor, Penobscot County, Maine for Judson M. Grant, Jr., Owner -Developers dated April 10, 1979, prepared by Andrew J. Shy W, Land Surveyor, and recorded in Penobscot Registry of Deeds in Map File Nos. 0102-I9 D103-79 and D104-79, namely, those portions of said land designated and shown on said plans a "Penton Way' (from its intersection with Judson Boulevard to its intersection with Balsam Road), •'Shady Lan (from its intersection with Judson Boulevard to its termination a cul-de-sac a w snoo said plan recorded in Map File No. D102-79), and 'Balsam Road" (from its intersection with Shady Lane to its intersection with Burleigh Road). Reference is hereby made to the aforesaid plans and the record thereof for a more particular description of the Premises hereby conveyed. For Grantor'ssource of title, reference may be had to the deed of Mollie E. Higgins, at of, to Judson M. Grant, Jr. dated December 9, 1969 and recorded in Penobscot Registry of Deeds in Volume 2114, Page 41 and the deed of Irene I. Palmer to Judson M. Grant, Jr. dated May 13, 1974 and corded in said Registry in Volume 2455, Page 204. This conveyance is made subject to the rights, privileges easements, e covenants and restrictions described and expressed in the deed of Judson N. Grant, Jr. to Bangor Hydro -Electric Company, dated October 10, 1979 and recorded in Penobscot Registry of Deeds in Volume 3031, Page71, to which instrument and the record thereof reference may be had for a more particular description thereof.' This deed is given pursuant to the provisions of Section 3025 of Chapter 304, Title 23, of the Maine Revised Statutes Annotated. BETTE L. GRANT, wife of the said JUDSON M.
