Central.Byslneas District By CH1' COMWa Of tie aty of Ram . _ ORDERED, THAT the City Manager is hereby authorized to sign the attached Memorandum of Understanding for a Federal Aid Project for traffic operational improvements in the Central Business District, and beit further ORDERED, that the sum of Three Thousand Four Hundred Forty-two Dollars ($3,442.00) be authorized for transfer from the Reserve for Future Construction Account - General to cover one-half of the City's share of the project, with future con- sideration to bel given to an Application for Reimbursement of the City's 'share, under the State Aid Fund. The Comsmbity must indicate theirna in these a mmitments a outlined by signing the original of the Meaorandumin then spaces provided and return it to the Mpety Chief Engineer, Project Development, Maine Departeent of Transportation, Auguste, Mein 04333. This signed document wet be received prier to the beginning or. continuation of preliminary engineering activities. A. Definitions 1. Total Estimated Cost The total estimated cost of a project is based on a projected date Of advertising for bids and represents the best estixgAe at the beginning of the project development process of the cost of engineering, right of way, construction, and other items considered necessarT sideredssary to satisfactorily complete the project. Total estimated cost of the subject project Is $51.WO 2. Non -Federal share The non -Federal chare represents the total estimated cost of a Project lees the estimated Federal contribution. For purposes of local reimbursement on this projects the non -Federal share of the subject project is _27_% of the total estimated cost, or $13,990 3. Comity Share The c mmenity share represents the portion of the total estimated cost of a project to be said available by the Community. joint State Aid funds can be utilized for all or part of the cossunity share for projects on the State -Aid or State Highway system when no higher priority project exists that requires the bas of these PUWe within the Cemsemity, and the Department, through its local Division Office, concern in the expressed deeir of the Comity to utilize these foods. The c mitt' share of the subject project is 50% of the non -Federal share, or $6.885 B. Reimbursement - 1. Prior to the beginning or continuation of preliminary engineering activities, the Comity shell submit to the Department, one-half of the comity share far the above stated project, or $3.442 2. At the time of contract 'award, the Department will advise the Cosmu,uty of the bids received and the Comity chill, upon receipt Of this information, indicate, in writing within ten days, their concurrence in the contract award and agree to achent the balance otheen community share, S , within 30 days subsequent to the award of the contract'. The total financial obligation of the Community toward thin project will be as stated in paragraph A.3 above, undenn significant changes in the crops of work agreed to by the Comity during the project development precess result la an increase in the "total estimated cost." C. Project Development 1. The .Department, prior to the initiation of the public hearing process, will arrange for a meeting with the officiala of the Community to review the project limits, scope of work, etc., based on the besteinlornmtion available. 2. Additional r- - ws may be raqueoted by either the Cmm unity Or the Department at any point in the projectdevelopment proceos. 3. The Comity and the Department retl, the right to terninate the project at any time prior to the actual acquisition of right-of-way. projects cannot be terminated by the Community subsequent to right-of-way acquisition without concurrence by the Department. a Projects terminated by the Comity The Comity shall be responsible for Ube entire non -Federal share of the total - expenditures incurred against the project at the time of termination. b.
