THAT Chapter VIII, Article 19 of the Laws and Ordinance of the City of
Hangar be deleted in its entirety and replaced with the following:
PARR AND OPEN SPACE ZONE
Sec. 1 Purpose The P & 0 Zone is established to preserve parks, park
land and open space land. Such zoning will protect
the public and private interests in these areas by limiting
the uses to certain recreational and appropriate resource
utilization activities.
See. 2 Basic Requirements. Buildings or land used or occupied, and
buildings erected, constructed, recon-
structed, moved or structurally altered, whether permitted
uses or special exceptions, shall comply with the requirements
of Article 21 of this Ordinance.
Sec. 3 Uses. In the P & 0 Zone, uses are controlled as follows:
(1) Permitted uses
(a) Agriculture, including the production of dairy pro-
ducts and crops, the keeping and raising of livestock
and poultry, except feedlots
(b) Tree farms, forest nurseries and timber harvesting
(c) Harvesting of wild crops
(d) Public parka, playgrounds, reservations, preserves,
sanctuaries and open and natural areas
(e) Hiking, saddle, carriage, ski, and snowshoe trails
(f) All activities necessary far managing and protecting
the land including but not limited to forest manage-
ment activities, surveying, fire protection
(g)
Within the confines of the Municipal Auditorium,
Bass Perk fairgrounds, and Municipal Golf Course,
activities which may customarily be carried on within
these facilities including but not limited to:
athletic events, exhibitions,
conventions, entertain-
ment, sales, recreation
programs and sales and service
which may be customary to such uses, unless limited or
prohibited under subsection (2) or (3) and within the
confines of Bass Park including the Municipal Auditorium,
those uses which are permitted under the terms of the
will and codicils thereto, of the late Joseph P. Bass.
(h)
Accessory uses on the same lot and customarily
incidental to and subordinate to the above uses
(2) Special
Exceptions The following uses shall be allowed in a
P. & 0 sone but only upon granting of a
special
exception permit by the Planning Board pursuant to
Article
22 of this Ordinance.
(a) Outdoor swimming pools
(b) Outdoor tennis courts
(c) Marinas, boat launching facilities and related boat
rentals
(d) Outdoor ice skating areas
(e) Botanical and zoological gardens and similar nature
exhibits
(3) Prohibited Uses Any use not specifically permitted in this
Article or in Article 21 of this Ordinance.

After careful consideration of the requirements of this zone, the
Heard voted four in favor and none opposed to recommend approval of the
above Zoning Amendment.
