Fsogram, based on local coat sharing, it is necessary for the City--Rew'a of Sensor hereinafter referred to as the Comity, and the Maine Department of Transportation, hereinafter referred to ad the Department, to agree to project coordination and reimbursement procedure. The Comity moat indicate their concurrence in these cC®itmenta a outlined by signing the original of the Memorandum in the spaces provided and return it to the Deputy Chief Engineer, Project Development, Isaias Department of Transportation, Auguata, Maine 04333. This signed document must be received prior to the beginning or continuation of preliminary engineering activities. A. Definitions 1. Total Estimated Coat The total estimated cost of.a project is based on a projected date of advertising for bids and represents the beat estimate at the begiraiag of the project development process of the cost of engineering, right of way, construction, and other items considered necessary to satisfactorily complete the project. Total estimated cost of the subject project is 8 1.450.000 2. Pon -Federal Share The non -Federal share represents the total estimated cost of a project less the estimated Federal contribution. -Por purposesof local reimbursement on this project, the non -Federal share of the subject project is 27of the total estimated coat, or $ 364.500 3. Community Share The c unity share represents the portion of the total estimated oat of a project to be made available by the Comematy. joint State Aid funds can be utilized for all or part of the community where for projects on the State -Aid Cr State Highway system when n higher priority project exists that requires the use of these funds within the Community, and the Department, through its local Division Office, concord in the expressed desire of the Comity to utilize these Made. The c mmunity share of the subject project is 50 '$ of the non -Federal share, or $ rp9.250 B. Reimbursement 1 Prior to the beginning or continuation of preliminary engineering activities,. the Community shall submit to the Department, one-half of the eCecunity share for the above stated project, or $91.125 2. At the time of contract award, the Department will advuse the Cemmunity of the bids received and the Community shall, upon receipt Of this information, indicate, in writing within ten days, their cOcCUneence N the contract award and agree to submit the balance of the commmity share, $�]j��, within 30 ds subsequent to the award of the contract. The total financial obligation of the Comity toward this project will be as stated in paragraph A.3 aboveg unless significant changes in the scope of work agreed to by the Community during the project development process result in an increase in the "total estimated cost." when this is the case, e r Weeendum of Understanding will be developed revising the "community share." If the "total estimated cost" of the project at the time of contract award is less then that stated in the Memorandum of Understanding, then the Community's cond payment required by paragraph B.2above will be reduced proportionately. C. Project Development 1. The Department, prior to the initiation of the public housing procesb� will arrange for a meeting with the officials of the Community to review the project limits, seope ap work, etc., based on the best Information available. 2 Additional reviews may be requested by either. the Community or the Department at any point in the project development process. 3. The Comity and the Department retain the rigbt to terminate the project at any time prior to the actual acquisition of right-of-way. Projects cannot be terminated by the Community subsequent to right-of-way acquisition without concurrence by the Department. a. Projects terminated by the Community The Comounity shall be responsible for the entire non -Federal shore of the total expenditures incurred .against the project at the time Of termination., b. Projects terminated by the Department The Department shall be responsible for the entireon-Federal share of the total expenditures incurred against the project at the time Of termination. Projects terminated by Matusl Agreement The Co®onity and the Department will share, Proportionately, as with total project funding: in the responsibility for the non - Federal share of the total expenditures incurred against the project at the time of termination.
