STATEMENT OF FACT: This Grant represents 75% of the total cost of Final Design of the Interceptor Sewer. The State's share is 15%, and the City's share is 10%. GRANT CONDITIONS - This grant is contingent Coon, and the obligations of the United States of America axe subject to, compliance with all 'State and Federal laws, regulations and executive orders, including, without limitation, 40 Cade of Federal Regulations Subchapter A, Part 6 and Subchapter B, Parts 30 and 35, and the following Special Conditions. In the event of nonfulfillment of or noncompliance with any such requirement or condition, in addition to other remedies as may be available to the United States of America in equity or at law, this grant may be annulled and all funds paid theretofore, may be recovered. 1. This grant is subject to -the approval of the Compliance Report by the Office of Equal Opportunity. 2. Approval of this project for Federal financial assistance does not constitute Federal sanction or approval of any changes or deviations from established water anality standards --criteria or implementation dates --or from dates established by applicable enforcement proceedings. 3. The applicant hereby agrees that it will make timely application for all necessary permits, including any air and water discharge permits, and any sewage sludge disposal permits required, and that it will conform to all requirements of such permits when issued. 4. During performance of the project for which this grant is awarded, the Applicant agrees to comply with the Civil Rights Act of 1964, 42 U.S.C. 2000a at seq, a5 amended and all Executive Orders and regulations promulgated pursuant thereto. At approximately 30% of the design stage for the project, the grantee and/or the consultant engineer, shall notify the EPA Project officer s0 that a meeting can be arranged, at the discretion of the EPA Project Officer, between FPAMaine DEP, the D. S. Fish and Wildlife Service, Army Corps of Engineers, the consultant and the grantee, as appropriate. lo.
